Based on an inspection by Brian Leathe, Local Building Inspector on March 8th, 2016,there is no evidence of a business being conducted at inspection time.The Town of North Andover Zoning Bylaw Residence 4 District,4.122,Section 4 does allow for a home office. The plumbing debris and supplies noted in the complaint dated March 1st,2016 have been removed weeks ago as observed during a previous inspection on February 4th,2016 when the Cease and Desist letter dated January 4th, 2016 was lifted. The lack of evidence of a business being conducted at the above property and the removal of debris and supplies would address your concerns of violation(s) of Residence 4 District,4.122,Section 4, Sub sections b,c,e,f. For the use of a dwelling in any residential district or multi-family district for a home occupation, the following conditions shall apply: a. Not more than a total of three(3)people may be employed in the home occupation. one of whom shall be the owner of the home occupation, and residing said dwelling b. The use is carried on strictly within the principal building: 31 c) Parking on Rights-of-Way. No parking area or aisles shall be laid out on land, which is reserved as a vehicular right-of-way, whether developed or undeveloped, and whether public or private unless otherwise permitted as provided in Section 8.1.4. d) Parking in Required Setbacks. No unenclosed parking area shall be allowed within five (5) feet of a front lot line except on a residential driveway. e) .Village Commercial District. i) Parking lots shall be provided only at the side or to the rear of the buildings. The Planning Board may, at their discretion, allow up to 50 spaces, or 25% of the total parking, whichever is greater, to be located to the front of the structure as long as all other dimensional criteria are adhered to. ii) No single section of parking may contain more than twenty-five percent (25%) of the total proposed parking spaces or more than fifty (50) spaces, whichever is less. As a method of division,'6' wide parking lot islands shall be installed to provide the proper break between adjacent parking lots. For projects which require less than fifty (50) spaces in total, the Planning Board may allow fifty (50) spaces to be located together if an effective visual buffer is provided. Each landscaped island must be 6' in width at the minimum. In locations where the possibility exists to enlarge the entire island or portions thereof, the Planning Board would recommend that such measures be taken. f) Residential Zoning Districts. � i) For single- and multi-family dwellings, the front yard shall not be used for parking for accessory uses. ii) Parking or outdoor storage of onewrecreational vehicle (camper, etc.) and one (1)boat per r dwelling unit may be permitted in an area to the rear of the front line of the building. All other recreational vehicles and boat storage(if any)shall be within closed structures. iii) Garaging of off street parking of not more than four (4) motor vehicles per dwelling unit may be permitted, of which four (4) motor vehicles, not more than two (2) may be commercial vehicles other than passenger sedans and passenger station wagons, but not counting armruc is nor motor-powered agriculture implements on an agriculturally active farm or orchard on which such vehicles are parked. 7. Exceptions. The regulations of this section shall not apply to residential and non-residential uses or structures whose minimum parking under the above schedule would amount to five (5)parking spaces or less. 8. Special Permits. The Planning Board as SPGA, may grant a Special Permit modifying certain parking/loading standards of this Section and/or Section 8.4 (Screening and Landscaping Requirements for Off- Street Parking), but only in the specific circumstances listed under "a" through "h" below. The SPGA may grant such special permit only when: (a)consistent with the purposes set forth in Section i 8.1; (b) imaking the findings and determinations set forth in Section 10.3; (c) malting a finding that the requested relief falls within one or more of the categories for the specific relief requested (any of cases "a"through "h"below); and, (d) upon a determination that the relief does not cause detriment to the surrounding neighborhood based upon any of the following applicable criteria: • (i) Increase in traffic volumes; 92 : c. There shall be no exterior alterations, accessory building,or display which are not customary with residential buildings; d. Not more than twenty-five(25)per cent of the existing gross floor area of the dwelling unit so used,not to exceed one thousand(1000)square feet,is devoted to such use. In connection with such use,there is to be kept no stock in trade, commodities or products which occupy space beyond these limits. e. There will be no display of goods or wares visible from the street; f. The building or premises occupied shall not be rendered objectionable or detrimental to the residential character of the neighborhood due to the exterior appearance, emission of odor, gas, smoke,dust,noise, disturbance,or any other way become objectionable or detrimental to any residential use within the neighborhood. g. Any such building shall include no feature of design not customary in buildings for residential use within the neighborhood. 5. Real estate signs not to exceed twenty-four(24)inches by thirty-six(36) inches in size which shall advertise only the rental, lease,or dale of the premises upon which they are placed. 