Turnpike Street, North Andover, for premises at: 249 Marbleridge Road, North Andover requesting a
Variance from Section 4, Paragraph 4.136(3)(c)(iix3) of the Zoning Bylaw in order to construct a new

The following non-voting members were present: Albert P. Manzi, III, and David R Webster.
Upon a motion by Richard J. Byers and 2nd by Joseph D. LaGrasse, the Board voted to GRANT a
Variance from Section 4, Paragraph 4.136(3)(c)(ii)(3) in order to construct two new permanent structures
within the Non -Disturbance Buffer Zone of the Watershed Protection District, and from 4.136(3)(d)(iii)(2),
to allow changes to the topography, 4.136(3)(d)(iii)(3), to allow vegetative removal, and 4.136(3)(d)(iii)(5),
to allow surface and subsurface drainage (swale and PVC pipe) for the driveway of the Proposed Dwelling

The Board finds that the applicant has satisfied the provisions of Section 10, paragraph 10.4 of the zoning
Bylaw in that the granting of this Variance will not adversely affect the neighborhood, that the topography
of this parcel and the proposed drainage control by treatment swales, catch basins, and roof drain
infiltration areas will not increase runoffto neighboring parcels or to Marbleridge Road or derogate from
the intent and purpose of the zoning Bylaw.
Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the date of
the grant, it shall lapse, and may be re-established only after notice, and a new hearing. Furthermore, if a
Special Permit granted under the provisions contained herein shall be deemed to have lapsed after a two (2)
year period from the date on which the Special Permit was granted unless substantial use or construction
has commenced, it shall lapse and may be re-established only after notice, and a new hearing.

SUBJECT: 249 Marbleridge Road - Map 37D, Parcel 16 - DEP file # 242-1304
At your request, I am providing comments as it concerns the above referenced property. The
comments provided are specific to the concerns raised by David C. Rand who is representing
a direct abutter, the Ridgewood Cemetery Association.
It is my understanding that Mr. Rand has concerns regarding the impact of construction on
the abutting properties and the collection/ drainage of any additional stormwaters from the
new construction activities on the low-lying Ridgewood Cemetery land.
To address these concerns, I offer the following:
• The main wetland system is located to the far rear (west) of the subject lot and continues
off property to the northwest. The rear portion of the site gradually slopes toward this
wetland system. In general, the topography in this location indicates that Stormwater
would drain in a north/ north westerly direction. Stormwaters to the front portion of the
subject lot are likely to drain in the same manner, however there is an obvious knoll
where the existing home sits that would appear to separate/ divide the drainage flows.
• The proposed plan appears to be designed to best capture drainage on the site in a similar
manner using treatment swales, catch basins, and roof drain infiltration areas. I am of the
opinion that any additional impervious areas, as a result of the new construction, would
be adequately accounted for with the proposed design. The applicant has willingly
proposed such stormwater management structures on the site, despite the fact that the.
state and local wetland regulations do not require compliance with the states Stormwater
Management Policy for the construction of less than 4 lots.
• An isolated wetland system located across Marbleridge Street is also shown on the plan.

north into a natural swale along the front property boundary. The plans were designed to
enhance this natural swale and to create an additional swale along the westerly property
boundary to prevent stormwaters from draining off property and keep any additional
drainage on site.
Hopefully, I have adequately addressed the concerns raised by Mr. Rand. Please let me
know if you have any further questions or concerns in this regard.

During the course of the 5-12-05 appeal of Belford Construction requesting a

STEP 1: ADMINISTRATOR PERMIT DENIAL:
The petitioner applies for a Building Permit and
receivers a Zoning Bylaw Denial form completed by the
Building Commissioner.
STEP 2: VARIANCE APPLICATION FORM:-
Petitioner

Petitioner completes an application form to petition the
Board of Appeals for a Variance. All information as
required in items 1 through and including 11 shall be
completed.
STEP 3: PLAN PREPARATION:
Petitioner submits all of the required pian information as
cited in page 4, section 10 of this form.
STEP 4: OBTAIN UST OF PARTIES IN INTEREST:
The petitioner requests the Assessor's Office to compile
a certified list of Parties in Interest (abutters).
8TEP s: SUBMIT APPLICATION:
Petitioner submits one (1) original and ten (10) Xerox
copies of all the required information to the Town Clerk's
Office to be certified by the Town Clerk with the time
and date of filing. The original will be left at the Town
Clerk's Office, and the 10 Xerox copies will be left with
the Zoning Board of Appeals secretary.

STEP 6: SCHEDULING OF HEARING AND
PREPARATION OF LEGAL NOTICE:
The Office of the Zoning Board of Appeals schedules
the applicant for a hearing date and prepares the legal
notice for mailing to the parties in interest (abutters) al
for publication in the newspaper. The petitioner is
notified that the legal notice has been prepared and It
cost of the Party in Interest fee.
STEP 7• DELIVERY OF LEGAL NOTICE TO
The petitioner picks up the legal notice from the Offic
of the Zoning Board of Appals and delivers the legal
notice to the local newspaper for publication.
STEP 8: PUBLIC HEARING BEFORE THE ZONIN4
BOARD OF APPEALS:
The petitioner should appear. in hismer behalf, or be
represented by an agent or attorey. In the absence
any appearance without due. rause on behalf of the
petition, the Board shall decide on the matter by usir
the information it has received to date.
STEP 8: DECISION:
After the hearing, a copy of the Board's decision will
sent to all Parties in Interest. Any appeal of the Boa
decision may be made pursuant to Massachusetts
General Law ch. 40A § 17, within twenty (20) days a

