Dear Members of the Zoning Board of Appeals: • •.
The above matter is the appeal by abutters, the Hamels, of
your grant of variances to Amy Cameron-.Callin.i.-,, .;._Shortly before
trial,• the .parties _agreed to a settlement. You may recall that
the variances .granted-` allowed Ms. Cameron-Callini to build an
addition to her. .house.' � The Hamels objected to the fact that the
addition extended beyond the front of Ms. Cameron-Callini's house
and was detrimental to them. The Hamels stated that they would
not object to the construction of a comparable addition if it did
not project beyond the front of Ms. Cameron-Callini's house.
Pursuant to this agreement, the terms of the settlement were
that Ms. Cameron-Callini would apply for the variances necessary
to construct her addition beside and behind her house (while
demolishing the protruding section already built) . This
agreement is, of course, contingent on your grant of the new
variances in place of those you had earlier granted. This matter
would return to you upon entry by the court of an agreement
remanding the matter to you.
I will notify you when such an agreement is entered by the
court. At that point, I anticipate that Ms. Cameron-Callini will
present new plans to the Zoning Board of Appeals seeking new
variances. . Do not hesitate to contact me if you have any
questions, during this process. ;

All stated they had.
Upon a motion by Mr. Rissin and seconded by Mr. Soule the Board
voted unanimously to GRANT the variances as requested. (Serio,
Soule, Vivenzio, Rissin, Pallone)

Mr. Laudani was not present to speak for this project.
Upon a motion by Mr. Vivenzio and seconded by Mr. Soule the Board
voted unanimously to CONTINUE this public hearing.
DISCUSSION
Juba Electric
The Board discussed some of the material that was submitted
tonight. They all once again decided that they wanted to take
some time to review the material.
Thomas Laudani then arrived for the following hearing.
PUBLIC HEARINGS
Meadows Realty Trust Variance Meadowood Road
Mr. Soule read the Legal. Notice. Mr. Laudani appeared to request
a variation from the Phased Development Bylaw to allow for the
construction of 26 single family homes in 1993 . This subdivision
will be built in an R-6 zone. Approval for this project was
received in January 1993 . In six weeks of marketing, fourteen
homes were put under agreement. Mr. Laudani expects all the
homes to be sold by May 1993 when all the roads are done. The
homes will then be built between May and December 1993 .
No correspondence was received and no one present in opposition
to this request.
Mr. Rissin asked what section and paragraph of the zoning bylaws
this was listed under. He was told Section 4, Paragraph 4 . 2
which states that 33% of 21-34 homes may be built within a year.
Mr. Soule read a letter from George Perna, Planning Board
Chairman, stating that his Board is in support of this

Residence-3 states that warehousing and wholesaling is not an
allowed use. Mr. Nicetta stated that Mr. Juba admitted to
receiving deliveries of supplies at his home. Mr. Pallone stated
that he'd like to see the definition of "home occupation".
Atty. Marden stated this is the first complaint of record since
in 1967. He feels it is impossible for this Board to conclude
that this business is obnoxious, or a nuisance, or detrimental to
the neighborhood. Mrs. Schena stated she is bothered with the
traffic from the Juba trucks.
Mr. Soule asked if the Board had any more questions. Mr. Pallone
asked Mr. Juba if he uses any contract employees. Mr. Juba
stated he employees five people only. Mr. Rissin asked Mr. Juba
if he could provide proof of employees with tax statements from
1967. Mr. Juba stated he wasn't sure, but he would check. Mr.
Rissin said this would help to decide if the business has
expanded.
Upon a motion by Mr. Rissin and seconded by Mr. Vivenzio the
Board voted unanimously to CONTINUE the hearing in order to
gather additional evidence.
Amy Cameron/Callini variances 23 Perry Street
Legal Notices were read by Mr. Soule. Atty. David Bernardin,
346 N. Main St. , Andover, MA represented the applicant requesting
two sideyard variances. He stated Ms. Callini obtained from the
building office a building permit to construct an addition to her
home on December 8, 1992 . Apparently, the Assistant Building
Inspector did not notice the side setbacks were in violation.
A letter from
the abutters was read by Mr. Soule. (See file)
Mr. Serio asked if there was anyone present who wanted to speak
in favor of the petitioner. No one spoke. Mr. Soule read a
letter from some abutters in support of this project. (See file)
Mr. Serio then asked if there was anyone present who was in
opposition to the petition. Mr. Richard Hamel o
PA p f 21 Perry Street
spoke. He stated he lives in the house directly in front of Ms.
Callini's. Mr. Hamel distributed copies of a letter that he had
sent to the Asst. Building Inspector. (see file) Construction of
Ms. Callini's addition began on December 21, 1992 . Mr. Hamel
contacted the Building Department on December 28, 1992 and the
construction was stopped. Mr. Hamel stated that in his opinion
there is no hardship. There was plenty of room in the rear and
the side of the dwelling to build. Mr. Hamel just asked that the
Board request the applicant to move the addition back
approximately 8 1/2 feet.
Abutter, James Cassidy, 13 Perry Street spoke. He has lived in
the neighborhood for forty years andave a little background on

the area. He stated that he is not for or against this petition.
Mr. Serio asked Ms. Callini if she would agree to a compromise.