6. a. Farming of field crops and row crops,truck gardens, orchards,plant nurseries, and greenhouses. i b. On any lot of at least three(3)acres,the keeping of a total of not more than three(3) of any kind or assortment of animals or birds, except chickens being kept,harbored,raised, or maintained as accessory to a residential single family structure as defined in 4.122.6(e), in addition to the household pets of a family living on such lot, and for each additional acre of lot i size to five(5)acres,the keeping of one additional animal or bird;but not the keeping of any j animals,birds or pets of persons not resident on such lot. c. On any lot of at least five (5)acres the keeping of any number of animals or birds regardless of ownership and the operation of equestrian riding academies, stables, stud farms,dairy farms,and poultry batteries. I The sale of products raised as a result of the above uses on the subject land. e. A single family residence may keep a maximum of six(6)hens. Two (2)family residences in addition to single family residences may keep six (6)hens as long as hens are owned by the homeowner who must reside in the property. (Floor Amendment 2013/28) j For lots of at least three(3) acres, a single-family residence may keep a maximum of three (3) hens per acre of lot size. No roosters shall be permitted. i i Such residence must maintain a.minimum coop area of four(4)square feet per hen. E The owner of the hens must live in the residence. i Hens and coops are prohibited from the front yard of a residence,unless screened by a privacy fence of at least six(6)feet in height. No coop shall be located closer than forty(40)feet fiom any residential structure occupied by someone other than the hen owner,custodian or keeper. - - i 32 i The hens shall be secured in a coop and contained in a fenced area on the property when out of the coop. This use shall meet all current applicable State or Board of Health regulations regarding the raising of chickens. 7. Swimming pools in excess of two (2)feet deep shall be considered a structure and permitted provided they are enclosed by a suitable wall or fence at least four (4)feet in height to be determined by the Building Inspector to prevent the entrance of persons other than those residing at the pool location. Pools shall have a minimum ten(10)foot setback from side and rear lot lines and be located no nearer the street than the building line of the dwelling, except by Special Permit. 8. Museums. 9. a. Public and private non-profit educational facilities. (1986/17) b. Conversions - The conversion of an existing one-family to a two-family dwelling, by special permit from the Zoning Board of Appeals in accordance with Sections 10.3 and 4.122.14.D of this Bylaw, provided that conversion fiom a one-family to a two-family dwelling meets the following additional requirements: ' a. If a conversion involves increasing the size of an existing structure, the expansion area shall not exceed 50% of the original building's gross floor area tip to a maximum of 1500 s.f. The size of the second dwelling unit can never exceed 1500 s.f. b. If a conversion involves razing an existing structure, the gross floor area of the new residential structure shall not exceed 150% of the gross floor area of the original building, nor shall the new structure be more than 1,000 square feet of gross floor area larger than the original structure, whichever is less. The size of the second dwelling unit may never j exceed 1,500 square feet.If an existing lot is subdivided to form two or more new lots, and the existing structure lies within more than one of the new lots, and if the existing structure is to be razed in connection with the conversion, then new buildings on any lot formerly covered by the existing structure must comply with all the provisions of 4.122.14.13 of the Bylaw. Newly created lots not formerly covered by the existing structure must meet the requirements of 4.122.14.D of the Bylaw. c. There must be two parking spaces for each dwelling unit. d. No parking/driveway shall be permitted within 10 feet of any lot line. e. No garage or carport shall face the street unless it is located at least 10 feet behind the front fagade of the principal structure and in accordance with the dimensional setbacks outlined in Table 2 of this Bylaw. f. The converted structure shall meet all of the dimensional requirements of the R-4 District identified in Table 2 of this Bylaw. 33 g. Stairways leading to the second or any higher floor shall be enclosed. I The principal building in a conversion to a two-family dwelling shall share a connected common wall (or floor) for at least 75% of the wall's (or floor's) surface. No unheated structure, no structure without foundation, and no structure that is entirely or partially a garage shall be considered as meeting the 75%requirement. L The conversion of a one-family dwelling to a two-family dwelling: 1. Must not result in any portion of the post-conversion roofline height exceeding the pre- conversion roofline height by more than five(5)feet,and 2. Must not significantly increase or decrease the pitch of any additional post-conversion roof area C. The conversion of an existing dwelling to accommodate not more than five (5) residential units, by special permit fiom the Zoning Board of Appeals in accordance with Sections 10.3 and 4.122.14.1) of this Bylaw. The conversion of a single family dwelling to a two-family dwelling must comply with the provisions of Sections 10.3, 4.122.143, and 4.122.14.D. D. Special Permit Granting Criteria for Two-Family Dwelling and One-Family to Two-Family or Multi- Family Conversions. a. The ZoningBoard of Appeals may approve a special permit for a proposed use of a pp Y pP p building, dwelling or structure provided by Section 4.122.14.A.b., 4.122.14.B or 4.122.14.0 upon finding that the application complies with the purposes of this Bylaw, and is consistent with the use of the site for the ose ur permitted within the Residential 4 I P p District. In malting its decision, the Zoning Board shall consider the following criteria in addition to those listed in Section 10.31: 1. Consistency with the North Andover Master Plan. 2. The degree to which the proposed use fiuthers the Town's interest in providing a range of housing types,where applicable. 