A. The particular use proposed for the land or structure: The proposed use is a daycare facility, and includes a complete redevelopment and improvement of the parcel, which will eliminate the.existing gravel yard and structures and provide an attractive landscaped colonial -style facility. The variances are needed to allow for the proper layout of a high-quality landscaped colonial -style building with parking placed to the rear and out -of - sight. B. The circumstances relating to the shape of such land especially affecting the property for which the variance is sought which do not affect generally the zoning district in which the property is located: The parcel is odd -shaped in a triangle, and also has very expansive and unusual distances from actual roadway pavement to Rights of Ways—these factors, combined with the relatively small size of the .parcel, do not allow for a reasonable and responsibly -planned use without the relief sought for the front setbacks. C. Facts which make up the substantial hardship, financial or otherwise: Please refer to the attached Alternative Layout Plan, for illustrative purposes— this layout would meet the required building setbacks, but would result in an unsafe, unattractive, undesirable, and infeasible project for any proposed use. The parcel is odd -shaped and triangular; with extensive unusual ROW widths, which would not allow any reasonable development. Not allowing the setbacks as requested would require additional unnecessary pavement, would place a sea of parking in front of the building, would force. an odd. -shaped triangular building, and eliminate the opportunity for reasonable landscaping. Not allowing the setbacks as requested would diminish the value of this lot as well as abutting lots, and would severely diminish the overall `presentation" of this gateway lot entrance into the Town of North Andover and present an unattractive first impression. Alternatively, allowing the setbacks per the Proposed Development Plan would result in an attractive, well-planned site that the Town can be proud of. D. Facts relied upon to support a finding that relief sought will be desirable and without substantial detriment to the public good: This parcel is one of very few parcels along the Route 114 corridor which is zoned Industrial -1 and surrounded by other zones and uses which employ the building setbacks which are requested. The relief sought would allow for a very pleasing landscaped site of true colonial character, with parking hidden in the rear per the philosophies of the more -stringent Village Commercial master plan. The proposed layout is clearly desirable in terms of efficient and safe site planning as well as a noted beautification and services improvement to the community. E. Facts relied upon to support a finding that relief sought may be given without nullifying or substantially derogating the intent and purpose of the bylaw: Refer to the arguments above—allowing the relief sought will yield a safe facility which will present a high-quality landscaped colonial character that the Town strives for, while meeting all the other goals and regulations of the bylaw. In fact, the design intent is to follow the more -stringent Village -type planning elements in. other areas of Route 114. This particular parcel is located in the Industrial -1 spot zone situation which requires extended setbacks due to anticipated industrial buildings of the type that could not be built here due to the lot geometry. Thus, redeveloping the lot with a high-quality colonial day care building actually supports the intent and purpose of the bylaw. Little Professionals, inc. All of the safety issues outlined in a previous memo from Chief Stanley and Chief Dolan have been addressed and improved to our satisfaction. The Playground has been moved and barriers will be erected. The traffic pattern has been improved. While we would like to review the traffic impact study, the Police Department has no other issues with this project at this time. 4) DPW The Division of Public Works has reviewed the above referenced plan and has the following comments: A. The Applicant is strongly encouraged to connect to town water and sewer systems. It is recommended that the Applicant contact the Developer of"The Meadows" to coordinate and agree on proposed water and sewer connections. B. On site drainage facilities should be reviewed by VHB. C. The proposed backflow preventor must be reviewed and approved by Dennis Bedrosian - Superintendent at the Water Treatment Plant, 420 Great Pond Road, 978-688-9574. 5) Conservation Conservation reviewed the site several months ago and determined no wetland resource areas existed on site, however off-site wetlands may exist. An existing drainage pipe outlets to the rear of the property and flows through a small ditch, through a culvert under Sharpner's Pond Road and into a wetland resource area. My review letter requested the applicant to investigate whether wetland resource areas exist within 100 feet of the property boundaries or within 100 feet of proposed activities. At the TRC meeting, the applicant stated that Michael Howard from Epsilon Associates has reviewed the site and prepared a letter stating no wetland resource areas within 100 feet of the site. Letter should be submitted to the Conservation Department for review and confirmation prior to filing for site plan approval with the Planning Department. 6) Planning The Planner supports ZBA approval subject to the conditions outlined by the Fire Chief. Subsequent Site Plan Approval by the Planning Board is required, but the applicant is advised to first obtain a determination from the Conservation Department regarding off-site wetlands. It would also be helpful, if the final decision regarding water and sewer connections are not available, to have the Board of Health decision regarding septic capacity prior to site plan review. In addition to the plans submitted, for site plan review the applicant must submit a complete drainage plan, traffic study and fiscal and community impact statements as outlined in Section 8.3 of the North Andover Zoning By -Law. 7) Health The Health Department did not have a representative at the TRC meeting, however, if the applicant is not able to connect to town water and sewer systems, the applicant will need to file with the Board of Health. Unfortunately, there is one very important site concern that needs to be addressed prior to the Health Department signing a building permit application. That is the issue of potable water. The septic plan itself has been approved and that letter will be forthcoming. Unfortunately, a concern over the private