At issue at that time were both side and front set back violations (Section 4.122, 14Bd and Section 8 Part 6fii) which I verified my understanding of with you. This Tuesday I talked with Mr. Cesati, 16 Meadow Lane, to see if he would move his camper in order to comply with the zoning bylaws. I was met with caustic resistance, but he subsequently revisited his initial response and moved his camper. The camper's current position now satisfies the front set back requirement, but does not comply with the side set back requirement. Specifically, as stated in 4.122, 14Bd, that no parking shall be permitted within 10 feet of any lot line. Considering the burden of noise coming from rain on a camper's roof and the potential for liquid leaks such as antifreeze, it is requested that this bylaw be enforced. Because this licensed vehicle will be parked there for a considerable length of time, your help in bringing this issue into compliance would be greatly appreciated. It is important to note that there is sufficient side area to satisfy the 10 foot side set back requirement. Special Permits. The Planning Board as SPGR, may grant a Special Permit modifying certain parking/loading standards of this Section and/or Section 8.4 (Screening and Landscaping =Requirements for Off - Street Parking), but only in the specific circumstances listed under "a" through "h" below. The SPGA may grant such special permit only when: (a) consistent with the purposes set forth in Section 8.1; (b) making the findings and determinations set forth in Section 10.3; (c) making a finding that the requested relief falls within one or more of the categories for the specific relief requested (any of cases "a" through "h" below); and, (d) upon a determination that the relief does not cause detriment to the surrounding neighborhood based upon any of the following applicable criteria: (i) Increase in traffic volumes; (ii) Increased traffic congestion or queuing of vehicles; (iii) Change in the types) of traffic; (iv) Change in traffic patterns and access to the site, (v) Reduction in on -street parking; and/or, (vi) Unsafe conflict of motor vehicle and pedestrian traffic. If a proposed development or project seeking a Special Permit pursuant to this Section 8.1.8 also requires the granting of a Site Plan Approval Special Permit pursuant with Section 8.3 (Site Plan Review), the conditions and requirements under this Section 8.1 shall be incorporated into and combined as a single application, review, and approval process for a Site Plan Review Special Permit issued in accordance with Section 8.3. The surface of the area where parking spaces may be reduced under a Special Permit for this section shall be suitable landscaped but shall not be used for purposes of satisfying the Usable Open Space requirements under the Zoning Bylaw. Circumstances under which the SPGA may grant a Special Permit pursuant to this Section 8.1.8 are as follows: a) Modification of Parking Requirements for Non -Conforming Structures, Lots and Uses. Where the total number of new parking spaces required by this Bylaw is five (5) or fewer for lots or sites that are determined by the Inspector of Buildings to be nonconforming with respect to parking, as specified in Section 8.1. b) Modification of Parking/Loading Area Design Standards. Where the design of a parking lot, loading area or aisle width differs from the provisions of Sections 8.1.5 or other parking provisions in this Zoning Bylaw, provided such design is prepared by a certified professional engineer or architect in the case of a parking garage or other structure, or by a certified professional engineer, architect or landscape architect in the case of a 90 at the pool location. Conversions - The conversion of an existing one -family to a two-family dwelling, by special permit from the Zoning Board of Appeals in accordance with Sections 10.3 and 4.122.14.D of this Bylaw, provided that conversion from a one -family to a two-family dwelling meets the following additional requirements: a. If a conversion involves increasing the size of an existing structure, the expansion area shall not exceed 50% of the original building's gross floor area up to a maximum of 1500 s.£ The size of the second dwelling unit can never exceed 1500 s.f. b. If a conversion involves razing an existing structure, the gross floor area of the new residential structure shall not exceed 150% of the gross floor area of the original building, nor shall the new structure be more than 1,000 square feet of gross floor area larger than the original structure, whichever is Iess. The size of the second dwelling unit may never exceed 1,500 square feet. If an existing lot is subdivided to form two or more new lots, and the existing structure lies within more than one of the new lots, and if the existing structure is to be razed in connection with the conversion, then new buildings on any lot formerly covered by the existing structure must comply with all the provisions of 4.122.14.B of the Bylaw. Newly created lots not formerly covered by the existing structure must meet the requirements