I, Benjamin R. Mosher, MA Registration Number: 46394 Expiration date: 06/30/2018, am a registered design
professional, and I have prepared or directly supervised the preparation of all design plans, computations and
specifications concerning:
Architectural x Structural x Mechanical
Fire Protection x Electrical x Other: Describe Civil
for the above named project. 1, or my designee, have performed the necessary professional services and was present at the
construction site on a regular and periodic basis. To the best of my knowledge, information, and belief the work
proceeded in accordance with the requirements of 780 CMR and the design documents approved as part of the building
permit and that I or my designee:
1. Have reviewed, for conformance to this code and the design concept, shop drawings, samples and other submittals
by the contractor in accordance with the requirements of the construction documents.
2. Have performed the duties for registered design professionals in 780 CMR Chapter 17, as applicable.
3. Have been present at intervals appropriate to the stage of construction to become generally familiar with the
progress and quality of the work and to determine if the work was performed in a manner consistentwith the
construction documents and this code.
Nothing in this document relieves the contractor of its responsibility regarding the provisions of 780 CMR 107.

RE: Emergency Pipe Repair - GLSD - 240 Charles Street
Dear Mr. Weare,
On Monday February 12, 2007 you had contacted me discuss an emergency situation at
one of your main sanitary sewer pipes. You had indicated that GLSD had discovered at
least 14 wire breaks, with up to 23 potentially, within a section of piping along the road
shoulder of your main entrance drive on Charles Street, which would need immediate
repair. Repair work would require an excavator to dig under the pipe to place
reinforcing strands. You had indicated that although the pipe itself is at a depth of 8-10
feet down, excavation would need to be at a depth of 15-16' for the appropriate repairs
to take place.
In order to determine if the proposed repair work would.require a filing with the North
Andover Conservation Commission, a site inspection was conducted that same
afternoon. Upon this site inspection, the area of proposed pipe repair was staked and
was observed to be a length of approximately 20 - 25 feet. It was determined that
wetland resource areas were located just beyond the 100 foot buffer zone and 200 foot
buffer zone of the Merrimack River. Further, proposed work is an exempt
repair/ emergency activity pursuant to the Wetlands Protection Act (M.G.L. Chapter
131, section 40) and the North Andover Wetlands Protection Bylaw (Chapter 178 Code
of North Andover). Therefore, the work as described above is allowed without a filing
with the Conservation Commission.
Please be aware that future activities within 100 feet of a wetland resource area or 200
feet of the Merrimack River may be subject to a filing with the North Andover
Conservation Commission pursuant to the Massachusetts Wetlands Protection Act and
the North Andover Wetlands Protection Bylaw.
