The release occured as a result of high winds causing a tree to break and fell on overhead utility wires. The strain caused an adjacent utility pole to break and the transformer atop the pole to fall to the ground. The transformer was damaged upon impact, releasing the contaminant. Due to heavy rains at the time of the damage and the location at which the tranformer impacted, the release had migrated with the storm flow, impacting flood waters and wetland areas adjacent to Mosquito Brook. (See letter attached from Coneco Engineers&Scientists dated April 19, 2007 for further information). 2. Public agency to perform work or public agency ordering the work to be performed: Coneco Engineers&Scientists for MA Electric(MECO) 3. Date of Site Visit: Start Date: End Date*: 4/20/07 4/17/07 30 days from issuance *no later than 30 days from start date or 60 days in the case of an Immediate Response Action approved by DEP to address an oil/hazardous material release. 4. Work to be allowed": Clean-up and mitigation efforts will include removal of the residual contaminant, the application of oil absorbant and containment materials to an adjacent driveway and surface water bodies, and raking, removal and proper disposal of impacted detritus leaf litter, leaves, soil, and absorbant material. C. General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Emergency Certification or subject to enforcement action. 2. This Emergency Certification does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of property rights. 3. This Emergency Certification does not relieve the applicant or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, bylaws, or regulations. 4. Any work conducted beyond that described above, and any work conducted beyond that necessary to abate the emergency, shall require the filing of a Notice of Intent. 5. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Emergency Certification at reasonable hours to evaluate compliance with this Certification, and may require the submittal of any data deemed necessary by the Conservation Commission or the Department for that evaluation. 6. This Emergency Certification shall apply to any contractor or any other person performing work authorized under this Certification. 7. No work may be authorized beyond 30 days from the date of this certification without extension by the Issuing Authority. D. Special Conditions 1. Proper erosion controls must be installed prior to any soil disturbance/excavation 2. Excavated soils shall be properly contained, covered, and immediately disposed of off site 3. Excavated materials shall not be temporarily stockpiled within 50 feet of a resource area 4.Equiptment shall not be staged overnight within 100 feet of a wetland resource area 5.Immediately following site disturbance, all exposed areas shall be temporary stabilized with hay mulch or other approved method 6. The Conservation Department reserves the right to impose additional conditions to mitigate impacts 7. A Notice of Intent filing must be submitted to the Conservation Department immediately following the issuance of this Emergency Certification. E. Appeals The Department may, on its own motion or at the request of any person, review: an emergency certification issued by a conservation commission and any work permitted thereunder; a denial by a conservation commission of a request for emergency certification; or the failure by a conservation commission to act within 24 hours of a request for emergency certification. Such review shall not operate to stay the work permitted by the emergency certification unless the Department specifically so orders. The release occurred as the result of high winds causing a tree to break and fall on overhead utility wires. The strain caused an adjacent utility pole to break and the transformer atop leto fall to the ground. The transformer was damaged by the impact, and approximately gallons of non-PCB MODF were released from the transformer. Due to heavy rains at the time of the damage and the location at which the transformer impacted,the non-PCB MODF released migrated along the surface of the private driveway and earthen road shoulder as the result of sheet flow on storm water. At the - time _ time the.release occurred,the area was reportedly submergedvby high flood waters of"the Mosquito _Brook which resulted from the storm. Based on Coneco's field observations,the release impacted flood waters and wetlands areas adjacent to Mosquito Brook,although only minimal surficial evidence of a release(i.e. a petroleum sheen)was noted on flood water., _ Ongoing IRA activities initiated the night of April 17,2007 consisted of the removal of residual non- PCB on-PCB MODF,application of oil absorbent and containment materials to the driveway, and surface _ water bodies, and raking,removal and proper disposal of impacted detritus leaf litter, leaves, soil,and absorbent material. Coneco estimates that the release impacted approximately 1,000 linear feet of asphalt driveway, as well as several areas of road shoulder and or private property, mostly situated adjacent to the flooded Mosquito Brook. Ongoing response actions are being conducted at the Site by Clean Harbors and all waste generated as a result of the release will be transported under Uniform Hazardous Waste Manifest to the Clean Harbors of Braintree facility in Braintree,Massachusetts for proper disposal. Additional required response actions will include the excavation and removal of impacted soil and grass within three distinct areas of potential wetlands. The three areas will comprise a total of approximately 400 square feet immediately adjacent t o the road shoulder. One area is estimated to be 4 1 ii,t Strict. Another area will be approximately 30 feet long by 1-foot wide,and the third area will be approximately 30 feet long by 2 feet wide. These areas were noted to have been impacted by the non-PCB MODF release. Preliminary response actions will be completed by April 18, 2007. Pending a review of laboratory analytical results of confirmatory samples collected at the completion of response actions, Coneco anticipates the installation and sampling of groundwater monitoring wells in the vicinity of the release. The Massachusetts DEP was notified of the release within two hours of it being identified and the DEP approved IRA activities which were conducted at the Site. As a result of this release, Coneco,on behalf of MECO,respectfully requests an emergency Order of Conditions to complete the necessary response actions at the Site. The release occurred as the result of high winds causing a tree to break and fall on overhead utility wires. The strain caused an adjacent utility pole to break and the transformer•atop leto fall to the ground. The transformer was damaged by the impact, and approximately gallons of non-PCB MODF were released from the transformer. Due to heavy rains at the time of the damage,and the_, location at which the transformer impacted,the non-PCB MODF released migrated along the surface of the private driveway and earthen road shoulder as the result of sheet flow on storm water. At the time the.release occurred,the area was.reportedly subrrterged byhigh.flood waters'of"the Mosquito Brook which resulted from the storm. Based on Coneco's field observations,the release impacted flood waters and wetlands areas adjacent to Mosquito Brook, although only minimal surficial evidence of a release'(i.e. a petroleum sheen)was noted on flood water. Ongoing IRA activities initiated the night of April 17,2007 consisted of the removal of residual non- PCB MODF,application of oil absorbent and containment materials to the driveway, and surface water bodies, and raking,removal and proper disposal of impacted detritus leaf litter, Ieaves, soil,and absorbent material. Coneco estimates that'the release impacted approximately 1,000 linear feet of asphalt driveway, as well as several areas of road shoulder and or private property, mostly situated. adjacent to the flooded Mosquito Brook. Ongoing response actions are being conducted at the Site by Clean Harbors and all waste generated as a result of the release will be transported under Uniform Hazardous Waste Manifest to the Clean Harbors of Braintree facility in Braintree,Massachusetts for proper disposal.
