Andover, MA 01845 * * ************************ NORTH 01, Nti 6 Q O MRn m SSA c`Nu5E� 5 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS Petition: #4-89 DECISION RECEIVED pAou LONG T Oda 4 C: I �ti ;Z K ;1 %or" .h,, bo,IER ocl 7 9 53 W'�� EI The Board of Appeals held a public hearing on Tuesday evening, August 9, September 13 and Wednesday evening, October 5, 1988 upon the application of David Ritchie request- ing a variation from the requirements of Section 7, Paragraph 7.3, Section 4.122, Paragraph 7 and Table 2 of the Zoning ByLaws so as to permit construction of a two - car garage and a swimming pool on the premises located at 2.00 Waverly'Road —Jhe following members were present and voting: William Sullivan, Acting Chairman, Augustine Nickerson, Clerk, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on July 14 and July 21, 19.88 and all abutters were notified by regular mail. Upon a motion made by Mr. Rissin and seconded by Mr. Nickerson, the Board voted, un- animously, to DENY the variance for construction of a new expanded garage and voted, unanimoysly, to GRANT the variance for construction of a swimming pool subject to the following conditions: 1. The pool filter be moved from the right rear of the garage to the left rear of existing garage and enclosed to prevent any excessive noise. 2. A rock drain be installed between the pool and the fence to ensure splash water does not drain on abutters' property. 3. Work on pool to be done only in the daylight hours. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning ByLaws and that the granting of this variance will not derogate from the intent or purposes of the Zoning Bylaws nor will it ad- versely affect the neighborhood.
