Most notably: Gas baffles were installed on.the,inlet tees, not the outlet tees (can you believe that one D -box was not level ✓No electrical service to verify pumps, panel,4etc: f Tanks need to be checked for watertightness Please also note the contractor used a;different pump than the one specified -on the plans When I asked if this was going be documented on the as -built, he indicated.he did -not believe the designer -was aware of this change. I did not push him to switch out the pumps, but�did ask him to coordinatnwith'the designer on this matters I'd S ggest we stay on t of that. Lastly, please note the contractor based his benchmark elevation on what was indicated on the design plan was going to be the building foundation elevation, instead of the actual benchmarks. Our inspection was based on the actual benchmarks and found everything to be in satisfactory compliance (you will note since the wrong benchmark was used, the soil absorption system is significantly higher in elevation than required). Joe also will be responsible for the final location and placement of the manhole(s). He will be on site to assist Watson when needed. The installer was to contact the Biodiffuser trainer to assist in the installation of the units. He should call the health office when the trainer is to be on site. A bottom of the tank bed inspection will'be done this am. All questions should go to the engineer. If not, I would like your office to send an engineer to the site to direct the installer on the process of the manhole placement, including the type of manhole, diversion box, angles to enter the tank etc. Watson indicated that he may need to install 2 manholes as there may be 2 bends in the building sewer, but it is not up to the installer to make these determinations. Whomever is going to make this decision must do so quickly so we may keep this job moving. I will see some of you on site Monday morning. The installation of the leaching field should procede quickly. Hopefully, if all goes well with the tanks, we can be done with this within a week. If the component is placed in fill, proper compaction is required to ensure stability and to prevent settling; native ground with a six inch stone base is otherwise adequate. (3) Septic tanks, grease traps and dosing chambers shall be equipped with a watertight access manhole(s) with a minimum diameter of 20 inches and constructed of durable material. (4) All system components shall be constructed of corrosion resistant materials. (5) All piping shall be a minimum of Schedule 20 PVC in areas not subject to automobile or heavy equipment traffic. In areas where such traffic exists or is anticipated, Schedule 40 PVC shall be used. (6) All pressurized pipes shall be designed and installed to meet the following requirements: (a) to prevent freezing by being installed below the frost line, by being adequately insulated if installed above the frost line, or be self -draining; (b) to specify the appropriate class or schedule of pipe to withstand maximum pressure and/or anticipated vehicular loads; and (c) to specify appropriate thrust blocking at all angles, bends, branches, plugs and wherever else necessary to prevent disruption of proper functioning of the line. (7) The top of all system components, including the septic tank, distribution box or dosing chamber and soil absorption system, shall be installed no more than 36" below finish grade. Where site restrictions prevent compliance with this provision, a variance maybe sought. (S) Where any portion of any component is to be placed at or below the ground -water table, all system tankage, including the septic tank, distribution box, dosing chamber or grease trap, shall be designed with counter weights, anchors or ballast and a buoyancy calculation for the entire volume of each component, when empty, shall be performed and submitted with the system plans and specifications. (9) Recirculating sand filters or equivalent technology shall be used in accordance with the provisions of 310 CMR 15.202 and Department guidance. 15.222: Buildinp- Sewers (1) The building sewer shall be sufficient to serve the connected fixtures. In no case shall the building sewer be less than four inches in diameter. (2) The minimum distance between a building sewer, and a private water supply well or suction line shall be ten feet. (3) The building sewer shall be constructed of corrosion resistant material and equipped with water tight joints; cast-iron, schedule 40 PVC pipe or the equivalent. (4) All pipe joints of the building sewer shall be made water -tight and protected against damage by roots. Poured -type joints shall be properly wiped on the inside to eliminate obstruction of flow. (10) All building sewers shall be constructed in accordance with the State Plumbing Code, 248 CMR 2.00. 