Hi Michele: We repaired the boot on the vent stack last Thursday morning. There was a small hole on the high side of
the old boot. Hopefully this repair will solve the problem. Please let me know if there is anything else that needs to be
done.

North Andover Health Department personnel had a meeting with the occupant and
their attorney, James C. Fischer on November 2, 2016, in regard to additional housing concerns
at the above referenced address. The tenant had requested another inspection and additional
follow up on items noted in the original Order to Correct. A Letter of Compliance was issued
on September 9, 2016 for this dwelling unit but the Health Department did note a few items that
need your attention. Please address the following:
1. Please submit any additional documentation and follow up reports from your
Exterminator;
2. Please provide us a copy of the letter you sent to your tenant in the subject unit
informing them that the light fixture in the basement common area is on the other
unit's electric meter;
3. Water staining on the ceiling below the second floor hallway has returned. It was
unclear if the stain came through the paint or if there is another issue. Please
determine if there is an intermittent leak from somewhere and the cause of the water
staining;
4. There is a small gap between two wooden floor planks and area where it appears a
small piece or sliver has broken off and left a small space in the upstairs hallway
floor. This gap/ space needs to be filled in.

I have reached out to the tenant directly, as well as attorney Fischer, in an attempt to
schedule a time when they would be available to allow you, your representatives and
contractors into the dwelling for assessment and repair purposes but have not been able to
ascertain a date or time at this point. I will contact you as soon as possible with dates and times
that you, your representatives and contractors will be allowed to access the dwelling.

questions, comments or concerns. Our hours are 8:00-4:30 on Monday, Wednesday and

This is to confirm my voice message to you of last week in response to the subpoena served on North Andover Health
Department officials. Brian Lagasse is out of the country and will not be returning until after December 1. Michelle
Grant is available to testify but was not the lead inspector in this matter and therefore suggests that it would be more
appropriate to have Mr. Lagasse testify.
I would appreciate hearing back from you confirming your understanding that Mr. Lagasse is not available to testify and
as to whether you will require Ms.Grant to be present.

Dear Center Realty Trust:
North Andover Health Department personnel conducted an authorized inspection of
your property at the above referenced address on 7/18/16, in response to a complaint filed with
this Department. The inspection revealed violations of the State Sanitary Code, Chapter II as
listed on the attached Violation Form.
You are hereby ORDERED to correct the violations within the time allotted on the
enclosed form. Failure to comply within the specified time period will result in a fine of up to
$500 per day' in accordance with 105 CMR 410.910 of the State Sanitary Code. The fine will
continue to accrue until the subject property is brought into compliance with this Order to
Correct. Each day or portion thereof during which the violations continue shall constitute a
separate offense.
You have the right to request a hearing before the Board of Health if you feel this Order
to Correct should be modified or withdrawn. A request for said hearing must be made in
writing and received by the Health Department within seven (7) days from receipt of this
Order. At said hearing you will be given an opportunity to be heard and to present witnesses

Don: I have spoken with A & M Appliance, and they have tried three or four times to contact C. Willis to no avail. I
have scheduled them to deliver and install the stove on Thursday September 1St at 1:00 PM to 2:00 PM. I have also

As required by the North Andover Health Department, the Trustees again are requesting access into
Unit 18 A to assess the necessary work. The Trustees must look at the alleged deficiencies so to
schedule the appropriate repair contractors.
To date the Trustees have repaired the openings around the cellar door, installed keyed dead bolts in all
cellar doors. We have had a pest control company place bait traps in three of the cellars, excluding 18 A
because the door remains locked. We have removed all gates from the fence so as to maintain a clear
passage from the house to the street. We have had our Air Conditioning service company inspect and
re -charge the A/C unit suppling Unit 18A. Again, because of your refusal to allow entry into the Unit,
they have not been able to inspect the three (3) A/C units in the apartment.
INSPECTION:
We again request access into the apartment to inspect the alleged problems. We are available between
9:00 AM and 4:00 PM Friday 8/12/2016 or Monday 8/15/2016.
REPAIRS:
We can do the repairs on whichever day is good for you, Wednesday August 13, 2016, or Thursday
August 14, 2016.
If you do not allow us to inspect Unit 18A, and do the necessary repairs, our only course of action is to
seek an order from the courts.

This issue with your complaint with the North Andover Health Department, the repairs, needs to be completed

months, in which time I have accrued additional debt as a direct result of my uninhabitable living situation.
I was advised by the Lawrence housing court on my rights and the course of action I should take, and as they were
willing to work with me while you were not, I trust their recommendations.
In saying that, I can be around on Monday, and once you provide me with a response to my email sent back on
8/2/16 (reference forward below), I will be more than happy to find a time that works for everyone.
I will state again as I always have, I never wanted any ill will or bad blood, I am a single mother, this is my home, this
is my daughters home, we are rooted here and I do not want to disrupt her life. Ideally, pay bills on time and landlord
keeps up and maintains the property in a timely fashion, they go hand and hand. I am a good, honest and fair person
(and I think we all know what happened her) so I hope that we can come to a mutually agreeable resolution and move
forward in a non hostile way. I have a double mastectomy coming up the end of this month and then follow up surgeries
for months to follow, got a lot going on; really these issues need to be addressed, resolved and put behind so the future
is non problematic; this is not desired by anyone I am sure.

