SCOTT Director Town of North Andover r 40RTH , OFFICE OF F COMMUNITY DEVELOPMENT AND SERVICES _ 30 School Street ` s North Andover, Massachusetts 01845 February 17, 1998 24 Peterson Road North Andover, MA 01845 To whom it may concern, The Board of Health has received a complaint regarding the dumping of dog excrement into a wetland bordering your property at 24 Peterson. This complaint was forwarded to the N. Andover Conservation Department and an inspection was conducted. The Health Department was informed that animal feces had been deposited in the wetland. In addition, it was noted that the rear yard had significant amounts of similar material. The Meadowood area is a densely settled community. Due to the close proximity of the homes it is important that residents pay close attention to public safety issues. In consideration of these facts the Board of Health deems this a condition which may be injurious to the public health. This designation constitutes a nuisance under the Massachusetts General Laws 1116 122 regulations relative to nuisances. This letter is an official Board of Health Order. All fecal matter must be removed from the property and surrounding area by February 27, 1998. The property should be maintained on a regular basis as to not cause a health nuisance and proper sanitary disposal methods must be adhered to in the future. If you disagree with all or any part of this order you may request a hearing by filing a written request with the Board of Health within seven (7) days of receipt of this letter. Thank you for your anticipated cooperation in this matter. Sincerely,, u Susan Ford Health Inspector cc: Conservation Dept. To Whom It May Concern: This department received a complaint that dog excrements were being deposited into the wetlands at the above referenced property. As stated previously in a letter drafted by Evergreen Management Corp., disposal of waste of any kind in the wetland is not an acceptable procedure. This type of practice may impact the wetland itself and its eight interests of the Wetlands Protection Act. The interests are as follows: Private and Public Water Supply, Groundwater Protection, Pollution Control, Flood Control, Storm Damage Control, Fisheries, and Wildlife Habitat. Most importantly, in this case, the excrements may cause degradation of the groundwater. Please remove the subject excrements and dispose of properly by no later than Friday, February 27, 1998. Also, please be aware that deposits of this nature are unacceptable, and should not continue. If you have any comments, questions, or concerns, feel free to contact me at (978)688- 9530.