She stated she could not afford to tear down and build over
again. She stated that she has spent over half her money on the
addition and now she has had to hire a lawyer. Atty. Bernardin
stated the figure he got from the contractor to tear down the
existing structure and build over again was $23 ,900.
Mr. Serio stated he would like to refer this to Town Counsel for
a ruling.
Motion by Mr. Rissin and seconded by Mr. Vivenzio the Board voted
unanimously to put this UNDER ADVISEMENT.
Mr. Vivenzio and Mr. Rissin also stated that they would like to
see the application for the building permit.
Borden Inc. Variance Holt Road Extension
The Legal Notice was read by Mr. Soule. Mr. Bob Graham from
Cutter Associates represented the applicant requesting relief of
31 feet for the front yard setback. Mr. Graham stated that a
new property survey indicated that a previous survey inaccurately
located the existing building. A variance had already been
granted to reduce the setback to 25 feet in June 1992 . Mr. Serio
asked if anyone else wanted to speak in favor of this petition.
No one spoke.
No one present and no correspondence received in opposition to
this request.
Upon a motion by Mr. Vivenzio and seconded by Mr. Rissin, the
Board voted unanimously to GRANT the variance as requested.
Andrew Slauter Variance 67 Hewitt Avenue
The Legal Notice was read by Mr. Soule. Atty. Dana Cohen
represented the applicant requesting a 6 foot variation for the
rear setback. This dwelling was originally built in the 1920's
and addition was built in 1971. Mr. & Mrs. Slauter has entered a
purchase and sales agreement to sell the property when the
engineers found the encroachment. Mr. Rissin asked if any more
construction is to take place. Atty. Cohen stated there is no
construction planned.
No one present and no correspondence received in opposition to
this request.
Upon a motion by Mr. Vivenzio and seconded by Mr. Rissin the
Board voted unanimously to GRANT the variance as requested.
Frank A. Marino Variance Great Pond Road
The petitioner was not heard because it was not properly brought
before the Board. The application should have stated the Brooks
School, not Mr. Marino as the applicant. Subsequently, the
advertised Legal Notice read Mr. Marino and not the Brooks
School. Mr. Marino was instructed to refile for next month under

Meadows Realty Trust Variance Meadowood Road
Mr. Soule read the Legal Notice. Mr. Laudani appeared to request
a variation from the Phased Development Bylaw to allow for the
construction of 26 single family homes in 1993 . This subdivision
will be built in an R-6 zone. Approval for this project was
received in Januar 1993six
January . In weeks of marketing, fourteen
homes were put under agreement. Mr. Laudani expects all the
homes to be sold by May 1993 when all the roads are done. The
homes will then be built between May and December 1993 .

The following is a list of things that happened prior to my complaint
to the building inspector about a violation of the building code at 23
Perry Street.
In the months prior to construction, the owner - Amy Cameron - told me
she wanted to add a bedroom. I informed her of the restrictions
related to this lot: that she could not build forward and almost
anything else she did would be in violation and would require a
variance and she would have to go to the board of appeals.
She then hired an architect who grew up in this town, the son of the
former building inspector, who should have known you cannot build less
than five feet (58 inches) from someone else's lot line.
She then hired a builder who grew up in this town, the son of a
contractor, he should have known you cannot build less than five feet
from the lot line.
She then applied for, and was given, a permit to build. The building
inspector did know better, and the assistant inspector admitted he
goofed.
She decided to disregard what I told her because someone else told her
what she wanted to hear.
When constructionLgan on December 21, 1992, I did not speak up
because I had-,ho iwhat was going up next to my kitchen window.
Two days later, when I saw the size of this structure, I decided to
speak to Amy and she told me "it's my property and I can build what I
want. " I could not contact the building inspector until Monday,
December 28, 1992 and that is when construction stopped. If there was
anything else I could do to avoid this situation, I would have done
it, but I ran out of options. I do try to be a good neighbor.
In closing, I would remind the board there is no hardship here, there
is plenty of room on the side and to the rear to build what she wants,
but she chose to build out front.
I am the only one playing by the rules, and I don't like being told I
am the one causing the problem by complaining. My whole life is in
this property, ' andiI will do what I can to' protect it.

Then I bought my house 35 ,years ago, I knew there was a house very
close to the lot line to the rear of my house and I accepted that, the
same as she had to accept this when she bought hers I I/2 years ago .
I am no longer a young man and every thing I have is tied up in
this house,my whole life is here .I only want to live in harmony with
my neighbors.My new neighbor' s only interest is to build what she wants
and to hell with the neighbor.
Must Inow suffer deer&ciation and encroachment on my property
because the building inspector goofed and issued an invalid permit.
I was denied the chance to voice my objection at a board of appeals
hearing because there was never one held,and now I must rely on this
board to do whatever it takes to stop this injustice.