15.223: Septic Tanks (1) Septic tanks shall have the following capacities: (a) For a single family dwelling unit, a minimum effective liquid capacity of 200% of the design flow or a minimum hydraulic detention flow of 48 hours, whichever is greater, shall be required. In no case shall the effective liquid capacity of the tank as measured below the outlet invert elevation be less than 1,500 gallons. (b) When designed to serve facilities other than a single family dwelling unit, and whenever the calculated design capacity is greater than 1,000 gallons per day, a two compartment tank or two tanks in series which meet(s) the design criteria specified in 310 CMR 15.203 is required. The minimum effective liquid capacity of each tank in series shall be 200% of the design flow. In no case shall the effective liquid capacity of each tank be less than 1,500 gallons. (c) When a domestic garbage grinder is proposed or installed, the minimum liquid capacity of the septic tank shall be 200% of the design flow with a minimum tank size of 1,500 gallons and a two compartment tank or two tanks in series shall be required which meet the design criteria specified in 310 CMR 15.223. Domestic garbage grinders shall be prohibited in systems which include an elevated septic tank constructed in accordance with 310 CMR 15.213 (construction in V -zones). (2) The liquid depth of the tank, measured from the outlet tee invert to the tank bottom, shall be a minimum of four feet. A tank with a minimum depth of three feet below the outlet tee invert may be permitted only for upgrade of existing nonconforming or failed systems, pursuant to 310 CMR 15.404 (local upgrade approvals), where installation of a tank with a four foot liquid depth is not feasible and shall be pumped on an annual basis with the results submitted to the local approving authority. (3) Tanks which are rectangular in cross-section shall have a minimum inside length to width ratio of no less than 1.5 to 1. Round tanks may be allowed. The inside length of all tanks, measured from the inlet tee to the outlet tee, shall be a minimum of six feet. The inside width of the tank shall be a minimum of three feet. Larger length to width ratios are preferred. (4) Vertical cylindrical tanks shall have a minimum diameter of five feet. The North Andover Board of Health has completed the review of the septic system design plans, for the above referenced property, submitted on your behalf by MHF Consultant, Last Rev. August 8, 2005. The design has been approved for use in the construction of a new onsite septic system for a childcare center that does not have a full kitchen facilities within its premises, however it will need a food permit to provide limited foods as approved by the health office. This approval is valid for three years from the date of this letter and during this time a licensed septic system installer must obtain a permit and complete this work, and a Certificate of Compliance must be endorsed by the installer, designer and the Town of North Andover. The design utilizes "Bio Diffuser" technology. Please be advised that the septic installer must show proof of certification prior to the issuance of the Disposal Works Construction permit. This approval is subject to the following conditions: 1. If any other site conditions are found -in the field to be different from those indicated on the design plan and/or soil evaluation, the originally issued Disposal System Construction Permit is void, installation shall stop, and the applicant shall reapply for a new Disposal Systems Construction Permit (3 10 CMR 15.020(1)). 2. It is the responsibility of the applicant and/or the applicant's septic system designer, septic system installer or other representative to ensure that all other state and municipal requirements are met. These may include review by the Conservation 0 Commission, Zoning Board, Planning Board, Building InspQ or, Plumbing Inspector and/or Electrical Inspector. Please note that the Electrical Inspector is now requiring exterior emergency shut offs within eyesight of all pump tanks. Contact the inspector for details. The issuance of a Disposal System Construction Permit shall not construe and/or imply compliance with any of the aforementioned requirements. 3. The plan previously indicated that a drilled well is proposed. A revision showing the proposed water line has been added. There will be no well drilled on the property for any use. The letter is going out. I have been in contact with persons regarding the following issues before the disposal works construction permit is issued. 1) The installer says he cannot purchase the Meyer's pump locally and is proposing a "Little Giant " with similar specs. I was told that the engineers want the health office to decide this one, so I am doing research. 2) The installer says that the building sewer invert placed by the plumber is 1 foot higher that specified on the plans. This information has been relayed to Karl. The tank must stay at the same elevation. Assuming that the elevation of the invert cannot be changed, we have to deal with this mistake by the contractor. (you all should deal with how this happened) Karl is reviewing the options. A building sewer with a steep pitch draws concern, as the solids and liquids will separate and may cause future problems. If a 45 or 2 -22 elbows are placed there would likely need to be an external clean out. Again it would be preferable to build it to plan. Waiting to hear from the engineer. 3) 1 am looking for the 30 scale as -built of the building. Does anyone know for sure it is here? I will check with Mike in building dept. on this 4) The issue of the installers certification to install biodiffusers has been solved. DEP was contacted and through multiple communications, the company will now be available to give instruction to the installer on site when needed. 