3. The degree to which the application addresses the following design standards: i. Achieve compatibility with the established pattern of uses in the district. The Residential 4 District consists primarily of single-family dwellings near the Stevens Memorial Library Area and off of Massachusetts Avenue, and more compact neighborhoods with a mix of residential uses toward Waverly Road. New construction or substantial alteration of buildings must compliment and reinforce the design features of these neighborhoods. ii. Achieve design compatibility with architectural features and exterior materials of surrounding structures. iii. Preserve existing structures of historic value. Buildings, dwellings or structures j listed on the National Register of Historic Places or the State Register, and are i more than 50 years old as of the date of application for a special permit, may be converted, constructed, reconstructed, restored or altered only in a manner that maintains or promotes their status as listed or eligible historic resources. For purposes of zoning compliance, additions or alterations that adhere to the U.S. Secretary of the Interior's Standards for the Treatment of Historic Properties will generally be presumed to maintain or promote such status. iv. Preserve established,mature vegetation. b. The right to apply for a special permit to convert an existing dwelling shall extend to any dwelling to be converted for use as a dwelling of not more than five (5) residential units, and meeting all requirements of the State and Town Statutes and Bylaws, including the 34 Health Codes,Building Codes,Zoning Laws and Zoning Bylaws. Proof of ownership must be supplied with the application. E. Definitions: a. Addition: The enlargement,alteration, extension or change to an existing dwelling unit that does not result in the creation of an additional dwelling unit. b. Conversion: The enlargement, alteration,extension or change to an existing dwelling unit that results in the creation of one or more additional dwelling units in a single structure. A property is considered a conversion whether the added dwelling units are included as part of the existing structure, or whether a new structure is built after razing/demolition of the existing structure. 15. Municipal recreational areas. 16. Guest or rooming houses. 17. Nursing and convalescent horns — see dimensional requirements of Table 2 (Special Permit Required). 18. However, the 1/4/2016 Order Letter that you referred to states, "All commercial vehicles must be removed from the premises within 10 business days". See the picture below taken yesterday (it does not show the congregation of other commercial vehicles). You also stated that they are "sick of neighbors harassing" them. This troubles me because I believe that you are aware of the hostilities between them and their neighbors, yet information was relayed to them regarding my complaint. Yet it would not be disclosed to us who had made a complaint about our home. Specifically my father-in-law Don was reported to your office when he had his bathroom floor replaced and plumbers moved his sink vanity etc... Don, who lives upstairs from me, asked who had reported him, but it would not be disclosed. Then Patrick Melvin came by to apologize to Don since Don was not the target of his complaint - I was - as retribution for reporting his business to the town. [Patrick saw the Apollo Plumbing truck and reported us for no permit.] There was no other way for Patrick to find out who had reported him to the town than through the inappropriate disclosure of my complaint to him. After the third text, Mrs. Melvin asked not to contact her anymore and I immediately stopped trying to contact either of the Melvins from that point on. On or about November, 2015 other neighbors in our neighborhood and I discussed the annoyance that the Melvins' business was creating. It seemed to me and to the other neighbors that the Melvins were operating a business in a residential neighborhood in violation of the North Andover Zoning bylaw. 13. Such request may be delivered in hand to the office of the custodian or mailed via first class mail. MASSACHUSETTS PUBLIC RECORDS ACCESS REGULATIONS (Excerpts from the Code of Massachusetts Regulations) 950 Code of Massachusetts Regulations(CMR)32.02: Scope and purpose. 950 CMR 32.00 shall be construed to ensure the public prompt access to all public records in the custody of state governmental entities and in the custody of governmental entities of political subdivisions of the Commonwealth,and to ensure that disputes regarding access to particular records are resolved expenditiously and fairly. 950 CMR 32.00 shall not limit the availability of other remedies provided by law. 950 CMR 32.03: Definitions.As used in 950 CMR: "Custodian" means the governmental officer or employee who in the normal course of his or her duties has access to or control of public records. Every governmental entity shall maintain procedures that allow,at reasonable times and without unreasonable delay,access to public records in its custody to all persons requesting public records. Each custodian shall comply with a request as soon as practicable and within ten days. (4)Description of Public Records.Any person seeking access to a public record or any portion thereof shall provide a reasonable description of the requested record to the record custodian so that he or she can identify and locate it promptly.A person shall not be required to make a personal inspection of the record prior to receiving a copy of it.A custodian's superior knowledge of the contents of a governmental entity's files shall be used to assist in promptly complying with the request.