9. WRITTEN DOCUMENTATION
Application for a Variance must be supported by a
legibly written or typed memorandum setting forth in
detail all facts relied upon. When requesting a Variance
from the requirements of MGLA ch. 40A, Sec. 10.4 and
the North Andover Zoning By-laws, all dimensional
requirements shall be dearly identified and factually
supported. All points, A -F, are required to be
addressed with this application.

affecting the property for which the Variance is
sought which do not affect generally the zoning
district in which the property is located.

with respect to the land or building for which the
variance is sought.
Facts relied upon to support a finding that relief
sought will be desirable and without substantial
detriment to the public good.

of the Ordinance.
Submit RDA from Conservation Commission when
Continuous Buildable Area is applied for in ZBA
application.
10. PLAN OF LAND
Each application to the Zoning Board of Appeals shall
be accompanied by the following described plan. Plans
must be submitted with this application to.the Town
Clerk's Office and ZBA secretary at least thirty (30) days
prior to the public hearing before the Zoning Board of
appeals.
A set of building elevation plans by a Registered
Architect may be required when the application
Involves new construction/converelon/ and/or a
proposed change In use.

Major project are those, which involve one of the
following whether existing or proposed:
1) five (5) or more parking spaces,

III) 2,000 square feet of building area.
Major Projects shall require, that in addition to the 10B &
10C features, that the plans show detailed utilities, soils,
and topographic information.

Variance application
Dear Chairman:
Please accept this letter as a memorandum in support of the request for a variance for the
above referenced property. The particular supporting information as required by the
application is outlined below.
A. The particular use proposed for the land or structure.
The proposed use for the proposed structure is as a single family dwelling.
B. The circumstances relating to soil .... which do not affect generally the zoning
district in which the property is located.
The property is located in the watershed protection district. Twp distinct wetland systems
are located within 400 feet of the property. The major wetland system to which the
drainage from the property flows is located at the rear of the property. The proposed
dwelling meets all of the required offsets to this wetland. A secondary wetland exists on
the opposite side of Marbleridge Road. This wetland does not receive any flow from the
property and therefore the property will not have any influence upon this wetland or any
downstream wetlands. The purpose of the watershed protection district is to " preserve
the purity of the ground water, the lake, and its tributaries; to maintain the ground water
table; and to maintain the filtration and purification functions of the land...". Since the
drainage from the proposed site does not flow to the wetland on the opposite side of the
street the project will not have any affect on the wetlands or the functions the bylaw is
meant to maintain.

respect to the land or the buildings for which the variance is sought.
If the bylaw was enforced literally the owner would be precluded from building upon a
lot which does not have any affect on the wetland for which the variance is being sought.
D. Facts relied upon to support a finding that relief sought will be desired and
without substantial detriment to the public good.
Since the property does not drain in to the wetland to which a variance is sought there is
no affect on that wetland and therefore no downstream impact to the lake or its
tributaries. Development on the site is being proposed in compliance with the remaining
development criterion which are part of the bylaw and will therefore meet the purpose of
the bylaw.
E. Facts relied upon to support a finding that relief sought may be given without
nullifying or substantially derogating from the intent or purpose of the ordinance.
If the property is developed in compliance with the regulations as it pertains to the
wetlands in the rear and the property has no influence to the wetland on the opposite side
of the street then the project will not derogate from the intent and purpose of the bylaw.

At your request, I am providing comments as it concerns the above referenced property. The
comments provided are specific to the concerns raised by David C. Rand who is representing
a direct abutter, the Ridgewood Cemetery Association.
It is my understanding that Mr. Rand has concerns regarding the impact of construction on
the abutting properties and the collection/ drainage of any additional stormwaters from the
new construction activities on the low-lying Ridgewood Cemetery land.
To address these concerns, I offer the following:
• The main wetland system is located to the far rear (west) of the subject lot and continues
off property to the northwest. The rear portion of the site gradually slopes toward this
wetland system. In general, the topography in this location indicates that Stormwater
would drain in a north/ north westerly direction. Stormwaters to the front portion of the
subject lot are likely to drain in the same manner, however there is an obvious knoll
where the existing home sits that would appear to separate/ divide the drainage flows.
• The proposed plan appears to be designed to best capture drainage on the site in a similar
manner using treatment swales, catch basins, and roof drain infiltration areas. I am of the
opinion that any additional impervious areas, as a result of the new construction, would
be adequately accounted for with the proposed design. The applicant has willingly
proposed such stormwater management structures on the site, despite the fact that the.
state and local wetland regulations do not require compliance with the states Stormwater
Management Policy for the construction of less than 4 lots.
• An isolated wetland system located across Marbleridge Street is also shown on the plan.
Wever, it appears that drainage from the site does not flow to this wetland system, as
s ge road separates this drainage. Natural drainage from the front of the site flow

north into a natural swale along the front property boundary. The plans were designed to
enhance this natural swale and to create an additional swale along the westerly property
boundary to prevent storn-waters from draining off property and keep any additional
drainage on site.
Hopefully, I have adequately addressed the concerns raised by Mr. Rand. Please let me
know if you have any further questions or concerns in this regard.
