Petition: 486-89
DECISION
The Board of Appeals held a regular meeting on Tuesday evening, November 14, 1989
upon the application of Ronald Pollone requesting a variation from the require-
ments of Section 7.2 and Table 2, and a Special Permit of Section 4.122(14) of
the Zoning bylaws so as to permit interior construction to convert a 2 -family
dwelling to a 4 -family dwelling and relief of 100' frontage on the premises located
at 185-187 Main Street. The following members ere present and voting: Frank
Serio, Jr., Chairman, Walter Soule, Raymond Vivenzio, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on October 26, 1989 and
November 2, 1989 and all abutters were notified by regular mail.
Upon a motion made by Ms. O'Connor and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the variance and Special Permit as requested.
The Board finds that the granting of this variance and Special Permit will not
be a detriment to the neighborhood and will not nullify or substantially
derogate from the intent and purpose of the bylaws.

the application of Ronald F. Pollone, 185-187 Main Street requesting a variance from
the requirements of Section 12, Table 2 and a Special Permit of Section 4.122(14) of
the Zoning ByLaws so as to permit the right to convert any existing dwelling to
accomodate not more than five (5) family units on the premises located at 185-187
Main St., North Andover, MA 01845. The following members were present and voting:
Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Anna
O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on May 26 and June 2, 1988
and all abutters were notified by regular mail.
Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board voted,
unanimously, to DENY the variance and Special Permit as requested.
The Board finds that major external structural changes would be made,' as described
in Paragraph;4.122(14)(a).of the ByLaws, should this petition be granted.
The Board further finds that the petitioner has not satisfied the provisions of
Section 10, Paragraph 10.3 and Section 10.4 of the Zoning ByLaws and the granting
of this variance and Special Permit would derogate from the intent and purposes of
the Zoning ByLaws.

Andover Board of Appeals and resides at 250 Hillside

4. The Defendant, Alfred E. Frizelle, a natural person,
is a duly appointed member of the North Andover Board of
Appeals and resides at 131 Appleton Street, North Andover,

5. The Defendant, William Sullivan, a natural person,

Appeals and resides at 88 Martin Avenue, North Andover,

10. Plaintiff realleges and incorporates herein the
allegations made in Paragraphs 1 through 9 of this
Complaint, as though fully said forth here.

