Please be advised that after public hearing held by the Board of Appeals R
on April 14, 1980 upon application of subject petitioners, the Board voted
4-1 in favor of GRANTING the-variance. Members James D. Noble, Jr. , Acting
Chairman, Richard J. Trepanier and Assoc. ,Members William, J. Sullivan,
Walter F. Soule, and Augustine W. Nickerson were present and voting. IIr.
Noble was the dissenting vote. A condition of approval was that the porch
may be maintained but not added to, rebuilt or replaced.

Gentlemen:
Our records show that Mr. and Mrs. Dolan were
issued a building permit on June 12, 1974 for a dwelling
and 2-car garage. There is no record of any building permit
being issued for a porch. Apparently, this porch has been
built without benefit of a building permit in violation of
the zoning setback requirement.

Sec. l APPLICATION FORM
Every application for action by the Board ' shall be made on
a form approved by the Board. These forms shall be furnished by the _-.
clerk upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until such
time as it is made on the official application form. All information :
called for. by the form shall be furnished by the applicant in the manner
therein prescribed. .
Every application shall be submitted with a list of "Parties
in Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way and
owners of land within three hundred.- feet of the property line all as

Property") in North Andover , Massachusetts.
2. We are aware of a structure on the Dolan Property
that may not conform to the setback requirements as
set forth in .the comprehensive zoning By-Law of the
Town of North Andover , Massachusetts.
3 . So long as the structure is not materially
destroyed, removed or rebuilt, we have no objection
to the presence of such a structure nor do we in
any way object to the granting of a variance for
any present non-conforming setbacks of the
structure.

2. That we are aware of a structure that exceeds the side
line requirements as set forth in the comprehensive
zoning ordinance of the Town of North Andover,
Massachusetts.
3. That we have no objection to such a structure nor do we
in any way object to the side line being varied to
allow the structure to become a permitted non-
conforming use.
