Background: On June 20, 2000 at a regular meeting of the Zoning Board of Appeals,the Board granted a Special Permit, at the request of Dale Cunningham who was the previous building owner,to enclose an existing open deck with screening. Attached is the notice of decision for petition 020- 2000 as well as the plot plan. On June 27,2003 Joel Porten purchased from Dale Cunningham the home located at 20 Dewey Street where three people lived. On July 10, 2005, I remarried and now require an additional bedroom and space for a family of five people. On April 26,2006,my permit application was denied. See attached letter from Town of North Andover Building Department. Our request for modification is to seek the Zoning Board of Appeals approval to allow the existing screened porch with an elevation of 14 feet to be replaced with a new structure with an elevation of 18 feet that is consistent with the home's existing roof elevation and footprint. Attached are drawings showing the room layout and roof lines. Since this modification request is within the allowed seven(7)year modification time,we believe that this request has satisfied the provisions of Section 9, Paragraph 9.2 of the Zoning Bylaw that this modification will not be substantially more detrimental than the existing structure to the neighborhood. Description of the Addition: Replace screened porch with an expanded family room and master bedroom above. Existing footprint of the home will not change and new structure's roof elevation will match the existing home's roof elevation. See attached architect's drawings.
