The Board of Appeals held a regular meeting on Tuesday evening, October
8, 1996 upon the petition of 2-4 Johnson Street requesting a Special
Permit under Section 9, Paragraph 9.2 of the Zoning By Laws as to permit
the extending of additional space to the restaurant capacity in a
preexisting non-conforming structure. The following members were
present and voting: William Sullivan, Raymond Vivenzio, John Pallone,
Joseph Faris, and Ellen McIntyre.
The hearing was advertised in the North Andover Citizen on 9/24 &
10/1/96, all abutter were notified my regular mail.
Upon a motion by Joseph Faris seconded by Raymond Vivenzio, the Board
voted to GRANT the Special Permit for extending of additional space to
the restaurant capacity in a pre-existing non-conforming structure.
Voting members in favor of the petition were: William Sullivan,
Raymond Vivenzio, John Pallone, Joseph Faris, & Ellen McIntyre.
The Board finds that the applicant has satisfied the provisions of
Section 9, Paragraph 9.2 of the Zoning Bylaw and that such change,
extension or alteration shall not be substantially more detrimental than
the existing non-conforming structure to the neighborhood.
Note: The granting of the Variance and Special Permit as requested by
the applicant does not necessarily ensure the granting of a Building
permit as the applicant must abide by all applicable local, state and
federal building codes and regulations, prior to the issuance of a
building permit as required by the Building Commissioner.

The principal points upon which I base my application are as
follows : (must be stated in detail)
The Top of the Scales Restaurant would like to have an additional dining room constructed on top of the existing garage. The
building footprint would be unchanged. The proposed plan includes a new roof,a new emergency stairway in back,and a
renovated face of the existing garage,which would continue to be used only for storage. The proposed renovation is intended
to greatly improve the appearance of this historic building. The design has been approved by the Old Center Historic District
Commision.

I would like to submit this letter of support for the

across the street (Great Pond Road) from the North Parish.
I have reviewed the plans for the proposed construction
of a second story addition over the garage, and am aware that the
construction would not add anything beyond the present length and
width of the building. It seems to me that the addition will
improve the appearance of the garage-side of the Hay Scales .
I know of no one in the North Parish opposed to the
proposed addition. We are not concerned about any additional
parking problems because of the parking available next to the
General Store. I am also aware that the town ' s Historic District
has approved the proposed plans .

in the Old Center. The plan would add a new room above the existing garage, allowing the Top of
the Scales Restaurant to provide dining space that is less crowded than at present. The plan
includes a new emergency exit stairway in back. Ample parking is available in the municipal
parking lot nearby. We believe that the proposed addition/renovation would greatly improve the
appearance of this prominent building in the Old Center. The Town's Historic District
Commission has unanimously approved the proposed exterior design.
Center Realty Trust,the owner of this building,leases the first floor to the Hay Scales
Exchange and the second floor to the Top of the Scales Restaurant. Center Realty Trust also owns
the two adjacent buildings:the house at 6-8 Johnson Street and the former Grange building at 3

The principal points upon which I base my application are as
follows : (must be stated in detail)
The Top of the Scales Restaurant would like to have an additional dining room constructed on top of the existing garage. The
• building footprint would be unchanged. The proposed plan includes a new roof,a new emergency stairway in back,and a
renovated face of the existing garage,which would continue to be used only for storage. The proposed renovation is intended
to greatly improve the appearance of this historic building. The design has been approved by the Old Center Historic District
Commision.