of 4.122.14.D of the Bylaw. c. There must be two parking spaces for each dwelling unit. d. No parking/driveway shallbe permitted within 10 feet of any lot line. e. No'garage or carport shall face the street unless it is located at least 10 feet behind the front facade of the principal structure and in accordance with the dimensional setbacks outlined in Table 2 of this Bylaw. f. The home owner is adding an in-law apartment to her existing home and has apparently run into a water problem. Since the foundation has been put in, there is consistent intermittent pumping of water both day and night into the street and onto my property. This water flows down the street and across my front lawn and drive -way. This is a public safety issue because there are a number of students and residents that walk on the street and when this turns to ice it will definitely develop into an ice slick. This is of great concern to us because winter ice will cause a problem for our vehicles using our drive way. We are concerned about sliding out into children and persons walking or into motor vehicle traffic on the street. Moreover, school buses drive up and down Meadow Lane. In addition, a portion of our yard which is used for winter parking is currently becoming a mud pit. We are also worried about any visitors, mail carriers and newspaper persons who will attempt to enter our residence. My husband has two replaced hips and we really do not need to have an avoidable accident happen this winter. We have taken photos that show the swift movement of this water and the width that it extends on to the street. Should you need copies I will be happy to supply them to you. Yesterday, October 27, 2008, 1 tried in good faith to talk with Samuel Caliento (home resident with estate interest) about the situation; however I was met with irate resistance. He told me to take this issue up with the town if I had a problem. I then spoke to the town Building Inspector, Jerry Brown, and Tim Willett in the Department of Public works to alert them of the problem. Tim Willett said he went out there to inspect the site and address our concerns and he did agree that there is a public safety issue. North Andover, MA 01845 Dear Elaine: As requested, Peterson Associates has performed an inspection and evaluation of the shingle roofs and related construction at 24 Meadow Lane in North Andover, Massachusetts and prepared this report. The purpose of this report is to provide you with an understanding of the existing roof conditions, present discussion regarding the significance of the conditions noted and provide recommendations for repairs. The house at 24 Meadow Lane is of wood frame construction with cedar clapboard siding and asphalt shingle roofs. The house can generally be described as a cape with a "gambrel" style roof. The main gambrel roof has a pair of gable dormers along the front of the house and a full shed dormer in the rear. Along one side of the house is a smaller garage / kitchen roof area with a low gable style roof. The "pool house" is of similar construction as the main house with a gambrel style roof. David Castricone Roofing, Siding & Remodeling was recently hired by the home Owners to remove and replace the roofing, flashing and related work on both the house and the "pool house" or shed. As requested by the home Owners, the roofer used organic shingles as manufactured by IKO. Following the application of the new roofing and related materials, there has been some concern by the home Owners about the quality of work done. This report addresses the home Owners concerns as well as various other roof related items noted during our evaluation. An inspection of the shingle roof areas revealed various defects and deficiencies. Observations and comments made during our site visit are as follows: 1. Following the roof installation, water leakage reportedly occuiTed around the chimney and damaged the ceiling in the room below. The roofer then proceeded to patch the chimney flashing with roof cement. This type of repair is considered a temporary repair and is not suitable for the long term. In addition, the paperwork provided by the roofer before the start of work states that they will "counterflash chimney". This implies new sheet metal flashing will be installed. It is recommended that all flashing and roofing coated with roof cement be removed from the area and that ice & water shield membrane be installed on the roof deck and turned up the sides of the chimney. New sheet metal step flashing / counterflashing should then be installed around the chimney along with shingles properly woven into the flashings. When properly done, the flashings will completely cover the ice & water shield applied at the base of the chimney. If any wind blown rain is able to get past the step flashing / counterflashing, the ice & water shield will prevent it from causing interior leakage. 