The North Andover Board of Appeals held a public hearing at The Senior Center, at 12OR Main Street, North
Andover, MA on Tuesday, 16 September 2014 at 7:30 PM on the application of Andrew and Eileen Brien for
property located at 22 Harkaway Road(Map 95,Parcel 51),North Andover,MA 01845.Petitioner is requesting
a Variance from Table 2(Dimensional Requirements)for a rear yard setback from the Zoning By-laws and also a
Special Permit from Section 9.1 for a Pre-existing non-conforming structure also of the Zoning By-laws,in the R-4
Zoning District,to construct a sitting room/mudroom.
Legal notices were sent to all the certified abutters provided by the Town of North Andover Assessor's Office,and
were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North Andover,on
September 2nd and September 9th,2014.
The following regular voting members were present:Albert P.Manzi Ill,Richard J.Byers,D.Paul Koch Jr.,and
Allan.Cuscia. Associate member Doug Ludgin and Deney Morganthal
D.Paul Koch made a motion to Grant Variances from Table 2 of the Zoning Bylaw for 22 Harkaway Road(Map
95,Parcel 51)to construct a sitting room/mud room. The Variance is for a rear yard setback, the required is 30'
proposed is 16',relief is 14'in the R-4 Zoning District.
Byers second the motion
All in favor to Grant the Variance;Albert P.Manzi III,Richard J.Byers,D.Paul Koch Jr.,Allan Cuscia,and Deney
Morganthal
The motion was unanimously approved and the Variance was granted.

The Board finds that owing to circumstances relating to soil conditions, shape, or topography of the land or
structures and especially affecting such land or structures but not affecting generally the zoning district in general,a
literal enforcement of the provisions of the Bylaw will involve substantial hardship,financial or otherwise,to the
Petitioner or applicant. The Board finds that desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent of the purpose of this bylaw.
The Board also finds that this use, as developed by the building&site plans, is an appropriate location for such a
use and will not adversely affect the neighborhood. There will be no nuisance or serious hazard to vehicles or
pedestrians,since there are provisions for the required off-street parking. Adequate and appropriate facilities will be
provided for the proposed sitting room/mudroom. The Board finds that the proposed'sitting room/mudroom will not
be substantially more detrimental to the neighborhood and that this use, is is harmony with the neighborhood and
general purpose and intent of this Bylaw.

neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there is provision for the
required off-street parking. Adequate and appropriate facilities are provided to the existing residential dwelling and
will be provided for the proper continued operation of a duplex home. The Board finds that the duplex along with
the proposed addition will not be substantially more detrimental than the existing duplex-family dwelling and that
this use,to allow for the addition of a sitting room/mudroom to the duplex,is in harmony with the general purpose
and intent of this Bylaw.

Notice is hereby given that the Board of Appeals will hold a public hearing at the
Senior Center, 120R Main Street, North Andover, MA on Tuesday, September 16th,
2014, at 7:30PM to all parties interested in the petition of Andrew and Eileen Brien,
for property located at 22 Harkaway Road (Map 95, Parcel 51), North Andover,

We would like to respectfully request permission to construct a 22 foot by 10 foot,one story
addition to the rear of our property located at 22 Harkaway Road in North Andover, MA.The addition
would be used as a Sitting Room/Mud Room. It would include a slider with a small deck going into our
backyard.This addition would be located on the side/rear of the present structure and would not be
located any closer than the present 14 foot side setback or adversely affect any of our neighbors or
abutters. It would only infringe on our rear lot line which is an abandoned railroad bed.
Because of the pre-existing dimensions of our lot and the placement of the structure, we have
no other place to put the proposed addition that will satisfy existing setbacks that are in place by the
Town of North Andover.
The use of the structure is within the intent of the Zoning bylaws set by the Town of North
Andover and will not affect adversely on our neighbors and abutters.We have lived in the structure for
35 years and need to add this small amount of space (187 Sq.Ft.)for comfort and storage for our present
and future use.
As per the application we are seeking your permission to construct the addition within 20 feet of
our rear lot line. We understand that the setback in the Zoning law is 30 feet. We also understand that
our home is a pre-existing, non conforming structure that requires the permission of the Zoning Board
to construct the addition.

Dear Mr. Manzi,
We would like to respectfully request permission to construct a 22 foot by 10 foot,one story
addition to the rear of our property located at 22 Harkaway Road in North Andover, MA.The addition
would be used as a Sitting Room/ Mud Room. It would include a slider with a small deck going into our
backyard.This addition would be located on the side/rear of the present structure and would not be
located any closer than the present 14 foot side setback or adversely affect any of our neighbors or
abutters. It would only infringe on our rear lot line which is an abandoned railroad bed.
Because of the pre-existing dimensions of our lot and the placement of the structure, we have
no other place to put the proposed addition that will satisfy existing setbacks that are in place by the
Town of North Andover.
The use of the structure is within the intent of the Zoning bylaws set by the Town of North
Andover and will not affect adversely on our neighbors and abutters.We have lived in the structure for
35 years and need to add this small amount of space (187 Sq.Ft.)for comfort and storage for our present
and future use.
As per the application we are seeking your permission to construct the addition within 20 feet of
our rear lot line. We understand that the setback in the Zoning law is 30 feet. We also understand that
our home is a pre-existing, non conforming structure that requires the permission of the Zoning Board
to construct the addition.
