The Board of Appeals held a regular meeting on Tuesday evening, June 22, 1999 upon the application of Michael &
Margaret Mannion, 20 Parker St. North Andover, requesting a Variance from Section 7, P 7.1 & 7.3 for relief of lot
area and rear setback of Table 2, in order to remove an existing two bedroom 21 floor, and replace it with a 3
bedroom and 1 bathroom on the 2nd floor. And for a Special Permit from the requirements of Section 9, P9.2 (3) for
an increase in volume area, or extent of the non -conforming use which shall not exceed an aggregate of more than
25% of the original use within the R-4 Zoning District.
The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Robert Ford and John
Pallone.
The hearing was advertised in the Lawrence Tribune on 5/25/99 & 6/1/99 and all abutters were notified by regular
mail. No persons appeared in opposition to the petition.
Upon a motion made by John Pallone and 2nd by Raymond Vivenzio the Board voted to GRANT a Variance from
the requirements of Section 71 P 7.1 & 7.3 for relief of area lot dimension, and rear setback of 2', as per the Plan of
Land by: Scott Giles, Land Surveyor, #13972, dated 4/28199. The Board voted to grant a Special Permit under
Section 9, P 9.2 (3 ) in order to construct said addition which exceeds an aggregate of more than 25%, but not more
than 33% of the original use as per house plan submitted by Robert E. May, Registered Architect, #4764; dated
5/6/98. Voting in favor. William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Robert Ford, John Pallone.
Variance
The Board finds that the petitioner has satisfied the provisions of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these
variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw.
10.4 Variances and Appeals
The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms of this Zoning Bylaw where the Board finds that owing
to circumstances relating to soil conditions, shape, or typography of the land or structure and especially affecting such land or structures but. not
affecting generally the zoning district in general, a literal enforcement of the provisions of this Bylaw will involve substantial hardship, financial or
otherwise, to the petitioner or applicant, and that desirable relief may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of this Bylaw.
SPECIAL PERMIT
The Board finds that the applicant has satisfied the provision of Section 9, paragraph 9.2 of the Zoning Bylaw and that such change. extension or
alteration shall not be substantially more detrimental than the existing non -conforming structure of the neighborhood.