11. On or about May 23, 1988 the Plaintiff submitted to
the North Andover Board of Appeals, a request for a Special
Permit under Section 4.122 (14) of the Zoning By-laws, and
a request for a Variance from the.requirements of Section
12, table 2 so as to permit the right to convert any
existing dwelling to accommodate not more than five (5)
family units on the premises located at 185-187 Main
Street, North Andover, Massachusetts 01845.
12. On June 14, 1988 a hearing was held by.the Board of
Appeals on Plaintiff's request for a Variance and Special
Permit. Several of Plaintiff's abutters were in attendance
at said hearing and spoke in favor of Plaintiff's request
for Variance and -Special Permit. Only one (1) abutter
appeared to speak in opposition to Plaintiff's request for
Variance and Special Permit.
13. After Plaintiff had presented his plans, his argument,
letters in support from abutters and letters in support
from the North Andover Fire Department, Building Inspector
and Town Planner, with minor modifications, (See Attached
Exhibits) the Board heard those in opposition to
plaintiff's application. The opposition to Plaintiff's
Complaint was completely based on an interpretation of
Section 4.122 (14)(a).
14. Afer hearing all arguments at said public hearing the
Board of Appeals took the matter under advisement, in order
to confer with Town Counsel and the Town Planner with
respect to the amendment of Section 4.122 (14)(a).
15. In May 1987 the town meeting, the Town of North
Andover's legislative body, approved a change of Section
4.122 (14) to the Zoning By -Law, which change was
recommended to the Town Meeting by the Town Planner and the
Planning Board.
16. The law prior to May 1987 read as follows "No major
exterior structual changes shall be made." This paragraph
was altered to read "no major exterior structual changes
shall be made which alter the character of the existing
contends allows him to convert his two (2) family dwelling
to a five (5) family dwelling, and it is an interpretation
of this change that the Zoning Board of Appeals was seeking
from the Town Planner.
17. The Plaintiff alleges that the character of Mr.
Pollone's neighborhood would not be adversely affected or
in any way changed by allowing plaintiff to convert his two
(2) family home to a five (5) family dwelling. Plaintiff's
abutters are: to the right of Mr. Pollone's property the
Archdiocese of Boston, which maintains an office and three
(3) apartments and a school directly abutting the rear of
Mr. Pollone's property, across the street from Mr.
Pollone's property there is a church and another school
owned by the Archdiocese of Boston, on the left side of Mr.
Pollone's property is a four (4) family structure and a
condominium building comprising of twenty (20) units of
condominiums. As one proceeds further down the street, the
neighborhood becomes a commercial one, with a beauty
parlor, banks, insurance and real estate offices, and other
retail establishments.
17. Mr. Pollone's lot has 19,041 square feet. His lot is
of sufficient size to accommodate a five (5) unit building,
two (2) parking spaces per unit as required by the North
Andover Zoning By-Law, and a new driveway. Mr. Pollone's
lot is larger than the lot of land on which a condominium
complex of twenty (20) units presently exists in that
particular neighborhood.
18. A few days prior to the August 9, 1988 Board of
Appeals public hearing, the Plaintiff enquired of the
secretary of the North Andover Board of Appeals, whether
she had been asked by members of the Zoning Board of
Appeals to send a letter to the Town Planner and/or the
Planning Board soliciting an opinion as to the
interpretation of the Zoning By-Law change of Section 4.122
(14)(a). The Plaintiff alleges that the said secretary's
answer was in the negative.
19. At the evening of the said public hearing, the
Plaintiff enquired of the Town Planner whether he had
rendered an opinion as to the interpretation of Section
4.122 (14)(a) to any member or members to the North Andover
Zoning Board of Appeals. The Plaintiff alleges that the
Town Planner's answer was in the negative.
20. On August 9, 1988 the Board of Appeals held a public
hearing for the purpose of rendering its decision with
respect to Plaintiff's application for Special Permit and
Variance. At said hearing no input and/or materials from
Town Counsel or the Town Planner or any other member of
the Community Development Department were available.
21. Plaintiff alleges that the North Andover Zoning Board
of Appeals did not confer with the Planning Board, the Town
Plannar AnH/nr Tnwn (nnnSP_1 with respect to the
interpretation of Section 4.122 (14)(a) of the North
Andover Zoning By -Laws, as its members had represented they
would at the public hearing on June 14, 1988 relative to
Plaintiff's application for Special Permit and Variance as
set out hereinabove.-

22. The Board of Appeals in its decision dated August 16,
1988 and filed with the Town Clerk on the same date, found
that "Major external structual changes would be made" in
violation of Section 4.122 (14)(a).
23. In the North Andover Board of Appeals decision dated
August 16, 1988, nowhere does the Board address the
language contained in the second half of the first sentence
of Section 4.122-•(14)(a). At its public hearing on June
14, 1988 the Board did not address the issue of the
character of the neighborhood, although Plaintiff and
Plaintiff's counsel raised and argued the issue.
24. The Plaintiff alleges that the North Andover Zoning
Board of Appeals did not read the first sentence of Section
4.122 (14)(a) in its totality. But rather eliminated any
consideration of the amended portion of said sentence by
its reading and interpretation of. the first half of said
sentence, without regard to a reading and interpretation of
the second half of said sentence.
24. The Plaintiff alleges that North Andover Board of
Appeals has not considered the By -Law change which occurred
in May 1987 as outlined above, to the detriment of the
Plaintiff.
25. The Board of Appeals exceeded its authority insofar as
it acted on legally untenable grounds and/or in a manner
which was unreasonable, whimsical, capricious or arbitrary.