5) Aside from the septic we have the issue of the food for the kids. A letter was sent to Mr. Richards requesting an application be made. I have not seen this application returned. The type of foods formerly applied for has bearing on whether a handsink needs to be designated or a three -bay needs to be added to the plan. It is important this is addressed. An occupancy will not be approved unless this has been addressed. The process is as follows; Application, fees, review, changes as needed, then approval, inspection and issuance of food permit. For clarification, I sent your request to the Department of Public Health Food Division. Last Friday I received a phone call from DPH regarding the issue. The outcome of the phone call is basically as follows. 1) You must submit the completed 2 page application that we provided to you, to the Health Dept. for a "daycare that serves food". Attach to the application a description of all food related activities that you intend to provide. Similar to your letter. Or you could attach the letter as written. This list should again support that you will not be conducting ware washing 2) The Health Department will review the application and the services you intend to provide. If it is determined that you are only doing minimal ware washing, than the 3 -bay sink requirement may be waived. However, there must be a hand sink available in the break room. I believe you had provisions for one sink already. If you choose, you may change the existing proposed sink to a designated "hand sink only" or add another. 3) Please submit specification of any equipment you will be purchasing that will be used to keep foods for the children, hot or cold. It must be NSF or UL approved. 4) Please submit a detailed agreement for service with any food vendor providing food to the clients such as the Real McCoy. The agreement must support the claim that no ware washing will be necessary in your establishment. Also, no plating of bulk potentially hazardous foods should be noted. 5) Along with the application, please submit a fee of $110 which is standard for daycare facilities in N. Andover. This is an annual fee. The permit is good until Dec. 30th of each year. If you plan on opening after Nov. 1st we will issue the permit through the next calendar year. Otherwise, you will need to renew in Dec. and pay an additional $110. 6) As for the requirement to be certified in food handling. You may be exempt as stated in the food code. This will also be looked at once we receive your application. Our next communication should be when you are ready to submit you application. If you are choosing to do more food prep etc. you will have to comply with the entire food code. In addition, any approval letter will note that upon 2x year inspections if conditions change you may need to upgrade the kitchen to meet code. Effective depth can be increased to two feet with the corresponding addition of up to 20 inches of base aggregate for the Field Drain Contactors and up to 12 inches for the Contactor 125. Bottom width can be increased by two to eight SF/LF with the corresponding addition of one to four feet of aggregate per side. III. General Conditions 1. The provisions of 310 CMR 15.000 are applicable to the use of the System, except those that specifically have been varied by the terms of this Certification. 2. The facility served by the System, and the System itself, shall be open to inspection and sampling by the Department and the local approving authority at all reasonable times. 3. In accordance with applicable law, the Department and the local approving authority may require the owner of the System to cease use of the System and/or Advanced Drainage Systems Modified Certification for General Use Page 6 of 8 to take any other action as it deems necessary to protect public health, safety, welfare or the environment. 4. The Department has not determined that the performance of the System will provide a level of protection to the environment that is at least equivalent to that of a sewer. Accordingly, no new System shall be constructed, and no System shall be upgraded or expanded, if it is feasible to connect the facility to a sanitary sewer, unless allowed pursuant to 310 CMR 15.004. 5. Design, installation and use of the System shall be in strict conformance with the Company's DEP approved plans and specifications and 310 CMR 15.000, subject to this Certification. IV. Conditions Applicable to the System Owner 1. The System is approved for the treatment and disposal of sanitary sewage only. Any wastes that are non -sanitary sewage generated or used at the facility served by the System shall not be introduced into the on-site sewage disposal system and shall be lawfully disposed of. 2. For new construction, the owner initially shall size a soil absorption system in accordance with 310 CMR 15.242 to demonstrate that a conventional Title 5 soil adsorption system using aggregate, including a reserve area, can be installed on the site. The owner may than size the soil absorption system for the System. The total area required for the aggregate system, which may include the area designated for the System, and a reserve area shall be preserved and the owner shall ensure that no permanent structures or other structures are constructed on that area and that the area is not disturbed in any manner that will render it unusable for future installation of a conventional Title 5 soil absorption system. 