Bower requesting a variation of Sec. 7, Par. 7.1, 7.2, 7.3 of
Table 2 of the Zoning By Law so as to permit variance as to
lot area, street frontage and side yard setback on the
Premises, located at Autran Avenue.

House allowed to stand
despite neighbor's objection

A new house a neighbor is calling
"oversized" will be allowed to
stand despite his objections.
Paul S. Connors, 18 Autran Ave-
nue, received a decision at the
January 10 meeting of the Zoning
Board of Appeals on his petition as a
party aggreived by the building in-
spector. While these types of peti-
tions come up often at meetings,
they are filed against the position of
building inspector, not a specific in-
spector. In this Case, the petition is
filed over a decision made during
the brief tenure of inspectors Sal
Scirreto and, earlier, Daniel McCo-
naghy.
During the December 13 meeting,
Connors filed his petition, stating
that the single family house built by
Thomas and Louise Bowers, 719
Winter St., in 1986, on the lot next to
his, was built to larger specifica-
tions than what the Appeals Board
had approved and that the building
inspector was at fault for allowing
the building to continue.
Jane O'Malley, an attorney work-
ing for Town Counsel Kopelman
and Paige, had read through .the
cover and decision letters and
observed that there was nothing
written in the decision regarding
the house size. The only mention of
house size came in the cover letter
which was not a part of the decision.
She ruled that so as long as the
building remained within the
variances established, there was no
violation.
The board voted unanimously, at
the January meeting, to turn down
the appeal on the grounds that the
original building inspector's deci-
sion was properly made.
Between the time that the house
was built and the last Board of
Appeals meeting, the house was
sold to two brothers who have not
been named in the petitions and
who declined to comment.
The board also dealt with two in-
dividual problems involving side
setbacks.

The Board of Appeals held a public hearing on Tuesday evening, January 10, 1989
upon the application of Paul S. Connors as a Party Agggreived for a review of a
decision made by the Building Inspector and other authority on the premises lo-
cated at Lot 3, Autran Avenue. The following members were present and voting:
Walter Soule, Acting Chairman, Raymond Vivenzio, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on December 1, 1988 and
December 8, 1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Ms. O'Connor, the Board voted
unanimously, that the original Building Inspectors decision be UPHELD on the
grounds that the size of the existing structure falls within the setback variance
granted in the original decision of August, 1985.
The Board finds that this decision will not adversely affect the neighborhood
or derogate from the intent and purposes of the Zoning ByLaws
Dated this 11th day of January, 1989.

Every application for action by the Board shall be made on a form approved
by the Board. These forms shall be f4rnished by the Clerk upon request.
Any communication purporting to be an application shall. be treated as mere
notice of intention"to seek relief until '.such time as it is made on the

be furnished by the applicant in the manner therein prescribed.

On August 15, 1985 this Board filed a decision in.the above matter
whict. did not clearly set forth the basis for granting the variance
requested by the Petition. The purpose of this memorandum is to
clarify the matter.
The Board voted unanimously to grant the variance as requested for
a 5,000 sq, ft. lot subject to the following conditions:
- Only a single family dwelling may be constructed thereon.
- The existing garage on the Bower lot must be demolished
prior to the issuance of the building permit.
- The side setback of the dwelling shall be 15 ft. on the
west side.
- The rear setback of the dwelling shall be 25 ft.
- The plans must be revised and resubmitted to the Board showing
a description of Lot A and Lot B as well as the conditions set
forth herein.

In granting the variance the Board finds that each ,of the. conditions ,
of Section 10.4 of the Zoning ByLaw have been satisfied. Specifically,
the Board finds that the lot in question was deeded as a separate lot;
that the size of lots in the immediate area are of a similar size and,
the Board has granted in the past in this neighborhood _.similar
variances.
The hardship in question relates to the use of the lot because of its
size and shape and the change of zoning in the area which prohibited
its use for residential purposes. The Board finds that the relief
granted is not a detriment to the public good and in fact is beneficial
thereto by providing necessary affordable housing in the area. The

