Dear Mr. Long: 1970 Any appeal shall be filed within (20) days after the date of filing of this Notice in the Office of the Town Clerk. October 31, 1983 Bulger Animal Hospital 247 Chickering Road Petition No. 56-'83 The Board of Appeals held a public hearing on Monday evening, September 19, 1983 upon the application of Bulger Animal Hospital. The hearing was advertised in the North Andover Citizen on Sep- tember 1 and 8, 1983 and all abutters were notified by mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizel le, Esq., Vice Chairman; Richard J. Trepanier, Esq., Clerk; and Associate Members Walter F. Soule and -Maurice S. Foulds. The .-pet--iti one -r seeks a -variance- from the provi s i on -s :of -Section --6, Paragraph 6.6 (5d) of the Zoning By Law. so as to permit the erec- tion of a sign which will not meet the setback requirements on premises located at 247 Chickering Road. Dr. John Prentiss represented -the hospital and testified -that the -- sign is necessary because the hospital is difficult --to find due to the many trees surrounding it. In addition, due to the berm and curb cut, the sign cannot be placed elsewhere. He is proposing to erect the -sign above the island in front of the hospital. The proposed sign will be approximately 10 feet from the ground, inside the property line, but overhanging on State property. A variance from the required 10 foot setback is requested. The Board voted to take the petition under advisement. On October- 17, 1983, the Board rendered its decision with Members Serio, Frizelle, Trepanier, and Associate Members Soule and Foulds- again present and voting. Bulger Animal Hospital 247 Chickering Road October 31, 1983 Petition No. 56-'83 Page 2 Oci �! 4I 5`i,t'� Upon a motion made by Mr. Fri zelle and seconded by Mr. Trepanier, the Board voted unanimously to grant the variance from the 10 foot setback requirement subject to the conditions that the sign post be placed on the petitioner's property and that the sign hang over the petitioner's property with no part hanging over State property. The Board finds that Section 10.4 of the Zoning By Law has been satisfied. Specifically, the Board finds that a literal enforce- ment of the By Law will involve a substantial hardship to the petitioner and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent and purpose of the Zoning By Law.