well that was being proposed for this site arose, so today; I contacted the MA Department of Environmental Protection to determine whether this would be of any concern to the Department. I spoke with Claire Golden of DEP. I verbally referenced to her key elements of the project such as; parcel size, projected number of occupants per day, septic component locations etc.. Ms. Golden immediately indicated that there might be problems with this planned private water supply. As proposed, the water supply will be servicing over 25 persons per day; therefore it will be a transient non -community water system. This system will be subject to restrictions regarding items such as nutrient loading and zones of protection Ms. Golden can be contacted at the DEP (617) 654-6516. She will be able to direct you to the appropriate DEP personnel to address the concerns. It has also been brought to our attention that there is the possible availability for municipal water to this area in the near future. The Health Department personnel have reviewed your food establishment application that was submitted in response to the correspondence from my office dated July 25, 2005. The letter sent to you outlined conditions that needed to be met to move to the next stage. (See attached letter) Items #1, and #5 were completed as requested. One person has been certified in food handling in regards to #6. Items #2, #3, #4 were not addressed in the application. Without these items, the Health Department can approve only prepackaged non- potentially foods be provided to the children. These foods are to be stored in a dry area, 6 inches above the ground, the storage area must not be in an area below any hazards such as sewer pipes etc. Shelf stable milk may be used for the cereals and snacks. This milk does not need to be refrigerated and therefore it will be acceptable to the health office. The use of a self-contained cooling unit provided by a vendor would not be acceptable unless a specification sheet on the refrigerator to be used is provided. This is needed for back up milk bags as is usually needed on site. Without additional information, as requested in #4, the use of a contractor/caterer is not approved. As was previously indicated this caterer was to be "the Real McCoy". Michele Grant, Health Inspector, spoke to this caterer last month. The operator indicated that they intended to provide trays of food to be plated out for the children. This office will notify The Real McCoy again and let them know that they are not approved to supply catered food in bulk at any time or separately bagged daily without the health office receiving the information requested in #4. Without the specification sheets on refrigeration, as noted in #3, no % gallons of milk (whole gallons are never acceptable) may be used for service to the children. This is also due to the fact that no hand sink has been identified in the prep area, as requested in #2. Also, note that single service dishes, cups etc. may be supplied to the children. There are no facilities towash these items on site. Under the guidelines listed above, Little Professionals food application for service of prepackaged non -potentially hazardous food, at a daycare facility, has been approved. Prior to the Health Department sign off on the building permit, the Health Department personnel must conduct an on site inspection. Please contact this office for this inspection. Prior to issuance of the permit to operate a final inspection should be requested 24-48 hours prior to opening for business. At that time all cleaning should be done, bathrooms and hand sinks stocked with soap pumps and paper towel dispensers. If all is acceptable at this inspection, then the permit will be given to the operator at that time. If you would like to submit additional information in regards to this application, please do so prior to your anticipated opening date, so that this office may review the permit status. If you disagree with any decisions made in relation to your application, you may request to be heard at the next regularly scheduled Board of Health meeting to discuss the issues. For clarification, I sent your request to the Department of Public Health Food Division. Last Friday I received a phone call from DPH regarding the issue. The outcome of the phone call is basically as follows. 1) You must submit the completed 2 page application that we provided to you, to the Health Dept. for a "daycare that serves food". Attach to the application a description of all food related activities that you intend to provide. Similar to your letter. Or you could attach the letter as written. This list should again support that you will not be conducting ware washing 2) The Health Department will review the application and the services you intend to provide. If it is determined that you are only doing minimal ware washing, than the 3 -bay sink requirement may be waived. However, there must be a hand sink available in the break room. I believe you had provisions for one sink already. If you choose, you may change the existing proposed sink to a designated "hand sink only" or add another. 3) Please submit specification of any equipment you will be purchasing that will be used to keep foods for the children, hot or cold. It must be NSF or UL approved. 4) Please submit a detailed agreement for service with any food vendor providing food to the clients such as the Real McCoy. The agreement must support the claim that no ware washing will be necessary in your establishment. Also, no plating of bulk potentially hazardous foods should be noted. 5) Along with the application, please submit a fee of $110 which is standard for daycare facilities in N. Andover. This is an annual fee. The permit is good until Dec. 30th of each year. If you plan on opening after Nov. 1st we will issue the permit through the next calendar year. Otherwise, you will need to renew in Dec. and pay an additional $110. 6) As for the requirement to be certified in food handling. You may be exempt as stated in the food code. This will also be looked at once we receive your application. Our next communication should be when you are ready to submit you application. If you are choosing to do more food prep etc. you will have to comply with the entire food code. In addition, any approval letter will note that upon 2x year inspections if conditions change you may need to upgrade the kitchen to meet code. We are continuing to seek completion of the elevator and satisfaction of the lien. During the interim, the second floor of our building is not being used for public access, yet private offices for immediate family members.