(emphasis added) (5)Prohibition of Custodial Requests for Background Information.A custodian may not require the disclosure of the reasons for which the requester seeks access to or a copy of a public record. Rolling commercial dumpster remains on-site 2. The employees continue to gather in the morning and return throughout the day often several times for supplies/equipment. 3. As for more than one company truck(owner) being parked on site,they now have commenced playing the game of leaving one vehicle on the street overnight(viol. Overnight pkg. ban). 4. Now leave discarded water heaters&debris in the rear of the PU trucks(either parked on street or on the property)apparently they assume the substitution of truck vs.yard is OK. We are now at the point realizing that the casual conversation approach is probably NOT going to get the job done.We understand that the soft approach is often the most reasonable but only if the offender(s)themselves are reasonable. You clearly indicated that more than one conversation between yourself and the two principles of the business one of whom is the owner of the property had taken place and you were confident that they understood what was expected of them as well as what was required in order to clear the matter up. As you and I spoke I felt that your initial approach to the complaint in handling it verbally with C11 the property owner and no official enforcement action that the issues raised would most likely be resolved satisfactorily. You also assured me that should they(business owners/property owner)fail to continue in a positive manner working towards a resolution I merely had to call your office and they would be spoken to again. I left feeling confident that the issue was well in hand and moving in a positive direction and a resolution was in the making. Prior to departing your office I had mentioned that they had placed a trash barrel at curb side with several (expansion tank)types of plumbing debris which the trash contractor refused to remove on Monday, December 21st.This debris had been sitting in the yard area for more than a week prior to the Dec. 21st date indicating that they were continuing to bring back and store commercial waste debris directly related to their business interest On Friday, December 25, 2015 (Christmas ) not only are the tanks still at curbside but the following activities have NOT ceased and continue to this writing: (1)They continue to bring debris from their operation back to this location and store it for any length of time in this case more than two weeks (2)The employee continue to gather to start the day'work and the returning throughout the day often times several times either for parts, unloading etc. continue (3)The parking of multiple company vehicles and/or workers vehicles either on the property or in the street daily while they're off working and finally (4)The dumpster remains on site for the collection and disposal of commercial business debris often time overflowing requiring additional refuse containers ( see attached photos). I'm beginning to doubt that the party(s) involved with these activities truly do not understand or they're deliberately ignoring your direction and or authority in correcting the actions. Without a defined schedule from your office for these activities including a firm date for the removal of the dumpster I'm concerned that they will NOT come into compliance willingly. This is not the usual home-business that would be acceptable in this area-as evidenced by the fleet of commercial vehicles, a reappearing commercial plumbing dumpster, and outside storage of water heaters,radiators, and other plumbing equipment. Sometimes the overflowing dumpster scatters debris onto our property. When other neighbors bring up the issue of plumbing equipment and trash all over the Home/Business property, it is just moved around into our view. For example, see the attached photo of a recent move of equipment behind a shed when another neighbor complained. This is not appreciated and we have brought all this up with the previous owner of 225-227 Main St. many times without lasting impact. We believe that our other neighbors have sufficiently described the situation (including to the Town and the Home/Business itself). Enough is enough. The property has been abandoned for several years. It appears that all utilities are disconnected and not running. The vegetation has over taken the home and the grass has not been mowed forever. Small animals, such as squirrels and raccoons are seen entering through holes in the roof and chimney. I just wanted to confirm what we spoke about. You stated that 225-227 Main Street was sent an Order Letter on 1/4/2016 and that since that time, they have cleaned 90% (or more) of the plumbing etc... Also, they are trying to obtain storage for the remainder when they have enough money to do so. It was not clear to me why they would still be seeking storage when they apparently view it to be cleaned. You also said that they were allowed to have commercial vehicles under a certain weight at the residence. However, the 1/4/2016 Order Letter that you referred to states, "All commercial vehicles must be removed from the premises within 10 business days". See the picture below taken yesterday (it does not show the congregation of other commercial vehicles). You also stated that they are "sick of neighbors harassing" them. This troubles me because I believe that you are aware of the hostilities