Based on my observations, there was no evidence of any tree removal. However, you did state that this area was cut back about month ago in an effort to make this area more aesthetically clean. It appears that this area is a wetland resource area. As such, you are not allowed to maintain this area. You also inquired to remove the large dead tree that fallen onto your neighbor's property. The North Andover Conservation Department hereby authorizes the removal of the above -referenced tree. The tree stump shall remain in the oun as it is located within the limits of the wetland resource area There shall be no heavy machin= or vehicles in this area. Therefore the tree shall be removeda chainsaw and dragged to an upland area for proper disposal. Prior to the commencement of the tree work, please contact the undersigned so that we know when the work is taking place. Also discussed during our onsite meeting was the potential for removing the existing in -ground POOL concrete patio and cabana and subsequently returning the area to lawn. In addition, you have been experiencing ongoing erosion runoff contributing from the large volume of stormwater runoff from Massachusetts Avenue and Waverly Road. Consequently, the water runoff has led to significant erosion in your side yard, and continues to undermine the driveway. You indicated that you would like to divert the stormwater, regrade and landscape the slope, and reconstruct the stairs and walkway that were damaged due to the erosion. Based on the proximity of the wetland resource area along the rear of the property to the proximity of the work, you will be required to obtain the necessary permit from the North Andover Conservation Commission (NACC). ibis will also require you to hire a wetland scientist to flag the wetland boundary on your property and have it depicted on an engineered site plan, along with the proposed work. Additionally, it has not been determined whether of not the adjacent drainage area has the characteristics that would constitutes it as a stream channel or a drainage ditch. In addition, the NACC enforces a 25 -foot No Disturbance Zone and a 50 -foot No Build Zone from the edge of a wetland resource. Enclosed please find the Notice of Intent (NOI) application accompanied by the instructions, the 2006 Conservation Commission meeting schedule, and the list of consultants for your needs.