3. The owner of the System shall at all times properly operate and maintain the on- site sewage disposal system. 4. The owner shall furnish the Department any information that the Department requests regarding the operation and performance of the System, within 21 days of the date of receipt of that request. 5. No owner shall authorize or allow the installation of the System other than by a person trained by the Company to install the System. V. Conditions Applicable to the Company By January 31 st of each year, the Company shall submit to the Department a report, signed by a corporate officer, general partner, or Company owner that contains information on the System for the previous calendar year. The report shall state known failures, malfunctions, and corrective actions taken for the System as well as the date and address of each event. 2. The Company shall notify the Department's Director of Watershed Permitting at least 30 days in advance of any proposed transfer of ownership of the technology for which this Certification is issued. Said notification shall include the name and Advanced Drainage Systems Modified Certification for General Use Page 7 of 8 address of the proposed new owner and a written agreement between the existing and proposed new owner containing a specific date for transfer of ownership, responsibility, coverage and liability between them. All provisions of this Certification applicable to the Company shall be applicable to successors and assigns of the Company, unless the Department determines otherwise. The Company shall furnish the Department any information that the Department requests regarding the System, within 21 days of the date of receipt of that request. 4. Prior to any sale of the System, the Company shall provide the purchaser with a copy of this Certification. In any contract for distribution or sale of the System, the Company shall require the distributor or seller to provide the purchaser of the System, prior to any.sale of the System, with a copy of this Certification. The Company shall prepare and provide the Department an installation manual specifically detailing procedures for installation of its System. The Company shall institute and maintain a training program in the proper installation of its System in accordance with the manual and provide a training course at least annually for prospective installers. The Company shall certify that installers have passed the Company's training qualifications, maintain a list of certified installers, submit a copy to the Department, and update the list annually. Updated lists shall be forwarded to the Department.. 6. The Company shall not sell the System to installers unless they are trained to install these Systems by the Company. VI. Conditions Applicable to Installers of the System Each Installer shall install the System in accordance with Company training on the installation of the System and the conditions of this Certification. 2. No Installer shall install the System unless the Installer has been trained by the Company on installation of the System. VII. The purpose of this Certification is to allow use of the System in Massachusetts, on a General Use basis. 2. The System may be installed on all facilities where a system in compliance with 310 CMR 15.000 exists on site or could be built and for which a site evaluation in compliance with 310 CMR 15.000 has been approved by the local approving authority, or by DEP if DEP approval is required by 310 CMR 15.000. Also, I found out that Little Professionals was issued a water and sewer connection sign off from DPW without proof of approved septic design and/or well design. They actually issued the connection permit on the premise that "water service" would be provided by others (others being us). Furthermore, a building permit was issued prior to the septic design being approved and also contingent on "water" being provided by others. I have reason to believe that Little Professionals was unduly authorized permission to build. Suppose we decided to abandon or delay the build out of our project and the infrastructure along Rt 114. and Little Professionals was without water. The Town would be faced with a problem .... a large facility, completed but unable to be occupied. I cannot imagine that the Town would issue a permit to anyone dependant on another property owners ability to provide adequate water and sewer. Let me know your thoughts. I can give you a synopsis of the health portion of this, however, for the building department's part I will tell you only my recollections of my conversations. Apparently this project has been in the works for some time. The file shows a TRC back in April of 2003. At that time Sandy Starr indicated that the applicant would be proposing an on-site septic system and a well and suggested they contact the health office. Soil tests were conducted 7/03. Then the applicant had to go through other departments for many approvals. Last fall, I do not recall the date, I was asked to sign the form "U" and found that the proposed septic design, that was located in the complete plan package to the other boards/departments, had actually never been submitted to the Health Dept. for review. 