I Ask Metafilter Page 1 of 3 Unfortunately, there is definitely nothing that will do this for free. Aside from Lexis or Westlaw, there are some other resources, ranging from the cheap to the insanely expensive. For a really tiny fee, you can search all U.S. district court cases on Pacer. Of course, this is only one tiny piece of the court system. CourtExpress is a great comprehensive database for most state courts and some federal courts. You have to open an account to use the database, and if you're just searching without downloading documents, the fee isn't too steep. This you can search by company name, attorney, law firm, jurisdiction, and type of case. If you start requesting documents from them, watch out, as I regularly rack up fees in the hundreds of dollars with them at work. Finally, many state courts have their own web sites with some sort of free database for searching by party name. For example: Mass.. Many of these sites allow free searching, but most don't go terribly far back in time. posted by baAjo_and_the_pork at 4:20 AM on March 14, 2005 I almost forgot LexisOne, which has some free case searching. There's a reason that companies (and lawyers) charge you for that information. If you want a few particular cases, I'd be happy to get them for you --as a law student, I get free, unlimited access to Lexis and Westlaw. My e-mail's in my profile. And if you want a few articles on an ongoing basis, Lexis will deliver articles to you for a small fee per case ($9 or under, I think). Lastly, law libraries have cases in books. They're more annoying to find that way, but if you can get to such a library, they're pretty cheap to copy. posted by equipoise at Ti4AM on March 14, 2005 But, when stringbean asks for "all lawsuits filed in the US," he's asking for something that isn't on LEXIS, Westlaw, or PACER. The vast bulk of lawsuits filed in the US are filed in state trial courts in really busy and underfunded courthouses like the Circuit Court of Cook County (Chicago) and similar places in NYC and LA. I am pretty certain that there there is no centralized database that tracks the thousands of complaints filed every month in those courts. It limits google searches to U.S. federal and state government documents. That may help you refine your search. I doubt that you'll find a publicly available clearinghouse with lawsuit filing statistics. Many states (and maybe the fed as well) report their own statistics, though. You may want to try state or federal courts websites and see what they have. It's a free resource, and as the name implies, is run by Stanford Law School. Additionally, Widener Law School runs the Delaware Corporate Law Clearinghouse, which serves a similar purpose for corporate and other business litigation in the Delaware Court of Chancery. There is no such thing. At most, there could (in theory) be one database for federal cases and one database for each state. States don't share information. In many states, there isn't even a single database (for example, municipal courts often aren't linked to state data collection in any way). The US federal government cannot legally require states to share such information, and has made no efforts (that I'm aware of) to facilitate this being done voluntarily. In short, the best you can hope for is a paid service that has reasonably widespread data collection. This database should be able to let me search by company being sued and by legal firm representing the plaintiff. The reason that public organizations have not taken on the task of building such a database is that the companies being sued, and the law firms representing them, know who they are. Ward had $5 in her pocket that night, not nearly enough to cover tolls, parking and gas into Boston. "It happened more than once ... I'd say 10 percent of my husband's paycheck goes to transportation," she said at her Devon Court home. "For the past 32 years, we've lived paycheck to paycheck, and it gets tighter every year. We've never had more than $500 to $600 in savings." Ward's son Willie, 32, was born with spina bifida, or a hole over his spine. To date Willie has had brain surgery about 55 times, most of them before his 10th birthday. One year he had surgery nearly every six weeks. He uses a wheelchair and functions at the level of a 12 -year-old and, like many people with spina bifida, he has a severe latex allergy, his kidneys are failing and he has limited control over his bodily functions. For Ward, Boston hospitals have been a home away from home and the trip there has always been a stressful one to begin with. So Ward, 59, a Merrimack Valley representative of the Spina Bifida Association, is one of many speaking out against the Massachusetts Turnpike Authority's proposed toll increases that would double the cost to drive through