The Board finds that owing to circumstances relating to the location of the existing dwelling on the lot as located on the aforementioned plan and, the existing well in the front yard, and the existing septic system in the back yard, as represented, particularly effects the dwelling and lot, but does not affect generally the Residential 2 zoning district in which it is located, a literal enforcement of the provisions of Section 10, Paragraph 10.4 and Section 7, Paragraph 7.3 (Yard Setbacks) & Table 2 would involve a substantial hardship to the petitioner, and that relief may be granted without substantial detriment to the public good, and without nullifying or substantially derogating from the intent or purpose of the North Andover Bylaw. The Board further waives the applicant's fees for said application. Furthermore, if the rights authorizes by the Variance are not exercised within one (1) year of the date of the grant, it shall lapse, and may be re-established only after notice, and a new hearing. The particular use of this land will continue to be a single family residential home. This particular addition will be used as a garage for parking two cars. B. The particular circumstance of our lot requiring us to request a variance for locating the garage to the side are such that: Front Yard Location Issues: • The front yard topography will require excavation into a slope that is quite probably ledge material and would be difficult work and quite expensive. • The front yard is also the location of our drinking water well and associated piping. In order to satisfy the 30 ft zoning offset requirement, we would need to relocate our well, which would be quite expensive. The well pump is approximately 100 feet below ground. Almost all of that is cored through rock. • The front yard is not a pleasing location for the garage since it would obscure the house and require multiple interior rooms of our existing house to become rooms without windows, which is highly undesirable. Back Yard Location Issues: The back yard is limited based on the location of our septic tank and associated piping. If the garage is to be located behind the house, the septic tank would need to be removed and relocated. This is another expensive consideration. Side Yard Locations Result: This is the logical location for the garage based on a side entrance to the existing house and location of the driveway entrance to our lot. Request for the side offset variance: The variance is requesting in order to construct a garage such that a car can be parked in it. • At the closest point, the distance from the existing house to the property line is 51 feet. • The required offset for R-2 zoning is 30 feet • The available distance to construct the garage is only 21 feet Application for Variance Supporting Documentation John and Heidi Watters 2125 Turnpike Street North Andover, MA 01845 • Considering actual geometry of the garage, thickness of walls, access to the existing house via stairs, and dimensional margin of error, a 7 foot offset is requested. Unfavorable Result If a variance is not approved, the garage depth will be too shallow to park a standard vehicle (currently assuming a passenger sedan such as a Toyota Camry).. C. The hardship is related to financial value of our home as well as health and safety issues. • Virtually every house along Turnpike Street from the Middleton Town line to Stop and Shop has a garage, limiting future resale opportunities (financial issue) • Comfort and safety of children getting in and out of cars in winter, rain, cold weather (health and safety issues) • Safe interior storage of garbage from animals (health issue) D. A finding in support of relief would not harm the neighborhood. • This is one of very few homes in the area without a garage. • The density of the housing in this area is very low due to proximity of Harold Parker State forest. The location of the garage is virtually identical to the current outside car parking location. Actually, the cars would now be parked further from the abutters house, creating a greater "clear zone" between the two homes than currently exists. E. It is assumed that the intent of the zoning law is to limit densification of housing within the zoning district and to maintain single family detached housing. • The density of the housing in this area is very low due to proximity of Harold Parker State forest. • The home will continue to be a single family detached home • The home will now be equal to all the other housing along Turnpike Street, which virtually all have garages. • The requested relief is for only 7 feet of the required 30 foot offset. The relief is only 7 feet at the critical clearance point and reduces to 4 feet at the limits of the garage. F. The variance is not for a Contiguous Buildable Area.
