Dear Attorney Kelley,
Please be advised that the Inspector of Buildings, Gerald Brown, forwarded your letter to my
office as the Health Director is the appropriate supervisor in issues concerning the State Sanitary
Code. Enforcement of MGL 105 CMR 410 lies under the purview of the local Health .
Departments. I have reviewed your letter dated August 15, 2012 as well as the file in this case
and respond as follows to your communication.
Letter from Attorney Kelley - Paragraph 1:
1) In the Town of North Andover the Building Department requires complaints to be
submitted in writing to their office, therefore note that the statement in your first
paragraph is incorrect, your client, Ms. Haskell at no time has contacted the Building
Department with complaints. If you still choose to do so you can contact Mr. Brown at
978 688-9545.
2) Ms. Haskell did contact the Health Department on July 31, 2012, but unfortunately she
did not contact this department in March. Her statements in an email to AIMCO were that
she contacted the office at Royal Crest in March, "Royal Crest overlooked the mold I
reported in March". (Please see email from Ms. Haskell; last paragraph) If she had
contacted the department prior to beginning the remediation, and submitted a formal
complaint an inspection would have been scheduled and if warranted, an Order Letter
would have been completed and issued.
Paragraph 2
3) The record indicates that the investigation began immediately upon the tenant's first
contact. The tenant indicated that repair work of sanitary concerns were underway; hence
the initial violations were in the process of being corrected and no longer visible. Without
the ability to view potential violations; inspection was not an appropriate action. The
investigation concluded that an inspection during the active corrective action was not
prudent.

We offered to assist and to advise your client. This offer was accepted verbally, which
prompted the action by the inspector to make a call to Royal Crest to validate the
statements of Ms. Haskell. Ms. Grant was informed that Smith and Wessel and Northeast
Remediation were in charge of the repairs. These reputable contractors have been
previously been involved with similar cases and they work has been acceptable. In water
infiltration cases however; note that reoccurrence is not uncommon and additional
remediation can often be needed if conditions return.
As a courtesy, the Health Office continued to stay in touch with both parties. On August 16,
2012; Royal Crest informed the Health Department that Ms. Haskell has been notified that the
apartment is once again habitable. A record from the contractors of work preformed was
submitted as back up information. Be advised that the process of accepting documentation in
regards to water infiltration repair is the usual procedure in any case that is being monitored by
the Health Department and or under the court system. Please note that local Health Departments
do not test or monitor for mold. Mold in itself is a symptom of a water infiltration problem; it is
not a violation. The Human Habitation code only addresses water infiltration.
While there is a great concern about ill persons; such as those with allergies to mold etc. this is
not our specialty. Local Health Departments cannot determine or diagnose any person's
condition or if it relates to the environment. In all cases we refer persons with complaints to their
physicians. Relationships between the environment and health issues are not drawn by local
Health either. We do not have air quality specialists or physicians on staff at the local level. The
main purpose is to assist renters in code issues that relate to the habitation. The file shows there
was diligence and purpose in assisting Ms. Haskell to get back into her home.
In closing, after reviewing the file, I support the actions of the Health Department staff. There
was no evidence of "conduct" which "has corrupted this situation and exposed" your client to
any health risk. The Health Office has documented the investigation in our usual manner. The
desire is certainly to maintain good relations with any resident or business in N. Andover and
though it may seem unfortunate, we are not always able to bring the desired results to all parties.