the Ted Williams and Sumner Tunnels — from $3.50 to $7 — and would increase the Allston - Brighton tolls from $1.25 to $2. The hikes would take effect in April. A video showing Ward and Willie will play at a Stop the Pike Hike rally today at 4 p.m. at the Ecco Restaurant and Martini Bar in East Boston. She couldn't be there herself because Willie has a kidney stone surgery scheduled. She wants people to know it's not just people who travel into Boston for work, the airports, sports games and entertainment who will be affected. It's not only the livery and delivery businesses that will take a hit. Then, parking at Massachusetts General Hospital costs $9 for more than a 2 -hour stay. And a round-trip ride to Boston eats up gas quickly. "When your kid is in for a week-long stay, that adds up," she said. "Some people say, 'Well, don't visit your kid.' He's my kid. Sometimes I've slept in the hospital room to save money." Ward no longer has to pay tolls, since moving from Wakefield to North Andover in 1980, but she speaks on behalf of every mother who still does. She's afraid people will stop seeking top-notch Boston hospital care for their illnesses because it's just an added expense when things are already tight. "I fight and I don't give up," she said. "Don't punish us because the Big Dig wasn't done right. It's not our fault ... I talked to a mother in Lynn who hasn't been able to pay the phone bill for the past couple months. She doesn't know how she'll afford a toll increase. She was crying." Ward now tries to get some of Willie's medical care done in area hospitals, which is not always easy, considering all his near -fatal ailments and allergies. She still visits Boston at least once a week. Ward said she wouldn't be opposed to a gas tax. "Whatever it is, we should all pay," she said. "I'm not asking for a handout. We're making it. But stop making things worse." Once the Corporation accepts the surrender of a share of stock, except for liabilities for monthly carrying charges and other expenses relative to the Shareholder's dwelling unit as set forth in the paragraph immediately below, the Shareholder (or his or her legal representative) shall be released from any and all liabilities and obligations to the Corporation. In addition, when the Corporation accepts a surrender of a share of stock, then the Corporation shall repurchase the share of stock at its Purchase Price. In such cases, the Corporation shall be entitled to deduct from any proceeds paid hereunder (1) any amount due the Corporation from the Shareholder under such Shareholder's Occupancy Agreement, (2) the cost or estimated cost of all deferred maintenance, including painting, redecorating, floor finishing and such repairs and replacements as are deemed necessary by the Corporation, normal wear and tear excepted, to place the dwelling unit in suitable condition for another occupant, and (3) legal and other expenses incurred by the Corporation in connection with the resale of such share of stock. D. Termination for Cause. If the Corporation has terminated a Shareholder's right to occupancy under the terms of their Occupancy Agreement relating to the dwelling unit which the Shareholder is entitled to occupy or otherwise, then the Shareholder's share of stock shall be deemed to be transferred to the Corporation and shall be reflected as transferred on the books of the Corporation. E. Death of a Shareholder. Any person who inherits the share of stock of a deceased Shareholder may have such share of stock transferred to him or her on the books of the Corporation only if he or she (1) is approved by the MHFA as a resident under the terms of the Regulatory Agreement, (2) assumes in writing the terms of the Occupancy Agreement relating to the dwelling unit the deceased stockholder was entitled to occupy, and (3) pays or causes to be paid any amounts due to the Corporation under the deceased Shareholder's Occupancy Agreement. If such person who inherits the share of stock of a deceased Shareholder fails, for any reason, to satisfy the requirements of this paragraph (E), then the Corporation shall purchase such share in the same manner as if such share of stock had been surrendered in accordance with the provisions of paragraph (C) above. Any person who inherits the share of stock of a deceased Shareholder shall possess only an economic interest in the share of stock and will not have any voting rights associated with the share of stock. In the event no member of the deceased Shareholder's household applies to become, or applies and is rejected (after the completion of any applicable conference proceeding), the share of stock of such deceased Shareholder shall be deemed to have been surrendered and the terms of paragraph C above and paragraph F below shall govern its