My Name is Margo Kealler, and I live at 257 Bridle Path at the end of the street in the Cul de Sac.
I am a widow, living alone, and I am next door to land ( I believe ) is owned by the town - Land that the
town is totally letting beavers take over, and now they are intruding on my land!.
arrived home from work this evening ........ yes , I must still work to keep up this house, as I cannot sell
it in this market, and I am worried sick that they are also depleting the value...... my only retirement
fund .................. (is my home) ............ I have worked hard since moving in to this home in 1980 to
keep up the property, and to be proud of it. I have a great fear also of the West Nile or EEE .........
there are so many mosquitoes, and a fisher cat. Ducks and gees also roam around, but they really
don't bother me at all...... my biggest fear is the fisher cat, as I have my living companion puppy, a
small pug, and I am so afraid to let him out after dark even for a moment.
I lost my husband to Multiple Myeloma 2 years ago, and still think the swamp next to our home (.on
your land ) was a factor involved in his disease..
I wish you would take a ride down here to see the tree, laying across my front lawn,( a live tree.eaten
and munched on on by the beavers in the swampland..or' lake' as I now call it next to me, on your land.
Also, tonite I found a bag of garbage dumped on 'your land' in the circle......... I guess people are now
thinking it is also a garbage dump.
I would like very much to 'clean up' the land, and take the downed trees out of the lake ........ (there are
now ducks swimming in 'the lake' and it could actually look very inviting, if it were ' taken care of) . DO
YOU THNK THERE IS ANYONE I COULD TALK TO ABOUT THIS. ???? I AM TERIBLY WORRIED
THAT MY LAND WILL BECOME ANOTHER JIM RICE LAND......... the beavers are now finding live
trees and encroaching on my land. I had a trapper here during the trapping season, and a 'neighbor'
put logs into his traps .......... saying he 'loves watching them build...................In the meantime, this
man has about 8 trucks in his driveway at times, here, in a residential neighborhood.

Please come and look at the live tree on my front lawn.(.you won't miss it, it is lying straight across the
lawn), and remove it please, and also please remove the white bag of garbage, so it does not begin to
look like a dump. John Cyr recently sent his trucks down the street to pick up a lot of winter sand in the
circle..(a lot had accumulated), and for this I thank him very much!
And mostly........ can you please help me???????????????? to see what we together can do to keep up
this beautiful town.!!

Beavers in
Massachusetts
The beaver is a valuable component of Massachusetts' fauna. Not long ago the beaver was absent from tl
fact, it was absent from the late 1700s to the early 1900s. Beavers are semi -aquatic mammals spending
approximately 80% of their time in water. They feed on aquatic vegetation and twigs from trees. Their c
lodges and dams are built from trees. As early Massachusetts farmers cleared the land for pasture and cr(
habitat disappeared. Habitat recovered in the early 1900s when farming was more lucrative in the fertile
Midwestern United States. Our forests continue to provide excellent beaver habitat, and the beaver has b
restored to the Commonwealth.
This webpage is intended to provide you with biological information about beaver as well as laws and re
that involve dealing with nuisance beaver and recreational harvest. When the beaver population was fair]
Massachusetts, MassWildlife concentrated on the many beneficial aspects of this large rodent. By damm
beavers expand wetlands which provide important filtration for groundwater as well as valuable wildlife
the beaver population increases and people build residential and commercial developments, adverse imp;
beaver damming activity increases. It is, therefore, critical that people know how to live with beaver in tl
environment.
In 1996, the voters of Massachusetts passed a ballot referendum known as "Question One". Among othe:
law prohibited or restricted (by permit only) many types of traps. MassWildlife managed the beaver pope
allowing a regulated harvest of beavers by licensed trappers. After Question One was enacted, statewide
dropped from 1,136 beaver, in the 1995-1996 season, to 98 in the 1997-1998 season, and the average am
harvest has been 157% below pre -1996 averages.Consequently, the beaver population experienced expos
growth from 24,000 in 1996 to some 70,000 today.
In 2000 the Massachusetts Legislature modified Question One making it easier for people to obtain perry
public health or safety problems due to beaver flooding. In this one website you will find all of the mates

