October 26 , . 1983 Frank and Mavis Dushame 18 Lexington Street Petition No. -57-'83 The Board of Appeals held a public hearing on Monday evening, September 19, 1983 upon the application of Frank and Mavis Dushame, The hearing was advertised in the North Andover Citizen on September 1 and 8, 1983 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice Chair- man; Richard J. Trepanier, Esq., Clerk; and -Associate Members Walter F. Soule and Mauri-ce:S.-Foulds.- The petitioners seek a variance from Section 7, Paragraphs 7.1 and -7.2 and Table 2 of the Zoning By Law so as to permit relief from the area and frontage requirements to allow the subdivision of a-parcel_into two (2)_ lots at the North side of Lexington Street and known as 18 Lexington Street. Mr. Dushame testified that he would like to purchase the dwelling located on Lot A on the plan, known as 18 Lexington Street, con- taining 12,000 square feet with 75 feet of frontage on Lexington Street. The Zoning By Law requires -12,500 square feet and 100 feet of frontage in the R-4 zoning district. He is proposing to create Lot B on the plan, containing 8,000 square feet w,ith.100 feet of frontage on Lexington Street. He further testified that the sale of Lot B is necessary to finance the purchase of 18 Lexington Street and to make the necessary re- pairs to the dwelling. In addition, a barn in disrepair on Lot A will be removed. Mr. Dushame added that there are similarly sized and smaller lots in the neighborhood and that there will be an easement running from Lot B through Lot A for sewer. On October 17, 1983, the Board rendered its decision with Members Serio, Frizelle, Trepanier and Associate Members Foulds a.nd Soule again present and voting. A motion made by Mr. Frizelle and.seconded by Mr. Foulds to grant the variance passed unanimously. Subsequently, a motion was made by Mr. Frizelle and seconded by Mr. Trepanier to reconsider the motion to grant the variance. This motion passed unanimously. Mr. Frizelle then made a motion to grant the variance as requested subject to the condition that only a single family dwelling be con- structed on Lot B. This motion was seconded by Mr. Trepanier and passed unanimously. The Board finds that Section 10.4 of the Zoning By Law has been satisfied. In particular, the Board finds that the unusual shape and size of the parcel creates a hardship to the petitioner, pur- suant to the Zoning By Law.
