Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service o£another under any their e of hire,
express on implied,oral or written."
An employee:is defined as"an individual,partnership,association,corporation or,other legal entity,or any two or more
of the Foregoing engaged in a joint enterprise,and including the legalxepresentatives of a•deceased employer,.or Elie
receiver or•fru a of'an individual,partnership,association.or other legal entity,employing employees. however the
owner of a dwelling house having notmore than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on,such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employes."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth.for any
applicant who has not produced-acceptable evidence of compliance with the insurance coverage requlred:'
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance ofpublic work until acceptable evidence of compliance with the insurance
requirements of this chapterhave beenpresentedta the contracting authority."

The Board of Appeals held a public hearing on Tuesday evening, March 14, 1989
upon the application of Peter Pawlick requesting a variance from the require-
ments of Section 7, Paragraph 7.3 and Table 2 of the Zoning ByLaws so as to
permit the addition of a front porch on the premises located at 23 Dana Street.
The following members were present and voting: Frank Serio, Jr. , Chairman,
Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, William Sullivan,
and Walter Soule.
The hearing was advertised in the North Andover Citizen on February 23, 1989
and March 2, 1989 and all abutters were notified by regular mail.
Upon a motion made by Mr. Sullivan and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the variance as requested.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning ByLaws and the granting of this variance will not
derogate from the intent and purpose of the Zoning Bylaw.