Good Afternoon Erin,
After speaking with Pauline on Thursday she kindly informed me you are the one who I will need to speak with
regarding my apartment. Pauline then informed me that you would not be back in to the office until Tuesday.
I feel as a tenant of Royal Crest, one whom has been abruptly relocated for nearly two weeks with my three year
old son, it is extremely important to have an open line of communication. Royal Crest has not done so; other
than two calls from Pauline. She was unable to provide any information from maintenance about why it is
taking so long or how serious this issue is inside of the apartment. All she could speak of was how we would
have to continue our stay at the hotel for a longer period of time. Due to this lack of communication I am
writing to you now and I have several issues that I need to address:
1. Upon finding out we have to stay at the hotel longer we were conveniently served with a 14 Day Notice to
Quit Letter. The only reason I did not pay August's rent was because we are not even living in that apartment.
I cannot even begin to tell you how much of a spectacle that was, here at the front desk of the hotel. As I was
up in our room, the front desk read it to me over the phone and everyone was made aware of a private situation
that never had to escalate to this: had your attorney been in communication with mine. I have never been so
humiliated! I have no choice but to see these people everyday due to Royal Crest relocating us and it is
completely embarrassing. I have never had a problem paying rent: what I do have a problem with is paying rent
in a place that is not providing a healthy environment to live.
2. I am not sure if Pauline has made you aware that I have gotten copies of my son's Medical Records: which
has brought to surface some pretty alarming results specifically relating to mold. Despite the fact that I reported
mold the last week of March in my Master Closet I was informed that it was not in the closet; however it was in
the bathroom and that it would be taken care of there. Under the terms that all the mold would be removed from
my apartment I agreed to sign a six month lease the first week of April.
On April 11th my son had a serious Upper Respiratory Infection, two weeks after the mold was suppose to have
been removed.
Brayden also was seen for Upper Respiratory Infections on December 7, 2011 and on October 12, 2011
I will have my medical records by the end of the week which after speaking with my doctor she has informed
me that they are consistent with that of my son's.
Due to the health hazardous environment mold has been known to produce along with the documented facts I
have from our records, I feel Royal Crest should want to do everything in their power to assure us that our home
has no mold in it. That is why I ask that before we even enter that apartment and are subject to more illnesses,
an inspector shows me that in fact all mold has been removed.
Being that Royal Crest overlooked the mold I reported in March pertaining to the master closet and now
ironically enough that is exactly where it is, Royal Crest should be more than willing to provide me this
assurance. Also has the mold in the bathroom been removed which was suppose to have been done in April? It
is growing all inside the bath tub, all over the shower head, and in the crevices of the walls (which I have
photographed).
We need to be able to communicate and get this matter resolved. It is affecting every facet of our lives. I start
back to school in two weeks and we cannot be living in a hotel room. Please let me know the status of our
apartment and a realistic time Royal Crest plans on having us back in to our home.

Hello all!
Please see Mark's response below on what has happened up to this point in 24-002 Ashley Haskell's apartment. When I
spoke with her today she said that she is very upset because she said to the previous Community Manager, Dan Mullane,
that she would only renew her lease if the mold was taken are of. She stated that there was mold in the closet all along
and she has called her lawyer and will be calling the Health Department. As you can see by Mark's response below this is
a new case and we will work to remediate.
Donna, the resident would like for us to call her attorney. I let her know that our attorney will be contacting her lawyer,
Lawrence Kelly, today. His phone numbers are 978-740-1070 and 617-416-7021.
Michelle, you had asked for me to outline what has been done in her apartment already and what we plan to do with the

