This letter is to inform you of our compliance with the request of
the North Andover Planning Board concerning the security of our parking
lot after hours.
As of this date, the lot will be chained and locked by the last
employee to leave the building in the evening, and will not be
accessable until 8:00 am the following morning.
Enclosed please find the details of this plan as presented to the
manager of the "99 Restaurant", Mr. John Hauser. A copy of that
notice has also been given to the North Andover Police Department.

Every application for action by the Board shall be made on a form
approved by the Board. -These,forms shall be furnished by the clerk
upon request. Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until,
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters, owners
of land directly opposite on any public or private street or way,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list, notwithstanding that the land of any such owner is located
in another city or town, the Planning Board of the city or town, and
the Planning Board of every abutting city or town.
* Every application shall be submitted with an application charge cost
in the amount of $25.00. In addition, the petitioner shall be respon-

ADDENDUM
Applicant: Winifred A. Bulger
The principal points upon which I base my application are
as follows:
Mrs. Bulger is the record owner of the land and buildings at
247 Chickering Road known as Bulger Animal Hospital.
On March 20, 1978 her late husband, Dr. Edward C. Bulger and
she entered into an agreement of sale for the property with Doctors
Wayne A. Zeilenga and Dr. John K. Prentiss. This agreement of
sale called for a passing of title on March 20, 1984 at the
conclusion of the installment payments.
Since March 20, 1978, Dr. Zeilenga and Dr. Prentiss have
operated the Bulger Animal Hospital and she has lived in
the residential dwelling on the premises.
Recently, Dr. Zeilenga and Dr. Prentiss have received notice
from the North Andover Building Inspector of complaints about
excessive noise caused by the dogs in the open animal runs shown
on the enclosed plans near the northerly bound. The Building
Inspector has ordered Dr. Zeilenga and Dr. Prentiss to eliminate
the nuisance caused to some neighbors by the dogs' barking.
Accordingly, the doctors have retained an engineer and
consulted a builder about this problem. As the enclosed plans
indicate, my clients propose to remove the existing dog runs
and put an addition to the rear of the existing Animal Hospital
approximately 30 x 39 feet which would, in effect, provide an
enclosed dog run and eliminate the noise problem. We seek
relief by variance as the rear line dimension is only 14 feet
and the side line dimension is only 37 feet.
In addition to a variance for the proposed addition, we are
also seeking a variance of the sideline and rear line dimensional
requirements for the existing dwelling and the proposed parking
spaces shown near the southerly bound. We expect that when
the transfer of title takes place in March of 1984, the lending
bank will require a certified plot plan and this will indicate
violation of the sideline and rear yard dimensional requirements.
Although the dwelling was in existence long before the additional
"15 foot residential buffer" was recently added to the Zoning
By -Laws, we will now have to conform to present requirements.
In addition, the proposed parking spaces will eliminate a serious
traffic and parking problem in the area as it will provide more
on-site parking for the patients. No harm will be done
to the residential buffer zone as no homes are affected by these
variance requests.
We respectfully submit that all elements for the granting
of a variance are present with this application, especially hard-
ship. The noise problem can only be corrected by providing an
enclosed animal run and the suggested location is the most logical
place. Further, the proposed sale in 1984 may be jeopardized if
zoning violations are found in the preparation of a plot plan.
Mrs. Bulger's premises are especially unique and the conditions
which affect this parcel are unique.
Further, we suggest there will be no detriment to the
neighborhood and, in fact, the traffic and parking problems should
be improved by the suggested new entrance and exit and the new
proposed on-site parking.

and rear side of the lot.
2. On the Southerly side, there will be a natural evergreen
tree barrier that will grow tv a suitable height to provide
necessary screening.
3. The two.Southern most parking spaces will be eliminated.
4. A chain or gate barrier will be installed to secure the
parking area at ingress/egress.
5. A suitable barrier on the island between the ingress/egress
will be installed to provide unauthorized entrance to the
parking lot.
6. The parking lot will be used only for the business purposes
of the animal hospital and the residents-of the home and
their guests.
7. All conditions to be placed on the plan and the plans to be
revised accordingly - to be submitted to the Board of Appeals
no later than February 8, 1982. No plans will be endorsed
until such revisions are made.

Dear Mr. lone:
The Board of Appeals held a public hearing on Monday evening,
January 11, 1982 upon the application of Winifred A. Bulger.
The hearing was advertised in the North Andover Citizen on
December 24, 1981 and January 7, 1982 and all abutters were
notified by.reaular mail. The following members were present
and voting: Frank Serio, Jr., Chairman; Richard J. Trepanier,
Esq., Clerk; William J. Sullivan; Augustine W. Nickerson; and
Raymond A. Vivenzio, Esq.
• The petitioner seeks a. variance from the provisions of Section 7,
Paragraph 7.3 and Table 2 of the Zoning By Law to allow the
continued use of the existing buildings and to construct an
addition with additional parking, having less than the required
set backs.on the premises located at 247 Chickering Road. A
sinnle family home and an attached animal hospital are located
on the property.
The petitioner testified, through counsel,.that the Building
Inspector ordered the occupants of the animal 'hospital to
eliminate the noise caused by barking dogs from the open runs
located behind the hospital. The petitioner proposes to eliminate
said runs and replace them with an enclosed dog run to the rear
of the existing hospital. The petitioner also testified that
additional parking is needed on the South side of the premises
for both,clients and employees.

In addition, a side line and rear line variance is requested for
the existing single family dwelling, as it does not conform to
current zoning regulations.
Several neighbors were present at the hearing and voiced concern
that the laraer parking area might attract unauthorized traffic
and parkins from a neighboring restaurant.
Upon a motion made by Mr. Sullivan and seconded by Mr. Vivenzio,
the Board voted unanimously to grant the variances requested for
the existing dwelling and proposed addition with additional
parking with the following conditionss
1. A six-foot stockade fence to be installed on the Northerly
and rear side of the lot.

The Board finds that each of the provisions of Section 10.4 of the
Zoning By Law have been satisfied. In particular, the Board finds
that due to the location of the existing dwelling on the premises
for many years with a slight deviation from the existing require-
ments, together with the order from the Building Inspector that a
daily fine will be initiated if the noise is not eliminated, con-
stitutes a hardship within the definition of the Zoning By Law.