disposition. F. Mandatory Redemption by the Corporation. On December 11, 2003, the Shareholders approved the mandatory redemption of all of the outstanding shares of stock in the Corporation, which totaled nine hundred twenty (920) shares as of such date. As part of this redemption, effective January 1, 2004, all outstanding shares shall be deemed to be redeemed and each dwelling unit will be issued one (1) share in the Corporation, subject to the administration of the redemption to be accomplished by the Board of Directors of the Corporation. Following the redemption and the issuance of one share per unit, the Corporation shall have two hundred thirty (230) outstanding shares and the price paid for each share will be $475 per share. When a Shareholder moves out of the development owned by the Corporation, the Corporation shall redeem his/her share in accordance with the Corporation's Bylaws at the Purchase Price, plus any appreciation that has accrued on the share according to the Appreciation Formula and that has been deposited in the Stock Repurchase Fund (after payment of the priorities enumerated in Section 6(c) of the Regulatory Agreement, and subject to limits on distributions under Section 7 of the Regulatory Agreement, as amended from time to time), less any adjustments made for any amounts owed the Corporation for such items as unpaid carrying charges, damages to the Shareholder's unit and potential legal expenses, as set forth in the Corporation's By -Laws as amended from time to time. The redemption of any shares shall be automatically effective upon delivery by the Corporation to the Shareholder a written notice indicating that the share of stock has been redeemed. G. Casually Loss or Taking by Eminent Domain. If the entire cooperative housing development or a portion thereof which includes a substantial portion of a dwelling unit to which ownership of a share of stock entitles the owner to occupancy shall be 1) taken in or by any condemnation or other eminent domain proceeding pursuant to any law, general or special, or shall be conveyed in lieu thereof, or 2) shall be destroyed or damaged by fire or other unavoidable insured against casualty and if such destruction or damage will preclude the repair or restoration of the cooperative housing development and/or dwelling unit (or their remaining portions) substantially to their condition prior to such event, then, subject to the rights of MHFA as mortgagee, the Corporation shall redeem the stock of the affected Shareholder. The redemption price shall be the proportionate amount (that is, the amount attributable to the value of the dwelling unit which the Shareholder is entitled to occupy including his or her improvements thereto) of the proceeds of any eminent domain or insurance awarded after first deducting wherefrom the sum of a) the expenses incurred in connection with securing such award, and b) any outstanding charges or expenses due to the Corporation. Any shares of stock redeemed by the Corporation pursuant to this provision shall be treated as treasury stock of the Corporation. 4 H. Indemnification of Directors and Officers. No director or officer of the Corporation shall be personally liable to the Corporation or any shareholder for monetary damages for breach of fiduciary duty as a director or officer, except for any matter in respect of which such director or officer shall be liable under Sections 61 and 62 of Chapter 156B of the Massachusetts General laws or any amendment thereto or successor provision thereto or shall be liable by reason that, in addition to any and all other requirements for such liability, he/she (i) shall have breached his/her duty of loyalty to the Corporation or its shareholders, (ii) shall not have acted in good faith or, in failing to act, shall not have acted in good faith, (iii) shall have acted in a manner involving intentional misconduct or knowing violation of law, or (iv) shall have derived an improper personal benefit. Neither the amendment nor repeal of this paragraph shall eliminate or reduce the effect of this paragraph in respect of any matter occurring, or any cause of action, suit or claim that, but for this paragraph would accrue or arise, prior to such amendment, repeal or adoption of an inconsistent provision. ARTICLE 6 ADDITIONAL PROVISIONS A. The By -Laws may only be amended by the Shareholders at a duly called meeting and with prior written approval of the MHFA. B. The directors may specify the manner in which the accounts of the Corporation shall be kept and shall make such determinations and take all such actions as may be necessary or appropriate to assure the continued qualification of the Corporation as a "cooperative housing corporation" within the meaning of Section 216 of the Internal Revenue Code of 1954, and the regulations