I looked back into our computer system and am not finding any other mold issues in this building.
In mid march this resident was contacted about renewing her lease, when contacted she said she had "mold issues" in
her unit and she wanted them resolved before she would sign her lease. On 3-21 Ed Dubiel (industrial hygienist Smith
and Wessel) Trevor Howard (site supervisor for LVI environmental), Tom Kinnel (rebuild vendor East Coast General
contracting) and myself inspected unit. The resident complained of mold in master bedroom closet and hall bath. We
found mold on 1 pair of shoes but all other shoes, belongings, building materials had no visible sign of mold. All walls,
ceilings, and floors were tested for moisture and all moisture readings were normal. We recognized that this could have
been caused by the shoes being put away wet.
Upon further inspection of the unit we found a small amount of mold behind the hall bath vanity. We followed Smith and
Wessels recommendation to remove wall behind vanity and vanity. This work was done by LVI environmental all building
materials with mold were removed and all adjacent areas where treated with an antimicrobial chemical (Shockwave)
made specifically for mold. East Coast general contracting installed new sheetrock and vanity. Resident was very happy
with the completed work and renewed her lease
On 7-30 the resident contacted the office and said she is still having a mold problem (this is the 1St time she reported an
issue since the above work was completed in her bathroom (back in March). She said she is still having a mold problem I
contacted (within 2 hours of the original call) Ed Dubiel (industrial Hygienist) and Trevor Howard (LVI environmental) to
inspect unit. We went to unit (resident was not home) and inspected the entire apartment. We found a small amount of
mold (about 1 sq ft) in the master bedroom closet ceiling (this would indicate there is a small/slow leak coming from
above). We tested all walls, floors, and ceilings in apartment and found a slightly elevated moisture level where the mold
is present. No other moisture readings where found to be above average. I went upstairs to inspect all plumbing fixtures
in the above bathroom for leaks, there were no visible leaks I left a note for the resident that we would contact her on the
31St to schedule the repairs in her unit. This morning I had Pauline Martin contact resident to put into a hotel until this sat.
so that we can fix this issue. Our plan for repairs is
1. Wed. the 1St LVI environmental to remove entire closet ceiling and part of wall to remove mold affected sheetrock
2. Thursday the 2cnd my service team will inspect open ceiling while running fixtures from bathroom above to
determine cause of moisture penetration
3. as long as leak has been identified and ceiling cavity is completely dry East coast general contracting will be
going in on the 3rd and 6th to put ceiling back
We will receive our recommendations from our industrial hygienist (Ed from Smith and Wessel) tonight and we will follow
all recommendations during remediation.
I am currently looking for mold reports relating to this unit and will send them over once I obtain them

Dear Mr. Brown,
I am writing with respect to my client, Ashley Haskell. On two (2)
occasions in March 2012 and in August 2012, Ms. Haskell contacted your
office regarding building code and housing code violations; to wit, evidence
of mold within the premises of her apartment. On each occasion, Ms.
Haskell spoke with Michelle Grant, the inspector assigned to her
complaint(s) and requested Ms. Grant to inspect her apartment.
In response to Ms. Haskell's requests in March 2012 and, again, in
August 2012, Ms. Grant refused to inspect the premises and offered no
reason why she was failing to investigate; particularly troubling since the
March 2012 purported removal of mold at Ms. Haskell's apartment was
represented to have cured the problem as well as the various code and
statutory violations.
In fact, I called Ms. Grant and asked her to investigate and, in
response, Ms. Grant refused to do so. In addition, Ms. Grant refused to
provide either me or my client with a written letter explaining why it was
she was unwilling to investigate these incidents and verify the condition(s)
of my client's apartment.

As you know, such conduct by a building inspector is completely
unacceptable and has corrupted this situation and exposed my client and her
three (3) year old son unnecessarily to mold within their apartment; for
which both have experienced medical conditions as well as property loss.
At this time, the landlord is representing that the apartment has been
worked on with no assurance to my client or my office that the mold issue
has been removed entirely or resolved.
Once again, I am requesting your office to investigate this matter fully
to insure that the landlord is compliant with building code regulations,
sanitary code regulations in the like.
Unfortunate that I should be required to pen a letter to obtain action
that should have taken place in March 2012; some six (6) months ago.
Thanking you for your prompt and expeditious attention to this
matter.

