Dear Mr. and Mrs. Graff: Visual inspection of the above referenced property on December 8, 1995 and December 11, 1995 revealed violations of the Massachusetts Wetland Protection Act and local wetland ByLaw. Any activity proposed or undertaken within an area specified in the Act (3 10 CMR 10.02)(1)(a) which will remove, fill, dredge or alter that area is subject to regulation under M.G.L. c.131 SAO and requires the filing of a Notice of Intent with the North Andover Conservation Commission (NACC) and Massachusetts Department of Environmental Protection (DEP). Dear Mr. and Mrs. Graff. Visual inspection of the above referenced property on December 8, 1995, December 11, 1995 and December 29, 1995 revealed violations of the Massachusetts Wetland Protection Act and North Andover Wetland ByLaw. Documentation was forwarded to the residence listed above return receipt/certified mail dated 1.2/12,195. In addition, two (2) phone calls have been placed with descriptive messages emphasizing the importance of this matter. To date theses requests have gone unanswered. This is the FINAL NOTICE mandating compliance with the enclosed Enforcement Order. Failure to comply will result in the issuance offines and/or additional penalties. Any activity proposed or undertaken within an area specified in the Act (3 10 CMR 10.02)(1)(a) which will remove, fill, dredge or alter that area is subject to regulation under M.G.L. c.131 s.40 and requires the filing of a Notice of Intent with the North Andover Conservation Commission (NACC) and Massachusetts Department of Environmental Protection (DEP). Furthermore, any activity proposed or undertaken within 100' of an area specified in 310 CMR 10.02(1)(a) (hereinafter called the Buffer Zone) which is in thejudgment of the issuing authority, will alter an Area Subject to Protection under M.G.L. c.131 s.40 is subject to regulation and also requires the filing of a Request for Determination and/or Notice of Intent. Each day that the violation is not rectified is constituted as a separate offense and subject to additional fines.
