Solomont, Partner, N.A. Associates, c/o ADS Management, Inc., 360 Merrimack Street, Lawrence, MA. The hearing was duly advertised in the Lawrence Eagle Tribune on May 31 and June 7, 1988. The following members were present Paul A. Hedstrom, Chairman; John L. Simons, Clerk and Erich Nitzsche. Absent were George Perna and Michael Leary. John Simons read the legal notice to open the public hearing. Due to the fact that the Board lacked a quorum, John Simons made a motion to continue the public hearing until June 30, 1988. The motion was seconded by Erich Nitzsche and voted unanimously by those present. On June 30, 1988, the Planning Board continued the public hearing on ADS Management. The following members were present and voting: Paul A. Hedstrom, Chairman; George Perna, Vice - Chairman; John Simons, Clerk; Erich Nitzsche and Michael Leary. John Simons read letters from Mass. D.P.W., Board of Health, the Fire Department and the Building Inspector. John A. James, attorney for the applicant spoke to the Board and introduced Mr. Jeff Lewis and Mr. David Dunlop. Joe Borgesi also spoke to the Board giving them background on the project and citing that State and local Boards have reviewed the project. Mr. Dunlop passed out packets to the Board members on the site plan. The purpose of the Site Plan is to review the proposal to construct a 142 bed, 85,200 sq.ft., 4 story nursing and retirement center on 4.2 acres on the West side of Route 114 near Berry Street in a Village Residential (VR) Zoning District. Accessed from Route 114, the project would have on-site septic system and a dry sewer. The applicant has met with the Technical Review Committee. Page 2: Shoe box type lighting will be used. Questions were raised about the height of the building - 4 stories vs 35 feet. The mean average height of the building is 161.34. Erich Nitzsche asked Scott Stocking, Town Planner, what the bylaw stated. Scott said the the bylaw stated mean. State D.P.W. said an acceleration lane was needed. Questions were also raised on the septic system not complying with Title V and also the drainage calculations. The septic system will be reviewed by the Board of Health. Bill Hmuricak, D.P.W., will go over the drainage calculations with Joe Borgesi. A motion was made by John Simons to close the public hearing and take the matter under advisement, seconded by Michael Leary and voted unanimous by the,,- Board. On July 21, 1988, the Planning Board held a regular meeting. The following members were present and voting: Paul A. Hedstrom, Chairman; John Simons, Clerk; Erich Nitzsche and Michael Leary. George Perna was absent. A draft decision was presented to the Board by the Town Planner, Scott Stocking. After a.brief discussion, amendments were made to Conditions #2.3,.#7 and #8. A letter was received and read from the D.P.W. and their concerns will be incorporated into the decision. Also added was a condition that states that "No Certificate of Occupancy before the Planning Board receives the As -Built Plans. A. The specific site is an appropriate location for such a use, structure, or condition; B. The use as developed and conditioned in this decision will not adversely affect the surrounding neighborhood; C. There will be no nuisance or serious hazard to vehicles or pedestrains; D. Adequate and appropriate facilities will be provided for the proper operation of the proposed use; E. The Special Permit application before us is in harmony with the general purpose and intent of this Bylaw. The Planning Board makes the findings as required under Section 8.35 that the site plan generally complies with Town Bylaw requirements and still requires additional approvals from State agencies. Therefore, in order to fully comply with the approvals necessary to construct the facility as specified in this special permit before us the Planning Board hereby grants a special permit to the applicant provided the following conditions are met: I. Conditions to be met prior to the plans being endorsed by the Board and recorded with the Registry of Deeds Office: 1. The proposed access design for this site from Route 114 shall be approved by the State DPW. 2. The proposed radius for the acceleration lane shall be revised to allow vehicles to turn into the lane without entering the traffic lane of Route 114. 3. Certificate from the Board of Health that the septic system design meets Title V requirements. 4. Revised set of drainage calculations be supplied and approved by DPW. 5. The site plan shall be revised to show the following conditions received from DPW: a. The proposed dry sewer should be extended to the edge of the State Highway layout and a manhole should be installed at that location. The invert of the sewer in the manhole should be the highest elevation possible without conflicting with other on-site utilities. b. A separation of 10 feet shall be maintained between the water and sewer pipes. C. The proposed hydrant near the entrance to the property should be installed on the east side of the water main. d. At the rear of the building, the proposed water main should take a more direct route toward its terminus in order to eliminate unnecessary bend. The proposed hydrant at the rear of the building should not be installed adjacent to the dumpster. e. The proposed 7 foot radius at an intersection angle of 30° will make it difficult for traffic to exit easterly onto Route 114. The final radius design for the driveway shall be approved by the Board. f. Suitable erosion control measures should be provided on-site to mitigate the potential for damage to the area at the outfall of the existing state drainage. g. A complete set of approved plans with up-to-date revisions must be on file at the Department of Public Works prior to issuance of any permits for this site. 6. Revised landscaping plan to be submitted and approved by the Board which shows additional plantings including, without limitations, the following: a. Junipers shall be placed along all parking areas in order to screen the areas from Route 114 and adjacent properties. The vegetation shall screen the parking areas with four season screening. b. Four (4) additional shade master locus trees shall be planted along the six (6) space parking area adjacent to the main entrance. C. Additional trees and shrubs shall be planted in the picnic area adjacent to the building. d. The area along the north westerly boundary to remain undisturbed to the extent possible. The area disturbed to construct the fire access in the area shall be reforested with pine trees upon the completion of the structure in a manner acceptable to the Board. e. The retaining walls which are visable onthe outside of the structure in front of the building shall be treated with wood, stone or other material and shall not be exposed concrete. The retaining areas and berms shall be landscaped with low lying shrubs. 