Burke Register o/ Deeds ZONING BOARD OF APPEALS - CLERICAL STANDARD OPERATING PROCEDURES Applicant supplies secretary with five (10) copies of the application (1 original and 9 copies) which have been time stamped by the Town Clerk along with (10) paper copies and one (1) mylar of the plans. The filing fee is $25.00. (Applications are in the desk drawer in file labeled "Applications".) Prepare Legal Notice for applicant to take to the North Andover Citizen. (In file in desk drawer labeled "Notice To Abutters & Newspapers".) Create a file. Number the file using the yellow "PETITION NUMBERS BY MONTH" folder. (Folder is in vertical file on top of desk.) Prepare two (2) sets of envelopes from the certified abutters list. One set of envelopes receives a copy of the Legal Notice that you will cut from the Newspaper two weeks prior to the meeting, the other set receives a copy of the decision not more than 14 days after the public hearing. Prepare envelopes for the surrounding towns' Planning Depts. Haverhill, Boxford, Middleton, No. Reading, Andover and Lawrence. (There are pre-printed labels in the desk drawer.) Cut the Legal Notices from the newspaper. Prepare the agenda. Copy the agenda to town departments. Copy the legal notices and the agenda to the Board members and to the Building Inspector. Place the Original Agenda in the 'AGENDA' Folder. Tape the copy of the newspaper Legal Notice to the NOTICE which is in the file. Mail a copy to the surroundings towns, the abutters and the applicant. Also send the applicant a bill for the postage used. (Applicant pays for mailings to all abutters and towns.) Post time -stamped NOTICE OF MEETING on bulletin board. Call Board members to ask if they will attend meeting. Must have a quorum. Attend meeting, take minutes. After meeting prepare minutes from your written notes or from the tape. Prepare the DECISIONS no later than 14 days after the meeting in draft form. Copy the draft minutes to the Chairman of the Board to review. Copy the draft decisions to the Building Inspector to review. After their review finalize the decision and sign the chairman's name. Stamp the decisions with the 120 -day appeal stamp'. Also stamp the decision with the Town Clerk's time stamp. Mail the decision to the surrounding towns and the abutters. Send the decision to the applicant, the engineer if any, and the following departments: Assessor's, Building, .Health, Conservation, Director of Planning and Community Devel.=, Town Planner, Town Manager, Selectmen (1), DPW, Police, Fire, and the FILE. The original is given to the Town Clerk. The decision and plan are to be recorded at the North District Registry of Deeds. These SOPs are not all inclusive. Adjust as necessary. VARIANCE Due to the size of the proposed addition to our single family dwelling, applicants request a variance from the requirements of Section 7 (DIMENSIONAL REQUIREMENTS), Paragraph 7.3 (YARDS - SETBACKS), and Table 2 of the Town of North Andover Zoning By -Laws. Specifically, applicants request relief of 5.4 feet from the minimum side setback requirement (20 feet), and feet from the minimum rear setback requirement (30 feet). �6 II. SPECIAL PERMIT To the extent our existing single family dwelling is non- conforming to the current regulations of the Town of North Andover Zoning By -Laws, applicants request a Special Permit as required by Section 9 (NON -CONFORMING USES), Paragraphs 9.1 (NON -CONFORMING USES) & 9.2 (ALTERATION OR EXTENSION). Applicants submit, however, that our existing single family dwelling does conform to current regulations. Specifically, Paragraph 7.8 (EXCEPTIONS) provides an exception to the Dimensional Requirements of the Zoning By -Laws. To meet this exception, applicants must show: 1. Lot cannot be adjoined by other land of the same owner, available for combination with or use in connection with such lot (applicants own no other land). 2. VARIANCE Due to the size of the proposed addition to our single family dwelling, applicants request a variance from the requirements of Section 7 (DIMENSIONAL REQUIREMENTS), Paragraph 7.3 (YARDS - SETBACKS), and Table 2 of the Town of North Andover Zoning By -Laws.