STATEMENT IN SUPPORT OF PETITION
OF W. THOMAS BOWER AND LOUISE A. BOWER
The Petitioners are requesting a variance from the lot area requirement, street
frontage requirement, and side set -back requirement in the zoning district known
as R-4, as defined in the North Andover Zoning By -Law. The required lot area
is 12,500 square feet, the required street frontage is 100 feet, the required side
set back is 15 feet.
This parcel of land is defined in a deed to W. Thomas Bower and Louise A. Bower
dated July 28, 1977 the premises concerned with this petition were specifically deeded
as a separate parcel and a separate lot in this deed to Mr. & Mrs. Bower. This vacant
lot was lawfully laid out and duly recorded by a Plan in 1920, specifically this lot
is described even to this day as Lot #3 on a plan entitled "Fairland Manor, North
Andover, Massachusetts, owned by City Suburban Land Company, October 20, 1920, W.E.
Lancaster, Surveyor", recorded with the Essex North District Registry of Deeds as
Plan 406.
Mr. & Mrs. Bower request that this lot be granted a building permit for a house
to be constructed according to the variance plan submitted to the North Andover Board
of Appeals. Pursuant to this plan there is proper and sufficient frontage and proper
and sufficient rear yard set back. This lot is located on Autran Avenue which is not
an accepted street in the Town of North Andover, and where almost every lot has a
demension of 5,000 square feet as laid out according to plan 406. Many houses in this
neighborhood are in fact on 5,000 square foot lots. The character of the proposed
dwelling is keeping with the characteristics of this neighborhood.
The granting of a variance to construct said dwelling may be granted without
substantial detriment to the public good or substantially derogating from the intent
or purpose of the zoning by-law.
To not grant a variance on Autran Avenue, not an accepted way, would be a
financial hardship to the Petitioners. This lot would be of no substantial use to
the Petitioners. From the face of their deed indicating this lot as a separate and
distinct parcel, the Petitioners were led to believe that this lot was in fact a
buildable lot.
The hardship is due to the general area which in the past couple of years has been
classified to require a higher lot area than the original plan as recorded at the
Registry of Deeds. Because of the number of 5,000 square foot lots on Autran Avenue
this hardship affects this particular parcel, but not all of the residential four
district.
In the past the Board has granted such variances to properties of 5,000 square
foot lots on Autran Avenue. This Board has also granted variances to 5,000 square
foot lots in other instances, the most recent decision being dated June 26, 1985 on
Columbia Road and Sutton Street.
To grant this variance for the construction of the house as presented to the
Board of Appeals will not be detrimental to the public good or derogate from the
intent and purpose of the Zoning By -Law. The granting of said variance will be
in conformance with both the neighborhood and consistant• with prior Board decisions.

Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
August 12, 1985 upon the application of W. Thomas Bower & Louise
A. Bower. The hearing was advertised in the North Andover Citizen
on July 25, 1985 and August 1, 1985 and all abutters were notified
by regular mail. The following members were present and voting:
Frank Serio, Jr., Chairman, Alfred E. Frizelle, Esp., Vice Chair-
man; Augustine W. Nickerson, Clerk; William J. Sullivan, and
Raymond A. Vivenzio.
The petitioners seek a variance from the provisions of Section 7,
Paragraph 7.1, 7.2, 7.3, and Table 2 of the Zoning By Law so as
to permit variance as to lot area, street frontage and side yard
setback.
Mr. and Mrs. Bower were represented by Mr. Peter Caruso, and he
- showed a plan of the proposed dwelling. The lot is located on
Auturn Avenue with 5,000 square feet of land and is on an unccepted
street, where almost every lot has a demension of 5,000 square feet
as laid out according to plan 406. The petitioners were led to be-
lieve that this lot was in fact a buildable lot. Many houses in
this neighborhood are in fact on 5,000 square foot lots. The
character of the proposed dwelling is in keeping with the surround-
ing neighborhood.
The abutter on the side of the proposed lot, Mr. P. Connors, spoke
in opposition. Claims square foot requested is less than � the
size of the zoning bylaw requirements and dwelling would be closer
to his property than allowed. Concerned for safety of children and
future value of property.
Motion made by Mr. Frizelle to grant variance subject to the following:
demolish existing garage on Bower lot before Building Permit issued
for lot in question. Limit west side setback to 15 feet, rear to
25 feet, limited to single residence only, grant lot size 5,000 feet,
easterly 10 feet and revise plans to show old lot as A and new lot

SUBJECT: Complaint of granting of Auturn Avenue variance -
I regret that due to the short notice of your request, the Board of
Appeals will not be represented at your meeting tonight regarding the
granting of a variance on Auturn Avenue.
The appearance of the Board in explanation of its decision before
any body other than a court of law purusant to a proper appeal as
perscribed in Chapter 40A is currently the only avenue permitted by
1 aw .
I further feel that any discussion of a closed public hearing
before another public board could have serious legal ramifications
if the decision was appealed in a court of law.
