A sign shall be displayed at the site not less than two square feel or more than three square feet in'sizo bearing the words, "Massachusetts Department of Environmental Quality Engineering, File Number 242- 315A . 10. Where Ine Department of Environmental Quality Engineering is requested to make a determination and to issue a Superseding Order, file Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11 . Upon completion of the work described herein, the applicant shall forthwith request in writing that a :n Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. The work shall conform to the folloiwng plans and additional conditions: a. Notice of Intent b. Plans entitled "Proposed Subsurface Sewerage Disposal System" Owner: John S. Willis Jr. , Dated: Jan. 27, 1986, revised 9/26/86, Two (2) Pages. 14. The following wetland resource areas are affected by the proposed work buffer zone and bordering vegetated wetland. These resource areas are significant to the interests of the Act and Town Bylaw as noted above. These resource areas are also significant to the wildlife and recreation interests of the Bylaw. The applicant has not attempted to overcome the significance of these resource areas to the identified interests. 15. In advance of any work on this project the applicant shall notify the NACC, and at the request of the NACC, shall arrange an on-site conference among the NACC, the contractor, and the applicant to ensure that all of the Conditions of this Order are understood. This Order also shall be made a part of the contractor's written contract. 16. The applicant, or its successors, shall notify the NACC in writing of the identity of the on-site construction supervisor hired to coordinate construction during the work on the site nd to ensure compliance with this Order. 17. Commencing with the issuance of this Order, and continuing through the existence of same, the applicant shall submit to the NACC a written progress report every two months detailing whta work has been done in or near resource areas, and what work is anticipated to be done over the next period. 18. Prior to any activity on the site, a filter fabric fence or a double row of staked hay bales shall be placed ten (10) feet from the edge of the wetland areas per Soil Conservation Service or D.E.Q.E. standards. This barrier shall be inspected and .approved by the NACC prior to start of construction. This row of hay bales or filter fabric shall reamin intact until all disturbed areas have been mulched, seeded, and stabilized to prevent erosion. Page 4 ORDER OF CONDTIONS LOT B - BOSTON STREET D.E.Q.E. #242-375-A li 19. Prior to any activity on the site, snow fencing shall be erected ten (10) feet upland of the erosion control barrier specified in Condition 18. 20. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of twenty-five (25) hay bales and sufficient stakes for staking these bales. Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion, as described in the Erosion Control Plan submitted with the Notice of Intent or the hay bale barrier described in Condition No. 17. 21. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. If the latter course is chosen, stabilization will be considered once the surface shows complete vegetative cover has been achieved. 22. No earthen embankment in the buffer zone shall have a slope steeper than 2:1. Any slopes of steeper grade shall be rip-rapped to provide permanent stabilization. 23. All erosion prevention and sedimentation protection measures found necessary during construction by the NACC will be implemented at the direction of the NACC. 24. There shall be no stockpiling of soil or other materials within 25 feet of any resource area. 25. During and after work on this project, there shall be no discharge or spillage of fuel, oil, or other pollutants into any resource area. 26. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds, by majority vote, said changes to be significant and/or to deviate from the original plans, Notice of Intnet or this Order of Conditions to such an extent that the interests of the Wetlands Protection Act and Bylaw cannot be protected by this Order of Conditions and would best be served by the issuance of additional Conditions, then the NACC will call for another public hearing within 21 days, at the expense of the applicant, in order to take testimony from all interested parties. Within 21 days of the close of said public hearing, the NACC will issue an amended or new Order of Conditions. 27. Any errors found in the plans or information submitted by the applicant shall be considered as changes, and procedures outlined above for changes shall be followed. In conjunction with the sale of this lot the applicant shall submit to the NACC a signed statement by the buyer that he is aware of an outstanding Order of Condtions on the development and has received notice under Condition No. 31 below. 29. The NACC shall be notified in writing of any lot line or lot nuiab.er changes with a copy of a plan showing these changes prior to any work on this lot. 30. Members of the NACC shall have the right to enter upon and inspect the premises to evaluate compliance with this Order of Conditions. 31. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 32. Prior to the issuance of a Certificate of Compliance, the applicant shall submit a letter to the NACC from a registered professional civil engineer certifying that the work is in compliance with the plans referenced above and all the Conditions hereof. 33. The provisions of this Order shall apply to and be binding upon the applicant, its employees, and all successors and assigns in interest or control. 34. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage, or any other form of damage due to wetness. 35. A proper bond or a depost of money or negotiable securities running to the Town of North Andover shall be provided in the amount of $2,000, which shall be in all respect satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the Treasurer of the Town of North Andover before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all Conditions hereof, shall be signed by a party or parties satisfactory to the NACC and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance any any Conditions which are of a continuing nature. This Condition is issued under the authority of the Town of North Andover .Wetlands Protection Bylaw. 36. No underground storage of fuel oils shall be allowed within one hundred (100) feet of any wetland resource area. This Condition shall survive this ORder of Conditions, and shall run with the title of the property. 