The variance allowed relief of one acre from the two acre lot area requirement for property located at 209 Bridges Lane. According the Massachusetts General Law, Chapter 40A, Section 10, the Board of Appeals may extend a permit for a period not to exceed six months. If work on the property is not exercised within the six month extension the applicant must refile for the vanance. The following members were present and voting: William Sullivan, John Pallone, Joseph Faris, Scott Karpinski and Ellen McIntyre. Upon a motion by John Pallone and seconded by Scott Karpinski, the board voted unanimously to Grant a six month extension to a variance granted on August 16, 1994 for property located on 209 Bridges Lane. This relief was sought by us so that we would be able to sell the property. Changes in Title V have caused delays that have prevented us, thus far, from completing the sale of the lot. We have, however, recently obtained the required approval of the North Andover Board of Health, vis a vis Title V, to proceed. We would therefore respectfully request that the Board of Appeals extend relief from the above mentioned two acre minimum lot size requirement for an additional six months. And if such a request is required to be formally presented at a meeting of The Board, we would respectfully request that this matter be included on the agenda for the August meeting. Thank you. In your deliberations, we would offer the following for consideration: The property was originally purchased by us in 1986 for $110,000 for investment purposes. At that time of course, the minimum requirement was one acre. Not knowing of the likelihood and possible consequences of a change in the zoning laws, we put the land into the same names as those in which our house is held; i.e. we had no idea that 1) the minimum lot size might be changed to two acres; and most importantly 2) even if the]aw was changed, we would be able to sell it as a separate, buildable parcel if we had out it (lot #59) in a different name than those in which our house is held. ' In addition, we would ask the committee to consider the fact that in the last several months, three houses have been built on one acre lots - one on the corner of Bridges Lane and Vest Way and two -on Vest Way - all of which are a mere few hundred yards from our property. In consideration of all of the above, we would respectfully request that you find it appropriate to grant us this appeal and make it pbssible for us to sell this property.
