After extensive discussion at the June 29, 2000 Board of Health meeting the following conditions were found to be outstanding. 1) metal flashing at the riser below the rear exit — must be secured to prevent injury 2) Bathroom floor — replace with an easily cleanable non -porous surface 3) Gas stove — replace knob on metal arm 4) Gas stove — apply for gas permit, plumbing/gas inspector will conduct inspection on gas connection 5) Under sink shut off valve — plumbing inspector to determine whether repair is needed. According to the inspector shut off valves are necessary under sinks 6) Back door screen — repaired as needed to prevent continued problems The Board of Health has granted an extension to July 12th, 2000, to complete the correction of these items. If the bathroom floor cannot be completed in the time allotted, a signed agreement for work must be submitted to this office. Please contact the Health Department when the list of items has been addressed so that a re -inspection may be conducted. At that time a letter of compliance will be issued to close this matter. It was taped with electrical tape. There are other knobs detected by the inspector that cannot be read (missing words like "bake", "broil"). It is my understanding that the permit was taken out and the inspector did inspect the installation. 4) The shut off valves were all inspected, I believe. 5) The screen door now has glass in it. Health Inspector North Andover Board of Health Dear Susan: JUN - 5 On May 23, 2000, an inspection was done at 179 Main Street (1 st floor) in No. Andover. Six violations were revealed at the location. The owner was given seven (7) days (after receipt of the order) to correct the violations. According to our calculations, this window of opportunity has expired. Only one (the ceiling) of the six violations has been addressed by the owner. Our mother has been released from the hospital, after her stay at TCU following her operation, and is now back in the apartment with the same living conditions as when she fell on the hole in the steps. Nothing has been done to fix, repair or replace the problematic conditions of the apartment . Would you please tell us the next steps in this process ? We do not believe that the owner has appealed the order within the seven day window. In addition to the missing smoke detector, back steps problems, bathroom floor condition, kitchen stove and windows problems, we also discovered, while changing a kitchen sink knob, that the shut off valve under the sink could not be shut off. We would recommend that this also be addressed to the owner. Thank you for your help in this matter. Is there anything else required of the tenant at this time to get some action taken by the owner ? E,� �� �- ��z � S� / ziu June 17,2000 Susan Ford Health Inspector North Andover Board of Health Dear Susan: On Saturday, June 17, 2000, upon entering my parents' apartment at 179 Main St. , No. Andover, I sensed a strong odor of gas in the apartment. The odor was coming from the stove. We could not resolve the problem . Subsequently, we called the gas company and they sent over a representative within an hour. Shortly after his arrival, he confirmed there was indeed a gas leak from the stove. His resolution was to disconnect the stove and make it inoperable. He said he could not officially condemn the stove but did not want it being used. This is the same stove that the landlord (John Willis) was ordered to replace in your May 23rd, 2000 letter to him. It has been almost a month since your letter was sent to him and still the stove has not been replaced. My mother (age 87) now has no method of cooking a hot meal and no way to heat water to make a cup of coffee or tea. I have been told that the landlord has allegedly "taken measurements" to replace the stove. We are now well beyond the "taking measurements" time frame. It is now beyond the scope of the oven door being held up by a coat hanger and burners inoperable. This situation could truly have been a life and death situation. Thank you for all your help in this matter. We will be at the June 29th hearing. I do hope that Mr. Willis will address the stove issue well before that date. As of this writing, we do not know the status of plans for the stove. John Willis Jr., the renter is an elderly couple, Mr. and Mrs. Walter Parker. They have lived in this apt. for over 30 years. We were called for an inspection because Mrs. Parker fell and broke her hip. (Mr. Parker is presently in Prescott Nursing Home, hoping to come home soon.) The sons were disgusted with their attempts to get Jay Willis to repair some items. Said "he would get to it when he could". I went to the home, wrote an order letter and then Jay asked to come before the Board. I don't know exatly why he wants to come before to the meeting. He did not meet the (7) day correction of the violations, and there is really no arguing the few problems that there are. I guess he just doesn't want to do what we ask, in the time we require. In fact he insists that the upkeep is primarily the renters responsibility. I believe that he is even planning to bill the renter for the repair of the bathroom floor!?! , because he says it was replaced two years ago. Mrs. Parker says that this is the original floor and she has be covering those holes with a rug for years. She is very disappointed, their families have been friends for years. As for the stove, it was dangerous. The door had no spring and the gas leaked. Jay admittedly told me that he didn't even know that the stove was his responsibility. He did not pull a permit to install the new (old ) stove. In fact the new stove went to Jay's house and Jay's old one ended up in the renters home. It may not be pretty but it does work. As the owner has no grounds for a modification, it seems like he is just trying to buy time. In fact, he is now in violation of the Health Order. 