7. Extend the sidewalk in the front of the building to the existing house and adjacent to the ambulance space. 8. The following conditions shall be filed with the Registry of Deeds Office and adhered to by the Special Permit before us: a. Building shall meet all NAFD requirements related to fire safety. b. An erosion control plan to be utilized during construction shall be submitted to the Planning Board prior to construction. C. All permits from the State DPW for work within Route 114 shall be obtained prior to any construction activitywithin the right-of-way. d. All conditions placed on this development by the Board of Appeals decision issued October 27, 1987 shall be met by this development. e. The existing house will be utilized as administrative offices for the facility as indicated on the site plan before us. The building is a structure of historic interest and shall not be razed. f. No Certificate of Occupancy shall be issued prior to a certified As -Built Plan is presented and accepted by the Board which verifies that the project was constructed as shown in the plan cited and contained in this decision. The petitioner is notified that the legal notice has been prepared and the cost of the Party in Interest fee. The signs currently standing in front of Sutton Hill Nursing and Retirement Home are outdated and are a potential hazard. Two new signs are being provided by Genesis ElderCare to replace the current signs. According to the Village Residence Zoning District by-law, signs must measure no larger than 21 x 21 For this reason, we have submitted the application for a special permit. The six points in item #9 are addressed here. The particular uses for the structures are for advertisement, easy identification, and visibility. One sign will replace the existing sign, already situated next to Route 114. The second sign will replace the sign closer to the entrance of the building. To address point 2, we believe these are appropriate locations for the structures. As the original signs are being replaced, there will be no nuisance or any serious hazards to vehicles or pedestrians. The signs are non -illuminated, free-standing structures that do not require special operations. According to the Village Residence Zoning District by-law, signs cannot measure larger than 2ft. x 2ft. However, the existing signs measure 48" H x 84" W and 28" H x 30" W respectively, which are the same measurements as the new signs. This information must be presented to the Board of Appeals prior to the issuance of a building permit or any other type of permit for construction on the site. the Board finds that the petition is for a nursing home as set forth in the Zoning Bylaw and that it meets the requirements set forth in Note 9 of Table 2. The Board has determined that the provisions of Section 10.31 have been satisfied and that the location for such use is adequate. In accordance with the authority of Section 10.31(2), the Board has imposed conditions for the protection of the neighborhood. Specifically the conditions require added park- ing, a single entrance/exit and most importantly, sewerage. The requirement to tie into a sewer line on Turnpike Street is deemed most important by the Board and expressed such desire to the petitioner. The Board hesitated tying the hands of the petitioner by re- quiring the petitioner to tie into the sewer before construction, however, the Board underlines the importance of the matter. Please note the following: 1. We have revised the number of parking spaces to 90 spaces. See site plan for location. We also incorporated sufficient parking spaces for the handicapped. 2. The house which presently exists on the site shall remain as is except for general site modifications due to construction of drives, utilities, etc. The Owner agrees that the house will be used for ancillary services only. 3. We have redesigned the parking lot to comply with a single entrance which shall line up with Berry Street and will be subject to the approval of North Andover and State of Massa- chussetts D.P.W. requests. We have also included a decleration lane as required by the State D.P.W. 4. It shall be noted that even though we have designed a complete on-site sewage system in accordance with Title V and submitted same to the Town Board of Health. We also show a condition of the Board of Appeals, a dry sewer line running from the proposed building to the street. This has been done so the facility can tie into public sewer when it becomes available. 5. We would also like to point out that in order to comply with item #3, our office had to redesign the ground floor plan to relocate the main entrance to the building. This was submitted to the Board of Appeals which reviewed same and subsequent to a Public hearing determined that the changes that were made were acceptable, subject to North Andover Fire Departments review and approval. Our engineers have review the new site plan with the Fire Chief and at his request we are going to provide access to the northwest side of the building by providing an 8" subsurface gravel base with grass cover. See dotted line on site plan showing location of this access.. We have revised our lighting layout due to the redesign of the parking lot and show the hydrant locations as requested. We believe that this project, as submitted, should not provide adverse impact to the surrounding area and it is consistent with the Board of Appeals decision for the approval of this type of use. The addition will contain a physical therapy and rehabilitation facility for in-house patients. No new bedrooms are proposed in the addition and no increase in the number of patients is proposed. To summarize the drainage design, all roof runoff will be infiltrated into the ground under the proposed parking area. No new curb cuts or driveways are proposed. The added parking will be accessed using an existing driveway and turnaround area. No new outdoor storage or display areas are proposed. Also, the proposed addition and parking area are not visible to any neighbors as they are screened by woodland out back and to the right, and somewhat in front, and their location is uphill and to the right of the entrance. No new refuse areas are proposed. The one existing light pole in this area will be relocated about 25 feet to the grassed area in the center of the turn around. In addition, the handicap ramp and entrance will be illuminated for pedestrians. Regarding traffic, since there will be no increase in the number of bedrooms or patients, we do not foresee any significant increase in traffic. There will be four new employees, so there will be a small increase in traffic. The proposed addition will connect to the utilities in the existing building, including sewer, water, electric and cable. We do not project any additional costs for public services.
