In the event of failure,the proposed septic tank may be used as a sanitary holding tank. • In the event of failure of the system and conversion of the septic tank to a sanitary holding tank, the applicant shall be required to submit to the Department within 30 days of conversion of the septic tank, an application, under 310 CMR 15.18 Miscellaneous Disposal, for the sanitary holding tank. No. 1010 Date: September 15, 1994 An engineer of the Department has reviewed the plans and the accompanying data, and it is the opinion of the Department that the requested variance to Title 5 cannot be approved as submitted for the following reasons: • The source of water supply and/or the water lines for the dwelling are not shown [310 CMR 15.02 (5)]. • The ground elevations at the deep observation hole locations and at the percolation test locations are not specified. • The existing topography for the entire lot is not shown [310 CMR 15.02 (5)]. The Department assumes that the proposed contours are the same as the existing. If this is not the case, the proposed contours should be shown on the plans. • It is inappropriate for a septic tank detail to be shown on the submitted plan. The existing tank is to be utilized. Since invert information is not complete regarding the tank, it is unlikely that the specific details shown in the detail drawing accurately depict the existing tank. The septic tank detail should be removed from the plan. • The plan appears to indicate some sort of structure toward the west side of the proposed system and located approximately 13 feet from the system. The nature of this structure should be specified. Since one of the variances requested is for downhill slope distance, the Department assumes to an extent that this structure is a barrier of some sort. If this structure is an impermeable barrier, detail regarding the materials to be used and the design should be submitted to the Department for review. Any proposed barrier should extend to an elevation at least 4 feet below the bottom -most elevation of the system and at least 2 feet into natural soils. In addition, the clay used for barriers should have a permeability coefficient of at least 10' cm/sec. Clay barriers should be at least 2 feet wide while concrete barriers may be 1 foot wide. Use of only a synthetic fabric material as a barrier is prohibited: a structural unit is also required for support and stability. Larry Curran Page 3 December 16, 1994 • The plans should include installation of a valve on the effluent pipe from the septic tank to the leaching facilities so that, in the event of failure, the proposed septic tank may be used as a sanitary holding tank. In the event of failure of the system and conversion of the septic tank to a sanitary holding tank, the applicant should comply with all applicable regulations and laws regarding the permitting of such systems. • The Department is curious as to whether or not the applicant has investigated the issue of mounding the system so as to achieve the required separation from groundwater. If this matter has been investigated, the reasoning for not including it as part of the design should be explained in fall. If this issue has not been investigated, it should be. The applicant should bear in mind that the Department cannot issue a final decision on this project until such time as the appropriate personnel in Boston have made a determination relative to the hardship request. In the opinion of the Department, the requirements for the granting of variances as specified at 310 CMR 15.20 have not been satisfied based upon the information received to date. The applicant has not proved that the enforcement of the provision(s) of the Code from which a variance is being sought would do manifest injustice and that the same degree of environmental protection required under Title 5 can be achieved without strict application of the subject provision(s). I A Larry Curran March 13, 1995 Page 3 • The septic tank shall be pumped as needed but a minimum of once per year. • The structure shall not be altered so as to result in an increase in the design flow of the system. • The system is not designed to accommodate a garbage disposal. As a result, a garbage disposal shall be neither installed nor used at the facility. • The Department reserves the right to, and emphasizes the right of the North Andover Board of Health and its agents, to order the applicant to cease discharge to the leaching facilities if there are any indications of failure. Such indications include, but are not limited to breakout and ponding. In the event of failure,the proposed septic tank may be used as a sanitary holding tank. • In the event of failure of the system and conversion of the septic tank to a sanitary holding tank, the applicant shall be required to submit to the Department within 30 days of conversion of the septic tank, an application, under 310 CMR 15.18 Miscellaneous Disposal, for the sanitary holding tank. At that time the Department will also require that the deed of the property be modified to reflect the existence of a sanitary holding tank on the property. • Should public sanitary sewer service be made available to the lot, the dwelling shall connect to the sewer and these deed restrictions can be removed. • The following conditions shall be recorded at the Registry of Deeds: - that no garbage disposal may be installed or used; - that there is no reserve area; - that there exists required operation and maintenance procedures as listed above; and - that the number of bedrooms in the dwelling may not be increased. • The applicant shall provide to the Department a copy of the revised deed showing book and page number and as -built plan within 60 days following completion of system construction and final system inspection. It is the opinion of the Department that the requirements for the granting of a variance as specified at 310 CMR 15.20 have been satisfied. The enforcement of the provision of the Code from which a variance is being sought would do manifest injustice and the applicants has proved to the Department's satisfaction that the same degree of environmental protection required under Title 5 can be achieved without strict Larry Curran March 13, 1995 Page 4 application of the subject provision. The Department hereby approves the variances as granted by the Board of Health. It is your responsibility to assure that the approved plans are available at the site during construction.