between them and their neighbors, yet information was relayed to them regarding my complaint. Yet it would not be disclosed to us who had made a complaint about our home. Specifically my father-in-law Don was reported to your office when he had his bathroom floor replaced and plumbers moved his sink vanity etc... Don, who lives upstairs from me, asked who had reported him, but it would not be disclosed. Then Patrick Melvin came by to apologize to Don since Don was not the target of his complaint - I was - as retribution for reporting his business to the town. [Patrick saw the Apollo Plumbing truck and reported us for no permit.] There was no other way for Patrick to find out who had reported him to the town than through the inappropriate disclosure of my complaint to him. If complainants should not be revealed by the town, then they should not be revealed regardless of .ationships. I believe this is a policy that should have been upheld in this circumstance, especially since it contributes to ongoing hostilities between them and us (and multiple other neighbors). In the summer of 2015, after our relationship as real estate agent and potential buyer ended, I attempted to contact Mr. Melvin to bid on some plumbing work which my wife and I were planning in connection with improvements to our home. 11. I had no luck in getting Mr. Melvin to get back to me so I contacted his wife in an effort to see if Mr. Melvin wanted my business. I contacted Mrs. Melvin three times via text. After the third text, Mrs. Melvin asked not to contact her anymore and I immediately stopped trying to contact either of the Melvins from that point on. I have not tried to have direct contact with either of them since approximately August, 2015. 12. On or about November, 2015 other neighbors in our neighborhood and I discussed the annoyance that the Melvins' business was creating. It seemed to me and to the other neighbors that the Melvins were operating a business in a residential neighborhood in violation of the North Andover Zoning bylaw. 13. I took several steps to make the Melvins cease their commercial enterprise in our neighborhood including filing complaints with the North Andover Building Inspector and taking pictures of(1)the trucks used by the Melvins in their business, (2)the employees of the business coming and going, (3)the unsightly dumpster on the Melvins property and (4) the materials used in their business. All of those photographs were taken of people and things in plain view of the public. 14. All of the photographs I took were taken from my own property. I never set foot on the Melvins property to take any pictures. 15. All of the photographs I took were for the purpose of demonstrating to the North Andover Building Inspector, who is also the zoning enforcement officer, and potentially to the North Andover Zoning Board of Appeals if necessary, the scope of the business that the Melvins were operating. 16. I have not taken photographs of any person or thing not directly related to the Melvins home operated plumbing business and no photograph is of anything except persons or object in plain public view. -17. I have been told by the other neighbors who are concerned about the Melvins' business that they have also filed complaints with the North Andover Building Inspector. These issues continued up to and through Phase 11 as outlined in our Phase 11 complaint filed just after Christmas of 2015.Admittedly,the exterior has been somewhat cleaned up but they continue with the following: 1. Rolling commercial dumpster remains on-site 2. The employees continue to gather in the morning and return throughout the day often several times for supplies/equipment. 3. As for more than one company truck(owner) being parked on site,they now have commenced playing the game of leaving one vehicle on the street overnight(viol. Overnight pkg. ban). 4. Now leave discarded water heaters&debris in the rear of the PU trucks(either parked on street or on the property) apparently they assume the substitution of truck vs.yard is OK. We are now at the point realizing that the casual conversation approach is probably NOT going to get the job done.We understand that the soft approach is often the most reasonable but only if the offender(s)themselves are reasonable. At this time we would appreciate a hard and fast deadline for the on-going issues to be finally resolved and the silly games to cease (by months end) in an effort to avoid a more serious escalation to resolve these lingering issues. Prior to departing your office I had mentioned that they had placed a trash barrel at curb side with several (expansion tank)types of plumbing debris which the trash contractor refused to remove on Monday, December 21st.This debris had been sitting in the yard area for more than a week prior to the Dec. 21st date indicating that they were continuing to bring back and store commercial waste debris directly related to their business interest On Friday, December 25, 2015 (Christmas) not only are the tanks still at curbside but the following activities have NOT ceased and continue to this writing: (1)They continue to bring debris from their operation back to this location and store it for any length of time in this case more than two weeks (2)The employee continue to gather to start the day' work and the returning throughout the day often times several times either for parts, unloading etc.continue (3)The parking of multiple company vehicles and/or workers vehicles either on the property or in the street daily while they're off working and finally (4)The dumpster remains on site for the collection and disposal of commercial business debris often time overflowing requiring additional refuse containers (see attached photos).