on my property. Is there anything that I can do to control the flooding?
A: Go to the property owner and explain your situation. In most cases permission is granted for certain a
techniques. Permits must be obtained from your local Board of Health before any action can be taken. Tl
application will require a signature from the property owner where the dam exists.
Q: What methods are available for the control of beavers?
A: There are a variety of non -lethal and lethal options available for the control of beaver damage. A hanc
approach may be used when beaver activity does not negatively affect the homeowner. Exclusion fencin;
used to prevent tree damage, and permits may be obtained for the breaching of dams and installation of N
devices to control water levels. Trapping beavers is also an option. There is a legal trapping season from
1 -April 15 when any licensed trapper may trap beavers. Beavers may also be trapped out of season with
permits. Please refer to publications.
Q: Why do beavers cause flooding?
A: Beavers are a semi -aquatic species that are well adapted to life in the water. They rely on aquatic hab:
provide access to food, protection from terrestrial predators, and shelter in winter. Beavers are herbivoro
on the bark, branches and leaves of trees as well as aquatic vegetation. They use the indigestible parts of
dam and lodge building. Beavers enhance their habitat by increasing the size of the beaver pond. It is in(

RULES AND REGULATIONS RELATIVE TO THE USE OF CERTAIN TRAPS FOR THE T
OF FUR -BEARING MAMMALS AND TO BREACH ANIMAL DAMS
(Plain Language Summary)
1. Purpose: These regulations govern the possession and use of certain traps for the taking of fur-bea
mammals, and the breaching of beaver and muskrat dams or the installation of water flow devices
certain types of animal damage. The regulations implement the provisions of M.G.L. c. 131, § 80Y
amended by c. 139, St. 2000.
2. Definitions: Several terms are defined as specifically used in the regulations. Certain of the most r,
include:
Fur -bearing mammals includes all mammals as defined in G.L. c. 131, § 1.
Permissible traps include cage or box type traps, common type mouse and rat traps, and net traps.
Prohibited traps include all traps except permissible traps.
Restricted traps include Conibear-type traps.
3. Prohibitions Re arg ding Tra Use: Except as provided in these regulations, a person shall not use,
maintain, or possess any prohibited trap for the taking of fur -bearing mammals.
4. Health and Safety Exception: The Department of Public Health, the U.S. Public Health Service, ar
municipal board of health may use prohibited traps for the purpose of protection from threats to ht
and safety.
5. Threats to Human Health and Safety: Threats to human health and safety may include, but are not
to, beaver or muskrat: (a) occupancy of a public water supply; (b) flooding of drinking water well
wellfields, or water pumping stations; (c) flooding of sewage beds, septic systems, or sewage purr
stations; (d) flooding of public or private ways, driveways, railways, or airport runways or taxiwa}
flooding of electrical or gas generation or telephone plants, transmission or distribution facilities, c
public utilities; (f) flooding affecting public use of hospitals, emergency clinics, nursing homes, he
the elderly, or fire stations; (g) flooding affecting hazardous waste sites of facilities, incineration o
recovery plants, or other situations which may result in the release of hazardous materials; (h) gna
chewing, etc. of electrical or gas generation equipment, cables, or facilities; and (i) flooding or stn
instability on the applicant's property when such animal problem poses an imminent threat of subs
property damage or income loss including: 1. flooding of buildings or facilities, 2. flooding or rest
access to commercial agricultural lands affecting the normal practices on those lands, 3. reduction
production of a commercial agricultural crop resulting from flooding or compromised structural st

