The North Andover Board of Appeals held a public hearing at its regular meeting in the Town Hall top
floor meeting room, 120 Main Street, North Andover, MA on Tuesday, June 14, 2005 at 7:30 PM upon the
application of Dolores X Goyette, 21 West Bradstreet Road, North Andover requesting a dimensional
Variance from Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw for relief of the left side setback
in order to construct a proposed garage extension, and for a Special Permit from Section 9, Paragraph 9.2 of
the Zoning Bylaw in order to extend a pre-existing, non -conforming structure on a pre-existing, non-
conforming lot. Said premises affected is property with frontage on the Southwest side of West Bradstreet
Road within the R4 zoning district. The legal notices were published in the Eagle -Tribune on May 30 &
June 6, 2005.
The following voting members were present: Ellen P. McIntyre, Joseph D. LaGrasse, Richard J. Byers,
Thomas D. Ippolito, and Richard M. Vaillancourt.
The following non-voting members were present. Albert P. Manzi, III; and David R Webster.
Upon a motion by Joseph D. LaGrasse and 2°d by Thomas D. Ippolito, the Board voted to GRANT a
dimensional Variance from Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw for relief of 8.6'
from the east side setback in order to construct a second stall addition to an existing one stall garage; and
upon a motion by Joseph D. LaGrasse and 2°d by Richard M VaillancouM the Board voted to GRANT a
Special Permit from Section 9, Paragraph 9.2 of the Zoning Bylaw in order to allow a pre-existing non-
conforming structure to be extended by a one-story attached second stall on a pre-existing, non -conforming
lot per Plan of Land in North Andover, MA, prepared for owner/applicant Robert and Dolores Allard, 21
West Bradstreet Road, North Andover, MA Date: May 11, 2005 by Stephen E. Stapinsla, R.L.S. #29876,
Merrimack Engineering Services, 66 Park Street, Andover, Massachusetts 01810 and Doloris and Bob
Goyette, 2202 Garage Draft #1, 21 W Bradstreet Road, N. Andover, MA, North Andover, MA 01845-
3815, 2 pages.
With the following conditions:
1. The roof of the proposed garage addition shall be the same height as the existing garage.
2• The applicant shall provide a corrected Mylar.
Voting in favor: Ellen P. McIntyre, Joseph D. LaGrasse, Richard J. Byers, Thomas D. Ippolito, and
Richard M. Vaillancourt.
The Board finds that the applicant's photographs showing two car garages in the neighborhood has satisfied
the provisions of Section 10, paragraph 10.4 of the Zoning Bylaw in that the granting of this Variance will
not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Also,
the Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.2 of the zoning
bylaw and that such change, extension or alteration shall not be substantially more detrimental than the
