Dear Mr. Lona :
The Board of Appeals held a public hearing on Monday evening ,
April 12 , 1982 upon the application of Thomas P . and Patricia
Ventura . The hearing was .advertised in the North Andover Citizen
on March 25 and April 1 , 1982 and all abutters were notified by
regular mail . The following members were present and voting :
Frank Serio , Jr . , Chairman ; Alfred E . Frizelle , Esq . , Vice-
Chairman ; Augustine W . Nickerson i, Maurice S . Foul ds ; and Walter
Soule . The Board voted to take the petition under advisement
and rendered their decision on May 10 , 1982 , at which time all
voting members except Mr. Foulds were present.
The petitioner seeks a variance from the provisions of Section 7 ;
Par. 7. 2 , 7 . 3 , and Table 2 of the Zoninq By Law and a Special
Permit under Section 4 , Par. 4 . 122 ( 14 ) to permit the conversion
of a two-family dwelling to a four-family dwelling on premises
located on the North side of Ashland Street and known as 22 -24
Ashland Street.
Throunh counsel and by testimony , the petitioner introduced
evidence showing that the dwelling had been constructed on the
premises prior to the enactment of the Zoning By Law and that
there are multi -family dwellings in the neighborhood . The peti -
tioner proposed that parkina be provided on the side of the dwelling .
According to the petitioner , it is economically necessary to convert
the existing two -family unit to a four-family unit and the variance
request is necessary because of the dwelling ' s non-conformance .

At the hearing , the Director of Community Development spoke in
favor of the petition , citing the lack of apartments in the town ,
and no one spoke in opposition .
Upon a motion made by Mr. Frizelle and seconded by Mr . Nickerson ,
the Board voted unanimously to grant the variance as requested and
to grant the Special Permit subject to the following condition :
That the parking lot , with a minimum of eight (8) spaces , be con-
structed to the rear of the building , and that the builidng (shed)
as shown on the plan be removed prior to the issuance of a building
permit for renovations .
The Board finds that the particular location is suitable for a
Jour-family unit and that each of the provisions of Section 10 ,
Par . 10. 31 for a Special Permit have been satisfied . Further ,
the Board finds that the provisions of Section 10 , Par. 10 . 4 have
been satisfied in regard to granting the variance .

Dear Tom:
This letter is to put you on notice that none of the three
unoccupied apartments at 22-24 Ashland Street have been approved for
occupancy. A Certificate of Occupancy will not be issued until the
following requirements are met:

1. A plan of the parking area to the rear of the building,
with the. eight required spaces, drawn to scale, is submitted to this
office for approval.
2. The required permits for electrical, plumbing and gas
installations are obtained and the work approved by the various inspectors.
3. A final inspection by the Building Dept. for conformance
to the Building Code.
4. The permit card has been signed by all of the inspectors

showing final approval.
5. A statement from the Community Development Dept. that the
requirements of that office have been met.

Failure on your part to comply immediately with these require—
ments will require me to take the necessary legal action to insure Code
compliance, with any resulting fines.

Dear Frank:
I inspected the parking area at 22-24 Ashland Street,
per your request.
It does not appear to me that there are eight parking
$paces in the area unless the driveway is used for parking.
Tom Venturat who owns the property, said he had a plan whereby
the tenants in each of the four units would have parking spaces
allocated to them one behind the other, thus eliminating turning
space. I told him to prepare a plan showing how he was going to
park eight vehicles in the area and also told him that no occu—
pancy permit would be issued until your Board is satisfied that
the conditions of the Special Permit have been complied with.

Dear Mr. Serio,

The Community Development Office of the Town of North Andover
supports the special permit application submitted by Tom Ventura for
residences at 22-24 Ashland Street.
The Town will be undertaking several improvement projects in this
neighborhood including street and sidewalk repair, drainage improvements,
and housing rehabilitation. The neighborhood is located in the Community
Development Block Grant target area and is therefore scheduled for
these improvements leading to an entirely upgraded residential area.
In our opinion there will be minimal negative impacts as a result of
increasing the unit density from two to four units. As you are aware,
the additional housing is urgently needed in the Town. The large
lot size and the building size will easily accommodate the additional units.
The property owner has been working with the Community Development
Office and the Building Department to assure that the renovation will
be attractive and an asset to the neighborhood rather than an eyesore.
We urge your approval of this application and thank you for your
consideration.

The principal points upon which I base my application are as follows :
(Must be stated in detail ) The building is situated on a lot with suf-
ficient area to accomodate conversion to four (4) units . A conversion to
four (4) units will not adversely affect the neighborhood and will create
two new modern rental units , in the area , with no exte'r'ior i:change in. the
building . A literal enforcement of the Provisions of the by-laws would
involve substantial hardship , financial or otherwise, to the petitioners
and desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent or purpose of such by-laws .

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. •These •forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or- town , and
the Planning Board of every abutting city or town .
* Every application shall be submitted with an application charge cost
in the amount of $25 .00 . In addition , the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication , but
are not necessarily limited to these .