37. Fertilizers utilized for landscaping and lawn care shall be of the low nitrogen content variety, and shall be used in moderation. Pesticides and herbicides shall not be used on any lot in the subdivision within 100 feet of a wetland resource area. I have taken an appeal of their determination to the Regional Office of the DEQE in Woburn, and will be pursuing this course of action to a final conclusion. I should suggest to you that the Wetland Delineation Line has still not been resolved. However, your Board should not at this time be concerned. Gentlemen: This lot was viewed by this Board today. The Board voted to grant the variance of twenty feel from the wetlands as requested provided that Conservation agrees with the established wet line as defined. The drainage of the swale on the north side of property must be re-routed to satisfy the sanitary inspector. Very truly ours , i Note : See attached copy of revised plan 10/6/86 John Willis revised plan 9/26/86 I do not recommend approving this lot . 1 . Leach area is still too close to swamp and I feel it is a bad precedent to waive the 100" wetland offset . 2 . The swale that runs from Soloman' s lot into this one will be dammed up with the fill necessary for the septic system. Mr. Soloman has also pointed this out . Impounding water so close to the l.eac h srea is a poor idea and may even flood the neighboring ( soloman' s ) property. 3 . Mr. Willis feels wronged by using the 17 min/inch perc rate , and this design shows (which is true ) , the leach area off the 17min test site . There were other peres on this lot ; one failed and one was discontinued because it was slowing down. Some passed very well , but without testing every foot of soil under proposed leach area, I felt the 17 min rate was reasonable . It might be possible to demonstrate that 3 min/in soil condi- tions exist in the high spot the leach area is c urrently shown over. However, tests . on 9/9/86 showed a change of soil condi- tions ( too Unsuitable ) within as little as 15 ' from the favorable tests . If the conditions can be demonstrated to be desirable (under 5 .min/in) there would be a possibility of downsizing the leach area and this_ moving. farther from the swamp, but I cannot say for sure at this point . All I can say now is that the current plan is unacceptable . Mr. Willis may wish to .pursue this further' 4• Mr. Willis informs me that the swale across Solomon ' s property and his line is "not his fault" . I pointed out that it really doesn' t matter;a drainage problem is a drainage problem whomever you blame-it on. 5." It alleged that I said "everythng will be OK, this lot will be accepted" at the- latest test on 9/8/86 . Mallett, a Professor of Biological Sciences at the University of Lowell, and he has through a vegetative count, determined the exact location of the wetlands boundary on the property. Subsequent to his determinations, we have, with your representative, Michael Graf, conducted additional percolation tests' on the property and are designing a system in accordance with the results to be utilized on the property. You will note that the edge of the wetland is closer than 100 feet from the edge of the leaching field as proposed. I am constrained by the size and location of the lot and the soils and topography of the lot to place the leaching field at the location shown. No other design can be made on the lot which would meet your 100 foot setback requirement from the edge of the wetland. I am therefore request- ing, due to the hardship that this presents, that your Board grant me a variance of your distance requirement under Section 4. 18 of your regulations with regard to the design of septic systems. The requirements of Title V of a 50 foot setback would still be met with 25 feet to spare, and so I believe that this variance could be granted by your Board in this instance without creating any health or other hazard to the community. I should like to point out that the variance, if granted, would be due solely to the uniqueness of this particular piece of property and would not in any way act as a precedent for others to come in for similar variances in that in my opinion, there would be no other lots of land in Town which would be bound by the same constraints that this lot is. Mass. This parcel owned by Mr. John Willis Jr. . is referred to as "Lot B" on Boston Street in the Town of North Andover. plass. and is recorded as Plan 329:3 at the North Essex Registry of Deeds. This survey was undertaken specifically to delineate the wet 1 ands boundries associated with the property for the expressed purpose . of rnaintaininq cornpliance with the Mass. Wetlands Protection Act and the quide-lines setforth in Requla.tions 310 CMR 10. 00. Methodolhgically. the wetlands boundry was defiri d and f• lagged over the period of July 14-16. 1986 by locating the demarkation line within which 50 percent or more of the vegetational commuhity consists of the wetland plant species tiientified in the Wetlands Protection Act. This delineation of the border•inq vegetated wetlands bou'hdry is in keepinq with the species composition criteria sot forth in the act and 310 CRM 10.55 (2) (c ) . Herbaceous cover. shrub layer and tree distributions were evaluated for specific floral composition. In addition to delineating the wetland community margin, quantitative plant inventory techniques ( in the form of quadrat analyses) were employed to document , verify and quantify plant distributions. It was found that the bor•derinq veqetated wetlands occupies a approximately 680 square feet at the southern-most corner of U ; parcel . I have marked this designation on accompanyinq plan. For purposes of quantification, five quadrats of 1 meter square each were inventoried at intervals alonq the southwest property boundry at 501 . 7514 1001 . 125' and 150' from the northwebt corner bound. These quadrats clearly and unequivocally show the transition from upland to wetla.nd species as occurinq between Ruadr•a.t III and Gu'adr•at IV. The wetlands boundry was observed to cross the property boundry at about 112' from the northwest bound . Attention was also addressed to an excavated area located more centrally on the lot. This depressed area supports some .plant species designated in the Act and was inventoried in detail to determine the status of area with respect to 310 CRM. The area measures approximately 25' x 50' and was investigated in it% entirety. The results of the quadrat studies and the investigation of the. excavated depression are given below. It is apparent that although some species cited in the Act are present. they are in the miner•ity and the community composition does not approach that of a wetlands. It is readily apparent tF-,a.t these studies are Entirely consistent with; the North Andover town wetlands map area 112 and the U. S. Department of Agriculture. Soils Conservation Service Soil Survey of Essex County. Mass. . Northern Part (Sheet 36) . These results indicate a wetlands involvement similar to that indicted on a. previously submitted Request for• Determination but slightly less area than the area indicated on the previously submitted filing (DEQE ,File No. 242-338) . However, this area cannot be construed to be a wetlands either by its geology or by its floristic composition. It is of higher elevation than the vegetated . bordering wetlands (which are about at elevation 1941 ) and obviously has no hydrologic connection to the wetlands.
