The Board of Appeals held a public hearing on Monday , December 12 ,

Dear Mr. Serio :
In reference to the Legal Notice dated November 22, 1983 in
the appeal of James & Carole Towle requesting a Special Permit for
a "family suite" or in'law apartment on the East side of the
Andover-By-Pass and known as Lot 2, Andover-By-Pass, please be
advised as abutting neighbors we have no objection to this. However,
please be advised on December 2, 1983, Mr. & Mrs. Towle and their
lawyer, Mr. Domenic Scalise were informed in my presence, as to
a further request for a zoning change in our property to I-1.
As you may recall, this was an article proposed for the Special
Town Meeting held in October, 1983. The Planning Board voted
favorable action on this at the Public Hearing, however, due to a
printing technically, the description of the property was eliminated
on the warrant and could not be voted upon at Town Meeting.
We have informed the Towle ' s and Attorney Scalise we are
preparing the zoning change again for the April 1984 Town Meeting
and have made them aware of this proposal before they incurred
any additional building expense on their abutting property.

house for their elderly mother-in- law. The proposed addition is in
an appropriate location for such use and structure ; will not adversely
affect the neighborhood; will create no nuisance or serious hazard to
vehicles or pedestrians ; will provide adequate an& appropriate facilities
for proper operati.on for said proposed use, and said use is in harmony wit

Sec . 1 . APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board . These 'forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directl.y opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or town , and
the Planning Board of every abutting city or town .
* Every application shall be submitted with an application charge cost
in the amount of $25 : 00 . In addition , the petitioner shall be respon -
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication , but
are not necessarily limited to these .
