F NORTH q 00 p O CDO 171 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition: 4150-90 DECISION The Board of Appeals held a public hearing on Tuesday evening, May 14, 1991 upon the application of Robert & Beth Bonenfant requesting a Special Permit from the requirements of Section 4, Paragraph 4.121(7) of the Zoning Bylaw so as to permit construction of a family suite for use by Mrs. Bonenfant's parents, John & Evelyn Melia on the premises located at 1806 Salem Street. The following members were present and voting: Frank Serio, Jr., Chairman, William Sullivan, Vice -Chairman, Walter Soule, Clerk, Anna O'Connor and Louis Rissen. The hearing was advertised in the North Andover "Citizen" on April 17 and April 24, 1991. Upon a motion by Mr. Sullivan, seconded by Mrs. O'Connor, the Board voted to GRANT the Special Permit as requested, subject to the following conditions: 1. the premises be occupied by Evelyn & John Melia; 2. the Special Permit shall expire at the time that Evelyn & John Melia cease to occupy the family suite; 3. the Special Permit shall expire at the time the pre- mises are conveyed to any person, partnership or corporation; 4. the applicant, by acceptance of the Certificate of Occupancy issued pursuant to the Special Permit, grants the Building Inspector or his -lawful designee the right to inspect the premises annually. The vote was unanimous. The Board finds that the petitioner has satisfied the pro- visions of Section 10, Paragraph 10.31 of the Zoning By -Law s . Robert & Beth-Bonenfant pg. -2- May 28, 1991 and the granting of this Special Permit in particular will not derogate from the intent and purpose of the Zoning By -Law nor will it adversely affect the neighborhood.