and rulings of the Internal Revenue Service thereunder, and to assure compliance by the Corporation with the MHFA Regulatory Agreement and other MHFA and HUD documents affecting the affairs of the Corporation. C. The purchase or other acquisition or retention by the Corporation of shares of its stock shall not be deemed a reduction of its capital stock. Upon any reduction of its capital or capital stock, no Shareholder shall have any right to demand any distribution from the Corporation, except as and to the extent that the Shareholders shall have so provided at the time of authorizing such reduction. D. Each director and officer of the Corporation shall, in the. performance of his or her duties, be fully protected in relying in good faith upon the books of account of the Corporation, reports made to the Corporation by any of its officers or employees or by counsel, accountants, appraisers or other experts of consultants selected with reasonable care by the directors, or upon other records of the Corporation. E. Subsequent to the issuance of the common stock of the Corporation, no contract or other transaction between this Corporation and another Corporation and no act of this Corporation shall in any way be invalidated or otherwise affected by the fact that any of the directors or officers of this Corporation are pecuniary or otherwise interested in or are directors or officers of such other Corporation: any directors or officers individually, or any firm of which any director or officer may be a member, may be a party to, or may be pecuniary or otherwise interested in, any contract or transaction of this Corporation, provided the fact that he, she or such firm so interested, shall be disclosed in the minutes of the proceedings of the board of directors of this Corporation and any director of this Corporation who is also a director or officer of such other Corporation or who is so interested may be counted in determining the existence of a quorum at any meeting of the board of directors of this Corporation, which shall authorize any such contract, act or transaction, provided, however, that such directors may not vote thereafter to authorize any such contract or transaction. On Tuesday, August 8, 2006 Service Master visited your home lo inspect for mold. It was suggested by them to remove the carpets entirely from the living room, treat the floor beneath and then replace the carpeting with new. On Wednesday, August 9, 2006 John Reddy, Continental Building Consultants visited your home to conduct a water test and to inspect your slider door_ The water test proved that indeed the cause of the leak in your living room is due to your slider door. Due to the fact that the home was closed tight for over two months and with the high humidity of late your living room became a prime place for mold growth. I am requesting that you contact me at your earliest convenience so that we may schedule remediation. You will need to remove all items from the affected area (living room) so that we can have the carpet company come in and remove the carpet prior to treating the sub floor. I did not observe mold growing in the paper at the rear of the drywall, but view was quite limited. This suggests that moisture may have wicked up the outside of the drywall from the subfloor, though there could be other areas of drywall where water ran down the wall from the tub. A "pat" sample consists of taking an air sample for a few seconds above an area that is tapped. Results of the Burkard sampling. Level of mold spores at interior is greater than at exterior; source of mold most probably is section of carpeting that was wet. Allergenco Air Sampler: This sampler works on the same principle at the Burkard but operates at 15 liters per minute and can be programmed to take multiple samples. The sampler ran in Kayne's bedroom from 10:01 tol 1:51 and took 5 -minute samples every five minutes. Sample 120498-A contains 12 separate samples. The samples contained mostly skin scales but there were elevated respirable materials (inorganic possibly from talc and plaster dust) as well as pet dander. There were also miscellaneous probable ratite fecal particulates. After agitating the carpeting at 10:49, the samples contained increased numbers of probable Penicillium and Aspergillus -type. (These latter spores have similar color, size and ornamentation to those found in bulk carpet sample below.) Bulk Samples: Bulk samples are obtained by pressing Scotch Tape on a surface. The tape is mounted and stained on a slide and observed under a microscope. Samples were taken from rear corner of room near baseboard convector. This area is at the very edge of the stained area extending from the bathtub wall. 120498-21 Plywood underlayment under carpet: cementitious materials (drywall?), many Penicillium spores (small, about 2 micron) insect fecal material, cellulose with mold growth, along with Penicillium conidiophores. 