As it relates to your request, the letter states access request on 8/2 and also lists dates for repair access. Please
clarify your request.
Are you asking for access on 8/2 and one of the additional dates, or merely access for the additional dates listed?
Once you clarify the request, I will consider the request for access to support issues identified by the Health
Department.
Please be mindful that the lack of clarity and urgency surrounding your request and correlation to the Health Department
is a direct result of the missing support for resolution of these items per many, many, many requests to Ben. As a
result of the extended negligence in not managing the residence to code becomes illustrated with your urgent action
request due to the Health Department's involvement. Please appreciate the time, money, and cost spent trying to get
repairs to a standard that really is considered minimum according to standards.
Thus, while we work to satisfy access and repair mandates in a timely fashion, it is appropriate to discuss the
reparations and support the Trust is willing to afford. It is critical to final resolution of this matter that we establish
agreeable guidelines for cost reimbursement, rent consideration, and other punitive areas for my sole satisfaction. It is
fully my intention to provide my child a safe, inhabitable, and code valid residence and where that has not existed,
clearly the expectation of reparations is partial to the overall resolution of this situation.
I would appreciate a few options in respect to working towards an amenable agreement for my residence costs and
transition costs associated with a suitable home for my family -and absent of the issues that have plagued this mutual
engagement.
Lastly please be aware, in regards to access to my residence, I will only provide you a permittable time to enter once
these issues and possible (agreeable) resolutions have been discussed.

A couple of additional things.
1. Regarding the Willis complaint, one of the items was some reference to lead paint in the unit. The unit 18a (note
lower case a) was inspected and approved by the Mass Health Department, the certificate is listed online. Charlie
Salisbury was able to find it. So this should remove one of the items. We will be working with our attorney on this
case as she is not co-operating with allowing access for repairs. We, the Trustees need to get in and inspect the issues
listed on the complaint. One is a leak in the basement and we are not sure if it is a water or sanitary leak and she has
changed the lock there as well. This is the main utility room for the building where the services come in.
2. With unit 20A Johnson regarding screens, Ben provided the tenant with temporary insert screens while he was
waiting for the storm/screen windows to come in from the manufacturer. They have arrived today, these will be
installed this week. Her boyfriend has evidentially left and she failed to send in last months' rent and Ben had to
collect another check in person, she claimed that the check got lost in the mail.

Hope all is well otherwise. Talk to your attorney but I believe the ounce you notify her of when you will be entering and
you give her the option of being there when you enter, then you have the right to enter your property for the purpose of

withholding or other accommodations she is seeking. We knew she was not going to pick up the certified mail but it
covers you in that you made the proper attempts to notify her and by her responding to your letter then we know she
received the posted copy or the copy sent by regular mail.
Also, Lisa Valentine from unit 20A Johnson Street has just filed a complaint regarding no screens on her windows. HUD
requires compliance with the housing code and is going to withhold her housing assistance. I have not scheduled an
inspection but was going to. her number is 978-655-6650. Can you please call her and if needed replace her screens as
soon as possible.

As it relates to your request, the letter states access request on 8/2 and also lists dates for repair access. Please clarify your request.
Are you asking for access on 8/2 and one of the additional dates, or merely access for the additional dates listed?
Once you clarify the request, I will consider the request for access to support issues identified by the Health Department.
Please be mindful that the lack of clarity and urgency surrounding your request and correlation to the Health Department is a direct
result of the missing support for resolution of these items per many, many, many requests to Ben. As a result of the extended
negligence in not managing the residence to code becomes illustrated with your urgent action request due to the Health
Department's involvement. Please appreciate the time, money, and cost spent trying to get repairs to a standard that really is
considered minimum according to standards.
Thus, while we work to satisfy access and repair mandates in a timely fashion, it is appropriate to discuss the reparations and
support the Trust is willing to afford. It is critical to final resolution of this matter that we establish agreeable guidelines for cost
reimbursement, rent consideration, and other punitive areas for my sole satisfaction. It is fully my intention to provide my child a
safe, inhabitable, and code valid residence and where that has not existed, clearly the expectation of reparations is partial to the
overall resolution of this situation.
I would appreciate a few options in respect to working towards an amenable agreement for my residence costs and transition costs
associated with a suitable home for my family -and absent of the issues that have plagued this mutual engagement.
Lastly please be aware, in regards to access to my residence, I will only provide you a permittable time to enter once these issues
and possible (agreeable) resolutions have been discussed.

Ben has attempted to notified the tenant that we would like to get in to do repairs documented by the board of
health, 48 hour notice +. He posted this notice on the door and sent by certified snail mail. The attachment is the
notification that the certified letter was never picked up as we guessed would happen.
To my knowledge she has not contacted any of the trustees so far.
I am also copying the North Andover Board of Health representative on this lack of progress.
