SERVICES 1. The CONTRACTOR agrees to drill a 6 inch diameter well in a workmanlike manner on the property of the OWNER in a location which is mutually agreed upon between the OWNER and the CONTRACTOR. Further details may be shown on a rider attached, if any. i 2. The OWNER represents and warrants that they own the property and agrees to provide the CONTRACTOR with adequate access to and from the drilling site and to provide the CONTRACTOR with adequate water during drilling procedures. 3. The CONTRACTOR agrees to exercise reasonable care during drilling procedures. The CONTRACTOR bears no responsibility for (a) impairment caused from moving equipment to and from the drilling site or when extracting debris, or (b) for disposing of the extracted debris. 4. The CONTRACTOR agrees to drill a well UP TO 300 FEET DEEP OR TO OBTAIN A MAXIMUM FLOW OF 300 GALLONS PER HOUR, WHICHEVER MAY COME FIRST that includes 20 feet of casing, and a pump. Electrical wiring is to be brought from the well to the house by a licensed electrician. 5. If the CONTRACTOR finds that the well is completely dry (no signs of water at all) CONTRACTOR will not charge the owner the drilling price up to 300 feet. If the CONTRACTOR drills beyond 300 feet and the well is still completely dry, the OWNER shall pay the full drilling price beyond 300 feet. If the CONTRACTOR drills beyond 300 feet and any water is found, the OWNER pays the full drilling price from the first foot. Irrespective of whether or not water is found the OWNER shall pay for all installed casing beyond the first 20 feet from the ground level. II. COMPENSATION: 1. The OWNER agrees to pay the contractor $.,;1n5',& for drilling a well and related materials as outlined in paragraph 4, Section I. Should drilling be required beyond 300 feet an additional $ 10.00 per foot will be charged. If more than 20 feet of casing is required, an additional $ 10.00 per foot will be charged. THE OWNER MAY ORDER DRILLING STOPPED AFTER 300 FEET. SUCH ORDER MUST BE IN WRITING AND IS NOT EFFECTIVE UNTIL DELIVERED TO THE CONTRACTOR. 2. The OWNER agrees to the following payment schedule: A deposit of $ 1 Q 0 o,1lam_ upon signing agreement. The balance of $1, poj.� , DD upon commencement of work. OWNER is responsible for any unmarked utilities. OWNER is responsible for any and all permits and fees. If the OWNER requests that the CONTRACTOR handle the permits, an additional $100.00 will be charged above the actual permit cost. III. CANCELLATION: 1. The OWNER acknowledges receipt of a Notice of Cancellation form in duplicate which were given to the OWNER Prior to signing this agreement. 2. The CONTRACTOR reserves the right to cancel this agreement without penalty or obligation at any time if any conditions are found that may endanger equipment, workers or the environment. IN WITNESS WHEREOF, THE PARTIES HERETO HAVE EXECUTED THIS AGREEMENT AS OF THIS DAY AND YEAR WRITTEN ABOVE.