26. Plaintiff realleges and incoporates herein the
allegations made in Paragraphs 1 thourgh 25 of this
Complaint, as though fully set forth here.
27. The Plaintiff has satisfied the provisions of Section
10, Paragraph 10.3 and 10.4 of the Zoning By -Laws.
WHEREFORE, Plaintiff respectfully requests the
following relief:
a. That the Board of Appeals decision be annulled;
b. That the Plaintiff's request for Special Permit
and Variance be remanded to the Board of
Appeals for further consideration under specific
direction by the Court;

.�t PLAN OF LAND TO ACCOMPANY PETITION
Each application and petition to the Board shall be'accompanied by
five (5) copies of the following described plan:
The size of the plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet; it shall have a north point, names of streets,
zoning districts, names and addresses of owners of properties
within a minimum of 200 feet of the subject property, property
lines and location of buildings on surrounding properties. The
location of buildings or use of the property where a variance is
requested and distances from adjacent buildings and property Lines
shall be verified in the field and shown on the plan. The
dimensions of the lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances, exits, driveways, etc. that are
pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red.
Any topographical feature of the parcel of land relied upon for a
variance, such as ledge, rock peat, or natural condition of water,
brook, or river, shall be shown on the engineering plan. When a
variance is requested_to subdivide a parcel of land, the dimen-
sions and area of the surrounding lots may be taken from the deed
or lotting plan for comparison of the size of the lots in the
neighborhood, noted on the plan as such, and marked "approximate".
The plan shall be signed and bear the seal of a registered
surveyor or engineer.. Any plans presented with the petition shall
remain a part of the records of the Board of Appeals.
If 1_iving quarters are to he remodeled, or areas are to be
converted into living quarters, in addition to the plot plan, five
(5) copies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be done
or areas converted into living quarters;
2. A floor plan showing the stairways, halls, doors opening into
the halls, and exit doors of each floor or floors where no re-
modeling or converting is to be done;
3. The plans and elevations shall show all existing work. All
proposed work shall be shown in red. The size of each plan
shall be 1.1 x 17 or 17 x 22; it shall be drawn to scale, 1/4
inch equals one foot.
All plans and elevations presented with the petition shall remain
a part of the records of the Board of Appeals.
For petitions requesting variation(s) from the provisions of
Section 7, Paragrpahs 7.1., 7.2, 7.3, and 7.4 and Table 2 of the
Zoning By Law for conveyance purposes only, a plot plan, certified
by a registered engineer or land surveyor, of the parcel of land
with a structure thereon being conveyed, will be acceptable to the
Board of Appea.Ls provided:
1. The dwelling(s), structure(s), or buildings) were constructed
prior to March 14, 1977.
2. The petition is not to allow construction or alteration to
the dwelling(s), structure(s), or building(s) which will re-
sult in the need for the issuance of a building permit.
3. The size of the ptan shalt he no smal_l.er than 8 1/2 x 11
inches and must show the exi.sti.ng area of the parcel, the
existing frontage, and the existi.ng setbacks of the
dwelling(s), structure(s), or huiLding(s) being conveyed.
4. Proper space is provi.,led on the plot plan for the Board's
signatures, as well as adequate space for the following

The Board of Appeals held a public hearing on April 12, 1988 on the application
of James & Ellen Phelan requesting a Special Permit from the requirements of
Section 2, Paragraph 2.37.1 of the Zoning ByLaw so as to permit including an
in-law suite in the construction of a single-family residence on the premises
located at Lot 4A, Appleton Street. The following members were present and voting:
Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Walter
Soule and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on March 24 and March 31,
1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the Special Permit as requested subject to the following
conditions:
1. The premises be occupied by Margaret M. Phelan.
2. The Special Permit shall expire at the time Margaret M. Phelan
ceases to occupy the family suite.
3. The Special Permit shall expire at the time the premises are
conveyed to any person, partnership or corporation.
4. The applicant, by acceptance of the Certificate of Occupancy
issued pursuant to the Special Permit, grants to the Building
Inspector or his lawful designee the right to inspect the
premises annually.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.31 of the Zoning ByLaw and the granting of this Special Permit in
particular will not derogate from the intent and purpose of the Zoning ByLaw
nor will it adversely affect the neighborhood.

