May 25, 1984 Robert Kereage 201 Greene Street - - Petition No. 28-184 'The Board of Appeals held a public hearing on Aonday evening, May 21, 1984 upon the application of Robert Kereage. The hearing was advertised in the North Andover Citizen on April 26 and May 3, 1984 and all abutters were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Richard J-.--:Trepanier, Esq.,. -Clerk;.-William J.- Sullivan_;—__--_____ and-=A_ssociate Members- t uurice= _Foulds_ and =Raymond :A,_ Viven_z_i.o;;- �. Esq The pet'itroner seeks a• variance -from==thyprovisions-of=-Sectlon7. Paragraph 7.3 and Table 2 of the Zoning By Law so as to permit relief from the front and rear setback requirements to allow the continued existence of a dwelling on premises located at 201 Greene Street. ��ir. Kereage was present- and -testified that a plot- plan recently - drawn for mortgage survey purposes revealed that a shed on the property does not meet the- side -or -rear setback requirements of_ the current Zon-ing—ByLaw.=-=A- variance granted- by --the Board -in 1959- _ --- to a previous owner allowed --the- cons tr.0-c:tion-of-_an- addition which did not meet the side or rear setback requirements. In addition to the above mentioned violations, the plot plan revealed that the existing dwelling does not meet the front setback requirement. Robert Kereage Petition No. 28-184 May 25, 1984 Page 2 Jug 2 a PM IN After reviewing _ the- plan .submitted and the application, thgr`;Board came to the agreement that the application as submitted and as advertised did not seek a side setback variance for the shed, so said violation could not be addressed at this hearing. Upon a motion made by Mr. Vivenzio and seconded by Mr. Trepanier, the Board voted four to one, with Member Foulds voting in opposition, to grant the variance as requested for the front and rear setback violations of the existing dwelling. In granting the variance, the Board finds that a literal enforcement of the provisions of the By Law would create a hardship to the petitioner and therefore,- Section--l-fl-.A- of -the Zoning By- Law= hasbeen satisfied. Said variance, in_the opinion of the Board, will not derogate from the intent and purpose of the Zoning By Law. A plot plan done by the biers bank show the violations which must be corrected. A literal enforcement of the zoning by law will prevent our selling. The variance will not affect the zonin district in general since the addition which is in violation has been standing for .;'over twenty (20) years and the house for a longer period.