1 contacted the applicant and engineer and told them that I would not sign the form "U" until the septic plan was approved. 11/24/ They submitted a plan. 12/06/- review was completed 12/09/0 = After changes were requested, a revision was submitted . 12/17/ - A letter from me was sent regarding the proposed well. I was concerned about the daycare center �{[J' being c assified as a "transient water supply" because they served > 25 persons per day. Also, there are issues V j about having septic and well on such a small lot. It was clear that prior to the form "U" sign off by the health Ii dept. they must show DEP approval for the use of a well. 1 1/03/0 A revised plan was submitted with the removal of the well and the addition of the water line. The Health/department approved the septic plan. As in all cases, a permit to install the septic system will not be issued until the water line has been installed, a foundation As -built has been submitted and other items indicated in the approval have been completed. The health department regularly does not consider the issue of when the water will be available at this time. The form "U" was signed on 1/18/05 As for building issues. I was aware that Bob Nicetta had issued a foundation permit prior to the water being brought down to the site. The health dept. was not requested to sign off on any foundation permit, as in general we are not. He also issued it prior to the septic approval. He indicated that the zoning variances on the property were about to expire on 10/28/05 and rather than the applicant re -file everything, he said there was a section in the bldg code that allowed the applicant to proceed at their own risk. He said the applicant was requesting and willing to accept the risk. The building file shows a signed document accepting that risk quoting the bldg code 780 CMR 111.13. I do not know what date the foundation and building permits were issued. That is about all I recall at the moment. I hope it helps. Let me know if you have any other questions. Rather than requiring a deep hole test at this time, this approval will require that an additional test hole be conducted on the northern portion of the system, at the commencement of the septic installation. If the soil evaluation indicates a need for change in the plan, the installation permit will be voided until the plan has been redesigned. 2. If any other site conditions are found in the field to be different from those indicated on the design plan and/or soil evaluation, the originally issued Disposal System w. ra C Construction Permit is void, installation shall stop, and the applicant shall reapply for a new Disposal Systems Construction Permit (3 10 CMR 15.020(1)). 3. It is the responsibility of the applicant and/or the applicant's septic system designer, septic system installer or other representative to ensure that all other state and municipal requirements are met. The septic plan itself has been approved and that letter will be forthcoming. Unfortunately, a concern over the private well that was being proposed for this site arose, so today; I contacted the MA Department of Environmental Protection to determine whether this would be of any concern to the Department. I spoke with Claire Golden of DEP. I verbally referenced to her key elements of the project such as; Parcel size, projected number of occupants per day, septic component locations etc.. Ms. Golden immediately indicated that there might be problems with this planned private water supply. As proposed, the water supply will be servicing over 25 persons per day; therefore it will be a transient non -community water system. This system will be subject to restrictions regarding items such as nutrient loading and zones of protection. Ms. Golden can be contacted at the DEP (617) 654-0516. She will be able to direct you to the appropriate DEP personnel to address the concerns. It has also been brought to our attention that there is the possible availability for municipal water to this area in the near future. It was suggested by the site contractor, Mr. Noyes, that possibly the Health Department could sign the building permit with the stipulation that the building be tied into town water if the proposal for a potable well was denied for this site. The Health Department unfortunately cannot make determinations on the possibility of water being available; therefore this is not an option at this time. The preferred method of water supply for that system would be from the municipal water system. Recognizing that the availability of access to the municipal water and sewer system may not be synchronized with the planned building of the Little Professionals, the following is recommended to the applicant in order for the continuation of their project. The fire department would support a conditional approval of the project by the Zoning Board of Appeals provided that: A. The building is designed and built with a full fire alarm and suppression system as if the municipal water system supply