The Board of Appeals held a regular meeting on Tuesday evening, October 14, 1997 upon the
application of Robert& Sara Schwartz, requesting a Variance from Section 7, paragraph 7.3
for relief of a side setback in Table 2. Said premises is land and building located on the West
side of 234 Brentwood Circle, which is in the R-1 Zoning District.

The hearing was advertised in the Lawrence Tribune on 9/30/97 and 10/6/97, and all abutters
were notified by regular mail.
Upon a motion made by Raymond Vivenzio and seconded by Walter Soule, the Board of
Appeals unanimously voted to GRANT relief of a side setback of 5.4 feet for the new addition
to the house, and the existing garage side setback relief to be 4.2 feet from garage overhang
to the South side lot line on the condition that a new and corrected plan be submitted by Mr.
Schwartz with respect to the existing garage. Voting in favor. William J.Sullivan, Walter F.
Soule, Raymond Vivenzio, John Pallone, Ellen McIntyre.
The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw
and that the granting of these variances will not adversely affect the neighborhood or derogate
from the intent and purpose of the Zoning Bylaw.
Note: The granting of the Variance and/or Special Permit as requested by the applicant
does not necessarily ensure the granting of a Building permit as the applicant must abide
by all applicable local, state and federal and building codes and regulations, prior to the
issuance of a building permit as requested by the Building Commission.

To the Board of Appeals:
Bob and Sara Schwartz have asked us to provide this letter on their behalf. We are their
next-door neighbors on Brentwood Circle. Bob has shown us the plans for their planned addition.
This addition would face our house on the south side of their home. Bob has explained that the
new structure would come within 24 feet of the property line facing our house, and that North
Andover's rules require a variance for anything closer than 30 feet to the property line.
We do not have any objections to this planned addition. In fact, we believe that it would
benefit the neighborhood. It will make their home larger, resulting in a higher value of their
property. It will also make the south side of their house more attractive. For these reasons, we
support the Schwartz's application for a variance from North Andover's 30-foot setback rule.

STATEMENT OF PRINCIPAL REASONS FOR VARIANCE APPLICATION
We need to expand our home. Our family is growing,and we feel a strong need for more space in our
home. With 1,800 square feet of finished interior space,our house is among the smaller homes in our
neighborhood. We have a formal living room but no family room. Our home would benefit immensely from a
new family room and an enlarged and updated master bedroom above it.We love our neighborhood,so we do not
want to move.
Only the south side makes sense for an addition. The house is situated on a long and narrow lot. (See
Exhibit A.) A swimming pool and mature landscaping in the back yard make development there problematic.
Topography and aesthetics prevent an addition in front. Adding to the side is the only reasonable approach. The
north side of the house is 38 feet from the property line,which would require a variance for any structure wider
than 8 feet;in any event,our existing living room is on the north side,which makes this an awkward place to add a
family room. There is more room to build on the south side. The kitchen is also on the south side. The family
room is a natural addition next to the kitchen,and our plans call for the creation of a"great room"with no
separation between kitchen and family room.
The addition requires a vestibule on the extreme southern end. The most commonly used entrance to
the home is currently a door to the kitchen,and we would continue to enter the home mostly from this side,not the
front door,after the addition is complete. The planned vestibule and porch structure will permit us to enter on that
side and remove coats and dirty boots before walking into the living area. Sited on the southern end,the vestibule
offers the least disruptive access to the kitchen from the outside,it interferes least with the beauty of the front
elevation(See Exhibit B,which shows the front elevation and the greenhouse that will be replaced with the
addition),and it creates the possibility of an attractive roof deck accessible from the master bedroom.
The width of the new room and the vestibule cannot be reduced without hardship. The proposed
structure would rest approximately 24 feet from the side property line,which is why this variance is sought.
Purchasing property from our southern neighbor is not a workable option. Thus,in order to build the proposed
addition more than 30 feet from the side property line,we would have to cut approximately six feet from the width
of the structure. This would either eliminate the 6-foot-wide vestibule/porch or reduce the width of the family
room,planned at 16 feet,to about 10 feet. A room this narrow would be useless as a family room. The 30-foot
rule poses a hardship in this case because reducing the width of the new structure to fit within the 30-foot setback
would either eliminate a necessary vestibule or make the family room so narrow as to be useless.
The proposed addition would have no adverse effect on our neighbors. The distance between our home
and the house of our southern neighbors(William and Rosalie Dehart)is quite large,and the difference between a
24-foot distance to the property line and a 30-foot distance is immaterial. Exhibit C shows the great distance
between our house and the Deharts'home. Exhibit D shows the very distant view of our house from the Deharts'
back porch. The Deharts support our application for a variance.
The proposed addition would benefit the entire neighborhood. The appraisal received from Andover
Bank estimates that the addition will add more than$100,000 to the value of our house. Because our home is
among the smaller houses in the neighborhood and the addition has been professionally designed,this will
positively impact the value of all houses in our neighborhood.

When the plot plan was prepared for this variance
application, it cane to our attention that the existing
garage structure, which is not connected to the main hcuse,
does not meet the 30-foot sideline setback requirement. The
setbeack is approximately 28 feet. This has apparently been
the case since the garage was built in 1978, althQ� igh no
discrepancies have appeared in the mortgage plans or title
insurance policies when we bought the property in 1992 and
re:inanced in 1993, In order to clarify the record and the
title regarding this structure, we respectfully request a
formal variance from the 30-foot setback requirement with
respect to the existing garage structure.
