On behalf of A.F. Pacillo General Contracting, Inc., West Environmental, Inc. inspected
the above referenced property to determine if there are Local or State jurisdictional
wetlands present. The area in question is a corner lot adjacent the intersection of Route
114 and Sharpeners Pond Road. Excavation work has begun at the site. There is a small
drainage ditch that receives stormwater runoff from Route 114 however this area does not
meet the criteria outlined in the Massachusetts Wetland Protection Act or the or the North
Andover Wetlands Protection Bylaw (10-20-98). Specifically the ditch does not have a
dominance of hydrophytic vegetation or hydric soils. This area also does not meet the
definition for stream outlined in Section II — Definitions in the North Andover Wetlands
Protection Regulations (11-10-98) because it does not exit or enter a wetland.

activity affecting the Buffer Zone and/or wetland resource
areas on this property.
❑ Wetland alterations resulting from said activity shall be
corrected and the site returned to its original condition.
❑ Complete the attached Notice of Intent. The completed
application and plans: for all proposed work as required by
the Act and regulations shall be filed with the Issuing
Authority on or before (date).
No further work shall be performed until a public hearing
has been held and an Order of'Cbnd'Rions has been issued
to regulate said work.

The property owner shall take the following action to

prevent further violations of the Act:

Failure to comply with this Order may constitute grounds .
for additional legal action. Massachusetts General Laws
Chapter 131, Section 40 provides: "Whoever violates any
provisions of this section shall be punished by a fine of not
more than twenty -Five thousand dollars or by imprisonment
for not more than two years or both. Each day or portion
thereof of continuing violation shall constitute a separate
offense."
An Enforcement Order issued by a conservation commission
cannot be appealed to the Department of Environmental Sign
Protection, but may be filed in Superior Court.
