Re Home Repairs Mary Ellen, It is evident that we are going to argue to argue, and that's not what I wish to do. I had hoped that we could have completed the job in it's entirety for you. You have decided to go another way and that's fine with me. T is is wliatT'm willing to do. I will-shiriglethe roof to the -pump room and to the cabafla building or give you five hundred dollars and walk away, nothing more than that. I will also need to get access to the two dehumidifiers that are in the basement, the heater that is your garage - - - --- and -the two propane tanks -at once-. They areata rental cost -of $ 64.00 dollars a day: At this point, I see no advantage to leave them for another contractors use - the rental company will not allow it. I don't think you are taking several issues into consideration. Payroll - it's not just what the worker is paid --- - —in -his check. -There -are payroll taxes that -have -to -be matched -by --the company, workman'scompensation.-. insurance (based on the payroll) that have to be paid, benefits, etc. This is not the only job that J. Tierney ..-Construction-is involved in. -There is_a union affiliation with all.the unions. At a cost.of a.laborer of $16.40 per hour for benefits, carpenters are at an even higher rate, iron workers are at $ 22.50 for benefits - plus _-- - --------.. _ --their-hourly. rates on top_ of_the_benefits._-_ -__.-_ _.._._-______.. _.__The hole_in the_garage_(concrete wall) has to be fully dried out before protective liquid roofing material is applied, to ensure that there are no more leaks. Due to the weather, it was not drying. It takes time. As far as not completing anything, please refer to the list I have supplied you twice. Also, I would like for you to make phone calls on what it costs to dump building materials these days. I hope that the person that you are talking to really understands what's wrong with your home. It is evident to me that the person does not have the knowledge of entire project,-concerning"what it's going to take to finish this project. With all my experience in construction, you're in for a reality check on what it's really going to cost to clean it all up (basement)_ _believe that you will find -another qualified contractor to do the work, but not at the price that I gave you for all of the work that needs to be done. We talked about what you wanted done and the price that it was going to cost to put this home back in good order (after many years of not properly doing the work or not doing it at all). As you and I agreed, the cost was going to be roughly $20,000.00 to $25,000.00, as stated to you, to do all of the work on your home that we had discussed. As we started the work, the garage was the first that you required to do. We did remove a lot of junk material, as there were 6 full pickup truck loads of stuff dumped. We also agreed that the roof on the pump room and the cabana room need to be done (they had not been done in 43 years). We agreed to paint the outside of both buildings and that will be done in a timely manner. As you can see, they have been stripped and new felt has been applied to the roofs of both of these buildings. The list of all of the work that has been completed was supplied to you on August 25, 2004 (copy supplied). I have personally gone on your roof today and sealed it with the proper adhesives to stop the leaks in your home. We both know it's going to rain on Monday night and Tuesday morning and I wanted to stop any further leaking. I plan on going back up there, in the next week, to ensure that there is enough roof cement there for the winter. Let me tell you the rest of the work and about what's it going to take to just do the liquid roof that is part of your patio area over the garage and leaking. First, the old roofing material has to be removed and the four areas of where the leaks are right now have to be repaired with new lumber, plywood, and facials boards. Then the rubber that goes below the liquid roofing material has to be laid down. At that point, the cold liquid has to be applied. This has been discussed with you and I have offered to place the cold liquid down at an angle (a Run off). That would make sense so that the run-off of water would be directed off the area. This will take about four days to complete. There will be approximately 2-3 more loads of building material to be dumped. n V Then what I thought was a very good plan was to let the dehumidifiers to run for another week to ensure that the area had dried out in your basement. Then we would take test areas and open the walls to ensure that there was no mold learking inside them. If there were, I had planned to remove all the drywall necessary to get at this problem and bleach out the walls using air masks and yes, the white suits to ensure our safety. I had also started to look for an in -the -wall dehumidifier for the area there, as to help in the future. Some of these designs are no good and some I'm looking into. In any case, I was going to get rid of I would not guarantee that it would not come back as people need to realize that air needs to move around and not sealed up to certain rooms. A dumpster will have to be brought in for the removal of all debris. The next project was going to be the windows, as we have discussed, all windows were going to be replaced and just maybe a Bow window for the front depending on the cost of the windows. At $400.00 per window the cost would have been $7,200.00 not including the bay window, but close. That does not mean that you will be able to pick out a $400.00 window, but a real nice one for about $260.00 or so depending on the style. The Pool area, I have a better idea of what's happening there, and would need to bring in a pool company to advise me of how to fix the problem. And, of course, set the pool up for the winter. As you have told me you do not know how to do this and neither do I. So, I would want to call Family Pool Center in Lawrence. In the last five years, I have never been asked to what you want me to. As I am a very honest person and very loyal to my customers that also include the Commonwealth of Massachusetts for Autistic Children. I have no complaints in any department in the Commonwealth, or other areas. If there is one, it's because I take my work too serious. I also try to protect the home -owner, above all. As far as money that you gave me on August 20,2004, ($5,000.00) I still have some of the money left - $1,163.29. As far as the bank tells me on today's date and I'm sure the purchases that were spent over the weekend on material at Home Depot for your home have not been posted to date. Mary Ellen, this is not a fly-by-night company, 1 am not a handyman. This is a Corporation that pays all taxes, insurance, workman's comp and so on. My name is the company, but I need to get paid for my planning, knowledge and.expertise. If you go to an attorney, and he tells you that his hourly rate is $ 150.00 per hour ... do you really think he is making $ 150.00 per hour? The same goes for a doctor. Their rates, as well as mine, have to cover a variety of expenses that go with the job. Mary Ellen, I asked you for another check for two reasons. One that if I needed labor or material that I would not be behind the eight ball trying to catch up with you. As it would not just continue to flow. This way, the work may proceed in a timely manner. ,1 I am now requesting another check for $ 5,000.00 to continue the work. Please let me know if you would like me to continue or not. More to be done * Removed Wood Stove (Illegally Installed) * Removed all pipes / joints that were burned through * Removed a wooden structure (used table saw to cut into pieces) * Floor of this structure was rotten * Installed 10'x16' box for the future use of the jacuzzi (by pool area) * Installed two Commercial Dehumidifiers (Rented) * Installed one Propane Heater, 30 BTU (Rented) * Filled in concrete hole that was for the stove (into the foundation) * Trimmed tree limbs over the pump room * Removed old shingles to the pump room (10'4"x14') * Installed Felt Paper * Removed old shingles to the Cabana (24'x13'3") * Installed Felt Paper Page 2 Please note on the previously installed wood stove: This stove was installed (by the owner's husband) and was completely illegal. The installation of this stove has caused significant problems to the home. The vent alone, has caused many blow -backs (what that means is that when the stove was working, the vent that went outside was 3.5" long above the ground. This is far short of the normal, properly installed wood stove. This is how it occurred. When the stove was not running at night, the cold air (cold air sinks, hot air rises) would flow back down the pipe and a small amount of black dust would occur. Just like a normal burner when they fail ... blow -back. i Between labor, rental equipment and dump runs, I have just about exhausted your deposit.
