Re: Subsurface Sewage Disposal System Plan for 1975 Salem Street—Lot 1
(Map 106B,Parcel 16,Lot 1)
To Whom It May Concern:
The proposed wastewater system design plan for the above site dated May 5, 2017 with a final
revision date of August 14, 2017 and received on August 17, 2017 has been approved.
The design has been approved for use in the construction of a new on-site septic system for a five
(5) bedroom, eleven(11) total room residential dwelling, utilizing a gravity leach field system.
This design plan approval is valid until August 24, 2020.
During this time, a licensed septic system installer must obtain a permit and complete this work,
and a Certificate of Compliance be endorsed by the installer, designer and the Town of North
Andover.
This approval is also subject to the following conditions:
1. Prior to the issuance of the Disposal Works Construction Permit, the applicant must
submit a foundation as-built at the same scale as the approved plan.
2. Prior to the issuance of the Disposal Works Construction Permit,the applicant must
submit the floor plans of the proposed dwelling showing no greater than five (5)
bedrooms or eleven (11) total rooms.
3. Prior to construction, the designer must establish a benchmark within seventy-five
(75) feet of the proposed system. The location and elevation of the benchmark must
be submitted to the Health Department.

4. If site conditions are found in the field to be different from those indicated on the
design plan and/or soil evaluation, the originally issued Disposal System Construction
Permit is void, installation shall stop, and the applicant shall reapply for a new
Disposal Systems Construction Permit (3 10 CMR 15.020(1)).
5. It is the responsibility of the applicant and/or the applicant's septic system designer,
septic system installer or other representative to ensure that all other state and
municipal requirements are met. These may include review by the Conservation
Commission, Zoning Board, Planning Board, Building Inspector, Plumbing Inspector
and/or Electrical Inspector. The issuance of a Disposal System Construction Permit
shall not construe and/or imply compliance with any of the aforementioned
requirements.

We have received your July 6, 2017 comments on the above referenced plan, and we offer the following
response.
1. The Title Block shows the Owner/Applicant as Livingstone Development Corp. The deed
reference listed on the plans shows Livingstone Development Corp. as the record owner.
2. All of the requested soil testing information has been added to the plans.
3. The second to last page of the soil evaluations forms were signed.
4. The percolation rate for P-3 has been revised to show 10 minutes per inch.
5. No response needed:
6. A foundation drain and invert were added to the plan.
7. The length and slope of the building sewer have been revised to show the correct information in
the Profile on sheet 2 of 2.

Dear Mr. Christiansen,
The proposed wastewater system design plan for the above site dated May 5, 2017 and received
on June 8, 2017 has been reviewed. Unfortunately,the plan cannot be approved until the
following items are corrected. The specific section in Title 5: 310 CMR 15.000, or North
Andover regulation that is not met by this design follows each item where applicable.
1. Please indicate the record owner on the design plan (NA 3.2). The Assessor's field card
has Lois Lachapelle as the current record owner.
2. The following soil testing data was not on the design plan:
a. The results of the soil and percolation logs (310 CMR 15.220(4)(h-i))
b. Date of the soil evaluation (310 CMR 15.220(4)(h))
c. The name of the approving authority representative (310 CMR 15.220(4)(h))
d. The name and approval date of the soil evaluator(310 CMR 15.220(4)0))
3. The soil evaluation forms were not signed by the soil evaluator(3 10 CMR 15.018).
4. The percolation rate for P-3 should be depicted as 10 mins/inch.
5. On sheet 1 of 2,the benchmark is shown greater than 75 feet to the proposed septic
system(3 10 CMR 15.220(4)0). A note on the design plan indicating a benchmark shall
be set prior to construction is sufficient.
6. A foundation drain and elevation were not shown on the design plan(NA 3.2).

Good to hear from you.Soil testing via test pits and percolation tests would fall under 321 CMR
10.14 (Exemptions from Review for Projects or Activities in Priority Habitat) of the MESA,
which reads as follows:
(14)performance of customary land surveying activities,wetland resource area delineations,
percolation tests,environmental assessments and investigations performed in accordance with
M.G.L.c.21E,and other customary preliminary site investigations or customary property due
diligence activities,provided that vegetation clearing and soil alteration are avoided or
minimized to the maximum extent practicable;
Therefore,as long as impacts are avoided and minimized to the maximum extent practicable,
soil testing activities may proceed in advance of official MESA filing.This site appears to be
mapped for a state-listed turtle species,so I would recommend conducting soil testing activities
as soon as possible,ideally by the end of the third week of this month(before significant turtle
movements begin).
Prior to subdivision of the property,I would recommend a pre-filing consultation to ensure that
any concerns are addressed in advance of MESA review. If you would like,I would be happy to
review the conceptual subdivision plan now and provide comments.Please let me know!

We have a client interested in a property at 1975 Salem Street North Andover MA. It is parcel
10613-0016 shown in GIS plan 1 attached. The property is in a priority/estimated habitat area as
shown on MA GIS NHESP Map parcel 0. The client would like to subdivide into 3 lots as shown
in the attached drawing 4975 Salem Street Conceptual Plan. Boston Brook is across the street
from the property but the 200 ft. Riverfront area crosses the front of the land.
The next step in our process to determine the feasibility of development is to do soil testing
which will require us to bring a backhoe on the site. We have had a wetland scientist inspect the
property and flag the bank of the stream. There aren't any wetlands or vernal pools on the
property. The local Conservation Commission agent will not give approval for us to do testing
until you review what we propose. As required by Title 5 we will dig 4 test pits and two
percolation tests per lot.The test pits will be 10 feet deep and approximately four feet by 15 feet
in size. The percolation tests will be three feet deep in an area that is about five feet by five feet.
If the percolation tests are successful we will subdivide the land as shown and file with the
Conservation Commission and your office.
Please let me know what special conditions or precautions we must follow to perform the tests.

Conceptual Plan.Boston Brook is across the street from the property but the 200 ft. Riverfront area crosses the
front of the land.
The next step in our process to determine the feasibility of development is to do soil testing which will require us
to bring a backhoe on the site.We have had a wetland scientist inspect the property and flag the bank of the
stream.There aren't any wetlands or vernal pools on the property.The local Conservation Commission agent
will not give approval for us to do testing until you review what we propose.As required by Title 5 we will dig 4
test pits and two percolation tests per lot.The test pits will be 10 feet deep and approximately four feet by 15 feet
in size. The percolation tests will be three feet deep in an area that is about five feet by five feet.
If the percolation tests are successful we will subdivide the land as shown and file with the Conservation
Commission and your office.
Please let me know what special conditions or precautions we must follow to perform the tests.