Hi Ashley!
I just wanted to recap our call this morning through email so we are all on the same page.
The remediation step of the process is complete and we will be installing the new closet ceiling today and new closet
carpet tomorrow morning. As discussed, you can be home for the process today and tomorrow but for the comfort of your
family I have reserved your hotel room for an additional night with an extended check out tomorrow of 2:OOpm. It is my
understanding that you will stay in the hotel and check out tomorrow.
In addition, you said that you wanted reassurance that the mold would never coming back. In any environment, you
cannot guarantee the natural occurrence of mold reappearing. As discussed, per our contract, it is the resident's duty to
report sightings of mold and the landlord's duty to work towards remediation. In both situations where you had mold
present this past year we had our licensed contractor inspect and remediate. So the answer would be "no" we cannot
guarantee that you will not experience mold again. We do see fewer events with mold on 2nd and 3rd floor apartments
because they are not sub -level.
As you know, your current lease expires on 9/24/2012 and you do have a few housing options available to you. Your
options are:
• Transfer to a 2nd or 3rd floor apartment
• Renew your lease in your current apartment
• Give your 30 day notice to leave the community

Hello all!
Please see Mark's response below on what has happened up to this point in 24-002 Ashley Haskell's apartment. When I
spoke with her today she said that she is very upset because she said to the previous Community Manager, Dan Mullane,
that she would only renew her lease if the mold was taken are of. She stated that there was mold in the closet all along
and she has called her lawyer and will be calling the Health Department. As you can see by Mark's response below this is
a new case and we will work to remediate.
Donna, the resident would like for us to call her attorney. I let her know that our attorney will be contacting her lawyer,
Lawrence Kelly, today. His phone numbers are 978-740-1070 and 617-416-7021.
Michelle, you had asked for me to outline what has been done in her apartment already and what we plan to do with the
current findings. Please let me know if Mark's response below answers all of your questions.

I looked back into our computer system and am not finding any other mold issues in this building
In mid march this resident was contacted about renewing her lease, when contacted she said she had "mold issues" in
her unit and she wanted them resolved before she would sign her lease. On 3-21 Ed Dubiel (industrial hygienist Smith
and Wessel) Trevor Howard (site supervisor for LVI environmental), Tom Kinnel (rebuild vendor East Coast General
contracting) and myself inspected unit. The resident complained of mold in master bedroom closet and hall bath. We
found mold on 1 pair of shoes but all other shoes, belongings, building materials had no visible sign of mold. All walls,
ceilings, and floors were tested for moisture and all moisture readings were normal. We recognized that this could have
been caused by the shoes being put away wet.
Upon further inspection of the unit we found a small amount of mold behind the hall bath vanity. We followed Smith and
Wessels recommendation to remove wall behind vanity and vanity. This work was done by LVI environmental all building
materials with mold were removed and all adjacent areas where treated with an antimicrobial chemical (Shockwave)
made specifically for mold. East Coast general contracting installed new sheetrock and vanity. Resident was very happy
with the completed work and renewed her lease
On 7-30 the resident contacted the office and said she is still having a mold problem (this is the 1St time she reported an
issue since the above work was completed in her bathroom (back in March). She said she is still having a mold problem I
contacted (within 2 hours of the original call) Ed Dubiel (industrial Hygienist) and Trevor Howard (LVI environmental) to
inspect unit. We went to unit (resident was not home) and inspected the entire apartment. We found a small amount of
mold (about 1 sq ft) in the master bedroom closet ceiling (this would indicate there is a small/slow leak coming from
above). We tested all walls, floors, and ceilings in apartment and found a slightly elevated moisture level where the mold
is present. No other moisture readings where found to be above average. I went upstairs to inspect all plumbing fixtures
in the above bathroom for leaks, there were no visible leaks I left a note for the resident that we would contact her on the
31St to schedule the repairs in her unit. This morning I had Pauline Martin contact resident to put into a hotel until this sat.
so that we can fix this issue. Our plan for repairs is
1. Wed. the 1St LVI environmental to remove entire closet ceiling and part of wall to remove mold affected sheetrock

3. as long as leak has been identified and ceiling cavity is completely dry East coast general contracting will be

I am currently looking for mold reports relating to this unit and will send them over once I obtain them

I just spoke to Ashley regarding Bldg 24 Apt: 2. Ashley had understood the Health Department's process. She is
aware that at this time the Health Department will not be doing an inspection. However, it is the Health Departments
recommendation that the apartment is thoroughly checked for mold, so as she does not have to repeat this process
again.