1 just wanted to fill you in. See the attached for items corrected and items outstanding. Outstanding items The gas stove has been replaced with a used stove. A little rusty in the front, however it works properly. The stove is missing a knob on the self-cleaning arm leaving a flat metal piece exposed. The metal must be covered for safety reasons, otherwise it is in adequate condition. Please note: The owner did not pull a gas permit for the gas stove installation. Information received r , x today from Mr. Willis indicated that a permit will be applied for and an inspection conducted by the gas inspector. Jay Willis indicated that he has hired someone to replace the bathroom floor, but we have not received any work order. I told him that the seven days had long since passed and he is in non-compliance with this issue. He must bring a signed work order for the meeting. The metal flashing on the back step has not been repaired Additional items not previously mentioned, newly identified. 1) There is no water shut off valve under the kitchen sink 2) The rear screen door has the screen pulling out. This had not previously observed, but is the landlord's responsibility. I believe the landlord and the tenant's son will attend the meeting. WMLIS (1951-2000 Ret.) The work as requested by you is underway. Some confusion seems to have arisen regarding the various misadventures I appear to have had with Plumbers. For your information and for any future dealings we may have, I wish you to know and want to make it perfectly clear that "I DO NOT LIE." If I had connected the gas stove myself, I would have admitted that fact. The gas stove was connected by James Greene, MA License 21878, a copy of his card is attached with this letter. As he is quite busy, I have had some difficulty contacting him. He did, however, return my calls yesterday afternoon, July 6th and informed me that he would do anything necessary to resolve the problem with the Town of North Andover. In the meantime, as a result of your additional work to be completed namely, the shut off values under the sink which were not an issue until your second letter to me, I employed the services of another plumber through James Carroll to complete the work requested. When I mentioned to him the gas connection permit to the stove, -he told me it would not be necessary for me to have Mr. Greene apply for the permit that he would do so simultaneously with the work he would have had done for me with the shut off valves for the sink. The work Mrs. Parker saw my son, Nathan and I perform in connection with her stove consisted of on the day of installation, contacting James Greene who appeared at her apartment that morning and disconnected her existing stove followed by Nathan helping me pick up the new stove and transporting it to her apartment. My son and I then removed the disconnected stove and remove it from her kitchen and brought the new stove inside. While we were waiting, Mrs. Parker requested of me that because she was not able to so, would I wash the floor where the stove was to be placed before it was installed. I did so and upon completing the washing of her kitchen floor, the plumber arrived with his helper and they installed and tested the gas stove before leaving. I understand that when Jim Carroll appeared and applied for the gas connection permit he was told that he did not have to "cover for me". This apparently implied the fact that your department believes that I installed the stove. This fact is categorically incorrect. I will keep you informed of the progress on this matter and hope that if you have any questions or issues you will contact me. We were treated very fairly last Thursday (6/29/00) evening in being allowed to speak on behalf of our parents. The Board listened attentively and I believe came to a proper and humane conclusion from the facts and proof (or lack of them in some cases) presented. As stated at the meeting, it should be in everyone's interest to fix all the problems in the apartment and thus get the issues off 'your plate'. the July 12th deadline, I believe, is an extremely fair amount of time for all work to be completed. You have been most thorough, efficient and quite professional in your duties and responsibilities involved in this action. You also managed to stay quite calm during the meeting and focused on the task at hand, restating the law and encouraging the cooperation of the landlord. I will deliver a note to your office on July 13th summarizing the progress of the specific tasks that were demanded of the owner. I do hope that all work will have been completed at that time.