Upon a motion made by Mr. Frizelle and seconded by Mr. Soule, the Board VOTED to
DENY the variance and Special Permit as requested. The vote was unanimous.
The Board finds that the petitioner has not satisfied the provision of Section 10,
Paragraph 10.31 and Paragraph 10.4 of the Zoning ByLaws, and if granted, would
derogate from the intent and purpose of the Zoning ByLaw and adversely affect the
neighborhood.

Dear Frank:
I am writing to the Board of Appeals in support of Ron and Marlene Pollone's
proposed addition to their property.
Ron and Marlene have been parishioners since February, 1978 and neighbors
since July, 1979. They have been and still are very actively involved in
St. Michael's Parish.
Ron and Marlene have shown and discussed their proposed addition with me. I
feel that this proposal will have no negative impact on the neighborhood, as
their immediate abutters include the Parish Religious Education Office with
two apartments, the Parish School, the Condo Association of twenty units and
a four family residence.
The Pollones believe in giving back to their community and this can best
be evidenced by their actions. Ron currently serves the town as a volunteer
on the Selectmen's Balanced Growth Steering Committee. He has served on the
Fire Department Computer Committee and was instrumental in that successful
town meeting article. He currently serves as a Eucharistic Minister in St.
Michael's Parish and is very active in the Holy Name Society. He is the
inspiration and cook for over six annual spaghetti supper scholarship
fundraisers. Marlene serves as a lunch mother at St. Michael's School,
is active in the Guild and is a volunteer block mother.
With this type of community and parish involvement, I can only believe
that the Pollone's proposal will be a positive addition to our
community and St. Michael's Parish.
I wholeheartedly approve of the proposal.

I have discussed the multiple family dwelling unit proposed
by Mr. Ron Pollone with him.
Mr. Pollone has agreed to provide 3601 access around the building
for Fire Department access.
The units will be sprinklered in accordance with NFPA 13D and
North Andover Fire Department requirements. Mr. Pollone has
also agreed to this.
The units are an extension of the existing building and not a
completely separate structure which was our opposition to
other projects.
The units shall also have the house numbers clearly marked by
each door and a suitable sign shall indicate the numbers on
Main Street.
I intend to be present at your April 14 meeting if you have any
further questions of me regarding this matter.

1 - Pollone, 185-187 Main Street: Mr. Pollone is seeking a variance
o a ree dwelling units to the existing building. This section
of the By -Law has always been interpreted as allowing the conversion
of an existing building to more than two dwelling units. Granting
a variance for an addition of this size to house three dwelling
units is beyond the scope of this section and, in my opinion, a
variance and special permit cannot be granted as requested.
2 - Kochanczyk, 61 Sylvan Terrace: The applicant has asked for a
variance from the rear setback, but there is also a problem with
the front setback from the street. It is only 29 ft. instead of
the required 30 ft. The petition was properly advertised so -that
the Board may,'legally address both setback variances.
3 - Coco, 164 Massachusetts Ave.: Mr. Coco is applying to your
Board for a variance that would allow him to have two undersized
lots. The petition is properly before your Board because appli-
cation has been made under the proper sections of the By -Law.
The plan requires signature blocks.
4 - William Davis, 891 Great Pond Road: Mr. Davis was referred
to your Board for the necessary Special Permit to allow a family
suite at 891 Great Pond Rd. I have reviewed the plans and find
no problem and the petition is properly before your Board.