120498-22 Top of carpet: skin scales, (bacterially?) degraded skin scales, dust mite, probable mite fecal. Cellulose and other fibers, miscellaneous spores, plant material and chewed pollen. 120498-23 Top of pad: pad fibers and synthetic matrix, inorganic crystals. 120498-24 Bottom of pad: mite leg, mite fecal, Many Penicillium/Aspergillus-type spores (1000'x), amber plywood adhesive, Aspergillus spores and conidiophores. 120498-25 Back of rubber cove molding: inorganic (drywall/plaster?) particles. 120498-26 Back of rubber cove: Mostly brown Aspergillus spores and conidiophores, but other molds grooving including probably Stachybotrys. Mites and mold are ,known risks to individuals with asthma. Stachybotrys and Aspergillus are potential health risks due to possible presence of mycotoxins. Workers should were respiratory protection during mold and carpet removal. Conclusions and Recommendations: 1. I recommend elimination of the carpeting in Kayne's bedroom. Great care should be taken during removal of carpeting to avoid contaminating Kayne's furniture and the rest of the house. The sheetrock behind the cove molding should be very carefully cut out and replaced. At same time, exposed wood framing in the wall can be treated with Bora-care or Timbor (borate) mildewcide. If there is any additional concealed drywall that is moldy, it too should be carefully removed and replaced at same time. Underlayment can also be treated with Bora-care and sealed, if sealant is suitable for subsequent adhesive used for floor. Any vacuuming should be done with TEPA vacuum. In removal, carpeting should not be carried open through home. 2. During all cleaning and repair operations, Kayne should not be in the house. Exhaust fans should operate in his room to exhaust dusts and prevent entry into the rest of house. Be sure that Willie is also kept clear of dusts. Entire room should be cleaned of all dusts prior to re -occupancy. Note that there are many species in any given mold genus, such as Penicillium or Aspergillus; I am not a microbiologist and no identification of mold species has been made and few, if any microscopic particulates can be identified with certainty. This site visit does not make any determination, regarding the overall indoor air quality and there is the possibility that hazardous substances requiring quantitative testing are in the air intermittently which may cause chronic or acute or long term adverse health outcomes. I recommend that all Cur tubing inside the baseboard convectors in the entire house be cleaned of AU dusts, as these may be the source of pet dander and other allergens. 3. Be sure that all pillows and mattresses are covered with allergy control (mite) coverings. An inspection of the premises was performed on October 28h, 1998 by a representative of the Health Department. The inspection was in response to a complaint received on October 26, 1998. A meeting was also held with you and other Wood Ridge representatives following the inspection to discuss the complaint. The issue in question concerns work which was conducted at these premises by the Wood Ridge maintenance department in June of 1998. This was in response to a chronic leak found affecting a second floor bedroom. Pictures obtained by the Health Department clearly show mold and mildew growth under the coving of the wall. Additionally, a review of the file of actions taken concerning this situation was conducted on November 12, 1998. The file revealed no records of proper fungicide application or rug cleaning. A subsequent conversation with Wood Ridge staff revealed that the maintenance department did attempt to combat the molds and mildew by applying an odor treatment. This treatment, supplied by Serve Pro and known as #155, is not a fungicide, and as described on the container, its main use is to "mask" the odors. This type of chemical is not designed to eliminate the mold source. Because of this information and the lack of documentation concerning the sanitizing of the affected areas, it is clear to this department that sufficient steps were not taken to combat the mold issue. It is widely known that mold spores can remain viable on or in surfaces that have not been sanitized. In turn they may cause environmental hazards. Therefore, it is hearby ordered by the North Andover Health Department that Wood Ridge Homes must further investigate this situation. Appropriate environmental professionals must be contracted with to determine if there are any molds, mildews or environmental hazards present which may have resulted from this incident and which may be remaining in the air, the rug, or the interior of the walls and the sub -flooring.