would be available. B. An alternative on site water supply is proposed during construction in accordance with recognized Nation Fire Protection Association standards and approved by the fire department in case the municipal water supply is not available prior to occupancy. C. If there is a written commitment to tie into the municipal water supply, which is available to the occupant prior to opening, the fire department will work with the applicant to eliminate the financial burden of installing the internal on site water supply system while maintaining a proper level of life safety for the occupants of the building. The ability of the fire department to work with the applicant in this instance would require a firm written commitment, which emphasizes the shortest period of time for municipal water to the site. Technical Review Committee Follow -Up Report to April 10, 2003 3) Police Department The Police Department is satisfied with the safety improvements made to the plan for this site. All of the safety issues outlined in a previous memo from Chief Stanley and Chief Dolan have been addressed and improved to our satisfaction. The Playground has been moved and barriers will be erected. The traffic pattern has been improved. While we would like to review the traffic impact study, the Police Department has no other issues with this project at this time. 4) DPW The Division of Public Works has reviewed the above referenced plan and has the following comments: A. The Applicant is strongly encouraged to connect to town water and sewer systems. It is recommended that the Applicant contact the Developer of"The Meadows" to coordinate and agree on proposed water and sewer connections. B. On site drainage fitcilities should be reviewed by VHB. C. The proposed backflow preventor must be reviewed and approved by Dennis Bedrosian - Superintendent at the Water Treatment Plant, 420 Great Pond Road, 978-688-9574. 5) Conservation Conservation reviewed the site several months -ago and determined no wetland resource areas existed on site, however off-site wetlands may exist. An existing drainage pipe outlets to the rear of the property and flows through a small ditch, through a culvert under Sharpner's Pond Road and into a wetland resource area. My review letter requested the applicant to investigate whether wetland resource areas exist within 100 feet of the property boundaries or within 100 feet of proposed activities. At the TRC meeting, the applicant stated that Michael Howard from Epsilon Associates has reviewed the site and prepared a letter stating no wetland resource areas within 100 feet of the site. Letter should be submitted to the Conservation Department for review and confirmation prior to filing for site plan approval with the Planning Department. 6) Planning The Planner supports ZBA approval subject to the conditions outlined by the Fire Chief. Subsequent Site Plan Approval by the Planning Board is required, but the applicant is advised to first obtain a determination from the Conservation Department regarding off-site wetlands. It would also be helpful, if the final decision regarding water and sewer connections are not available, to have the Board of Health decision regarding septic capacity prior to site plan review. In addition to the plans submitted, for site plan review the applicant must submit a complete drainage plan, traffic study and fiscal and community impact statements as outlined in Section 8.3 of the North Andover Zoning By -Law. 7) Health The Health Department did not have a representative at the TRC meeting„ however, if the applicant is not able to connect to town water and sewer systems, the applicant will need to file with the Board of Health. The Applicant is encouraged to meet with the Health Department to obtain any additional comments or to learn about any other applicable health requirements. Andover Wetland -Protection ByLaw (c.178 of the Code of North Andover) existed within close proximity to anticipated future work. It is understood that this correspondence will.be made part of future permit applications with the North Andover Zoning Board of Appeals and Planning Board. We offer the following comments. Bordering and Isolated Vegetated Wetlands We did not observe a jurisdictional bordering vegetatedwetland (BVW) or isolated vegetated wetland (IVW) within 100 -feet of anticipated future work. An off-site meadow characterized by upland grasses and fill material (interspersed with purple loosestrife and a cattail "pocket") was documented but'it does not appear that this: disturbed area meets the definition of a jurisdictional wetland... As we did not have permission from the adjacent property owner to access their property and, definitively determine the jurisdictional nature of this. area, we would recommend that the North .Andover Conservation Agent, Ms. Julie Parrino, confirm same prior to obtaining a building permit. We would also add .that there were no records on file with. the Conservation Commission regarding approvals for past and ongoing work undertaken on the subject property. It is our understanding that theseactivities were authorized by .the prior Conservation Agent without the need fora permit (we have a phone call into her office. to confirm this. assumption).