2 t 6 " - (bi (z,a_- t 1 h z1 1 0 1 7 ) 4 7 3 5 0 ,Evaluation of Shingle Roof 24 Meadow Lane North Andover, MA June 21, 2005 Page - 2 Shingle course application and alignment is uneven in various areas of the roof. The worst areas are between the two dormers on the front of the "pool house" and along the back -right roof edge of the "pool house". In these areas, the alignment problems are obvious due to the position of the shingles with respect to the dormers and the roof edge (rake edge). At the roof edge on the back -right of the "pool house", the shingles were cut unevenly, leaving only about 1" on some of the shingle tabs. These tabs are likely to be lifted and blow -off during heavy winds. The manufacturer's application instructions state "The width of any rake tab should be at least 1/4 tab". The manufacturer's application instructions also state "Sufficient chalk lines should be struck to ensure accurate vertical and horizontal alignment of shingles. Vertical chalk lines every 4 to S shingle lengths are recommended for alignment of cutouts." These manufacturers requirements were apparently not followed based on the alignment errors noted. Removal and replacement of the shingles in these areas is recommended and should be done to comply with the manufacturer's instructions. There is some physical damage to shingles on the roof, particularly at transitions where the shingles are bent for the slope changes. In one location on the "pool house" roof, a shingle is split, apparently due to a hammer being driven through it. It is recommended that this damaged shingle be removed and replaced in compliance with the manufacturer's instructions. 4. The shingles on the majority of the roof appear to be secured with nails applied using pneumatic nail guns. Some of the fasteners are not set properly and are lifting the shingle tab above them. This prevents the shingles from sealing down properly and may contribute to holes in the lifted shingle tabs. It is recommended that the shingle tabs be carefully lifted in these locations in order to properly set the nails. There also are nails that were not properly placed in the shingles as per the manufacturer's instructions. Nails placed too high (above the seal strip) do not properly attached the shingles and subject them to blow -off during periods of heavy wind. The manufacturer's application instructions state "DO NOT NAIL INTO OR ABOVE THE SEALING STRIP", which is exactly how most of the shingles appear. to be nailed. This is not a problem that can be easily repaired as it would involve nailing the majority of the shingles again. It is recommended that the home Owners discuss this with the roofer and come to a mutual agreement about how to handle this. The IKO warranty provided with the roof states that "Failure to follow [manufacturer's application] instructions can void the limited warranty". Therefore, it is recommended that all manufacturer's application instructions be followed. 6. Most three tab shingles are nailed with four nails per shingle. However on steep slope roof areas, the roof manufacturer requires additional nailing (6 nails per shingle). This is commonly known as "hurricane nailing" and is required on roofs with steep slopes such as the bottom portion of all gambrel roofs. During our inspection, it was noted that these shingles were not "hurricane nailed". This can contribute to shingle blow -off and/or shingles tearing and sliding down the roof. It is recommended that all shingle tabs on the Evaluation of Shingle Roof 2'4 Meadow Lane North Andover, MA June 21, 2005 Page - 3 bottom portion of the gambrel roofs be lifted and additional nails be installed as per the manufacturer's instructions. 7. IKO also requires that the shingle tabs be cemented down (with roof cement) on all steep slope roof areas. This does not appear to have been done and further subjects the shingles to blow -off during periods of heavy wind. It is recommended that all shingle tabs on the bottom portion of the gambrel roofs be lifted and roof cement be applied as per the manufacturer's instructions. 8. There are two plumbing vent pipes that penetrate the roof. These pipes were flashed with a premanufactured type flashing. The flashing consists of a rubber boot with an aluminum flange. During our roof inspection, we observed that this flashing was improperly installed. Shingle roofs and the related flashings are not "waterproof' but rather "water shedding". This requires the shingles and flashings to be properly lapped to be effective. The bottom edges of flashings should be out over the shingles to provide water shedding ability. The vent pipe flashings on this roof were run under the shingles at the bottom edge and direct water into the roof system. It is recommended that the pipe flashings and surrounding shingles be removed and replaced so that the bottom edge of the pipe flashings is out over the shingles. As documented within this report, the roof has not been installed in compliance with the requirements of the shingle manufacturer, and in our opinion will be subject to leakage, and/or wind damage. Several areas were not constructed as required to resist weather penetration. Various repairs have been discussed in this report and represent feasible solutions to the current problems.
