C.131 S.40 and The North Andover Wetland Bylaw (C. 178 of the Code of North Andover). Dear Mr. Yameen: Please refer to my letter dated May 19, 1998 (copy enclosed) referencing violations at the above referenced property. A deadline of June 4, 1998 was issued for removal of the subject yard waste. On June 4, 1998, June 9, 1998, and June 10, 1998, staff from this department inspected the above referenced property expecting to find compliance. The deadline of June 4, 1998 was not adhered to and in addition, this department was not contacted in regards to the incapability of comply with the deadline. It was observed that the fill pile on site and grass clippings were removed with machinery without authorization. The remainder of the yard waste piles should be removed by hand only. The following remain outstanding: • There are still several leave piles on site. • The trash is still in the wetlands. The area that was disturbed by the piece of machinery needs to be smoothed out with a rake. • The erosion control (i.e. silt fence and haybales) should have been removed when the areas were stabilized, but still exist in the field. The erosion control should be removed. Please refer to the attached Enforcement Order and Violation Notice issuing a 2nd deadline of Friday June 19, 19.98 for removal of this waste. Dear Mr. Yameen: On May 14, 1998, this department visually observed an "alteration" that took place at the above referenced property. The term "alteration" includes, but is not limited to, the placement of fill, excavation, or regrading (Section IL (b) of the North Andover Wetland Regulations). The subject "alteration" consists of grass clippings, placement of fill leave piles, and trash within the 25' No Disturbance Zone to a Bordering Vegetated Wetland (BVW) and located directly in the BVW. The above mentioned alterations are being inappropriately deposited and need to be removed. Wetlands and their Buffer Zones are not a desirable location to deposit material. Please inform your landscaper of these violations, and see that he/she brings the yard waste to a recycling center or a dump for it appears as though any location on the property will result in a violation. Any work that is proposed within 100' of a BVW is subject to a RDA or NOI filing with the North Andover Conservation Commission (NACC) (Sections III and IV of the North Andover Regulations). Please be aware that you are in violation of the Massachusetts Wetland Protection Act and The North Andover Wetland Bylaw, and NO FURTHER WORK IS TO BE PERFORMED without the proper filings. Please adhere to a deadline of Thursday, Tune 4, 1998 for removal of this waste. Failure to comply with the above mentioned deadline will require your attendance at a public meeting before the NACC, and/or additional penalties and/or fines. Attn: Robert F. Halpin, Town Manager. Dear Mr. Halpin, I am submitting this letter as my formal complaint regarding the constant litter that blows over and is thrown over to my property from the Butcher Boy Mall. I am continuously picking up paper and plastic bags coming from the Mall property. I not only pick up in my yard but I also make sure that any litter that ends up on town property across the street from my home is also picked up. Presently there are the torn remains of a plastic bag hanging from a tree in my back yard. I have on occasion taken other wind blown plastic bags down from trees before they were torn and shredded by the elements. The rear of the mall is generally kept in a sloppy condition with rubbish from stores placed on the ground outside the rear door and allowed to blow around instead of immediately being placed in the dumpster. The rear of the mall that is designated a fire lane on the Mall's final plan recorded at the Registry of deeds in Lawrence, always has vehicles parked there on the grass area as well as the hot top fire lane area. As a wall had to be built to raise the grade of the property in order to build the Mall litter blows or is thrown over this wall on to my property. My back yard presently contains beer bottles and glass bottles and other debris thrown there by workers of the Orzo Restaurant during there evening clean up late at night. Suffice it to say I am tired of picking up the unnecessary mess created by the Butcher Boy Market and Mall Renters. As a North Andover property owner it is not my responsibility to pick up after sloppy and disregarding individuals. I am appealing to the Town to enforce an immediate cleanup of my property by the Mall Owners and prevention of any further occurrences. A walk around the Mall property along Great Pond Road, and along the lot line to the rear of the Mall that abuts my property will justify my complaint. Pay particular attention to all the litter between the Malls stockade fence and their block wall and then the litter that has blown onto my property where the stockade fence ends. (2) There is no need for this to take place. I would be available to speak to you on this matter if you have any questions.