4. flooding of residential lands when the board of health determines this is a threat to human healtl
safety.
6. Permits to Use Restricted Traps: A person or his agent can obtain a permit to use restricted traps fi
municipal board of health, in situations involving threats to human health and safety, or (b) from I
non -emergency situations.
7. Permits involving Human Health and Safety: The municipal board of health may give the applican
agent a 10 -day permit to: (a) use restricted traps, (b) breach dams or dikes, subject to conditions of
municipal conservation commission, or (c) install water flow devices, subject to the conditions of
municipal conservation commission.
8. Denial of Permit: If the municipal board of health denies the permit, the applicant may appeal to: (
Department of Public Health, if the denial involves a question as to human health and safety, or (b
the denial involves a question as to whether the damage was caused by beaver or muskrat. .
9. Extension Permits: If the 10 -day emergency permit does not solve the animal problem, the applica
approval of the board of health, shall apply to DFW for a 30 -day extension permit.
10. Management Plans: If the DFW director determines that the 30 -day extension should be issued, he
within 30 days, develop an alternative, non -lethal management plan to address the situation. The p
developed with the participation of the applicant, the board of health, and the conservation commit
plan is to describe long-term solutions, using barriers, fencing, water flow devices, continued use c
permissible traps, or other options appropriate to the situation. DFW is to provide such technical a,
assistance as is necessary to implement the plan.
11. Additional Emergency Permits: If the initial 10 -day emergency permit does not solve the animal p
applicant or his agent may apply to the board of health for additional emergency permits. The app]
state in writing that either: (a) he has attempted and failed to control the situation with alternative,
means or permissible traps, or (b) he has applied for, but not yet received, a 30 -day extension from
director.
12. Authorizations under such Additional Emergency Permit: A person may receive only 2 additional
permits, each valid for 10 consecutive days. The first allows the use of any of the means allowed u
initial permit. The second allows only dam breaching and installation of flow devices. Such emerg
permit expires upon the issuance of a 30 -day extension permit by the DFW director.
13. Non -Emergency Permits: In situations not involving threats to human health and safety, a person r
to the DFW director for a permit either to use restricted traps, to breach a beaver or muskrat dam c
install water flow devices. Dam breaches or installation of flow devices must also be approved by
municipal conservation commission.
14. Procedures for Obtaining Non -Emergency Permit. Upon receipt of an application to use restricted
DFW shall review the situation and may make a field inspection. If issuance of a permit is warrant
applicant must: (a) demonstrate that he has used permissible traps for at least 15 consecutive days
failed to abate the problem, and (b) has attempted to use alternative, non -lethal methods and has fa
abate the problem. The director may then issuance a permit to use restricted traps for up to 30 con:
days. The applicant shall make a report to DFW after the period is up. If the problem is still not so
applicant may again go through the entire process to obtain another permit.
15. Review of Problem Situations: When an animal complaint is received, DFW shall determine the n,

problem, and direct problems relating to human health and safety, which may necessitate the use c
traps or dam breaches, to the board of health. Situations not involving human health and safety, or
necessitating restricted traps or dam breaches, shall be handled in accordance with DFW practice.
16. Subregulatory Guidelines: The Department of Public Health, and the Department of Environmentz
Protection, in consultation with DFW, have prepared guidelines for boards of health and conservat
commissions, to aid them in the implementation of these regulations and §80A. These guidelines f
mailed to all municipalities, and will be posted on the DFW website. Sample permits and forms m
available in like manner.

Special Permit - Watershed Protection District
The Planning Board makes the following findings regarding the application of David and
Margaret Kealler, 257 Bridle Path, North Andover, MA, 01845, submitted on March 16,
2001, requesting a Special Permit under Section 4.136 of the Zoning By -Law to allow the
construction of a 16' x 31' deck and a 1,126 square foot addition to the first floor of the
existing dwelling; and the razing of an existing shed within the Non -Disturbance Zone of
the Watershed Protection District.
FINDINGS OF FACT:
In accordance with 4.133 the Planning Board makes the finding that the intent of the Bylaw,
as well as its specific criteria, are met. Specifically the Planning Board finds:
1. That as a result of the proposed construction in conjunction with other uses nearby,
there will not be any significant degradation of the quality or quantity of water in or
entering Lake Cochichewick. The Planning Board bases its findings on the
following facts:
a) The existing dwelling is NOT connected to the Town sewer system; however, as
part of this proposal the municipal will be connected to the town sewer system
prior to the issuance of any building permits.
b) A deed restriction will be placed limiting the types of fertilizers that can be used
on the site.
c) The topography of the site will not be altered substantially.
d) The limit of clearing is restricted to the minimum necessary to construct the
proposed deck;
e) Certification has been provided by a registered professional engineer that the
installation of the deck will not have an effect on the quality or quantity of runoff
entering the watershed protection district.
f) The construction of the deck and the addition has been reviewed by the town's
outside engineering consultant, VHB, and with the application of the erosion
control, use of organic low nitrogen fertilizers, and connection of the dwelling to
the municipal sewer, there will be no degradation to the quality of quanity of
water in or entering Lake Cochichewick.
2. There is no reasonable alternative location outside the Non -Disturbance Buffer Zone
for any discharge, structure or activity, associated with the proposed project as
almost the entire lot is located within the Non -Disturbance Zone and the Non -
Discharge Zone.

In accordance with Section 10.31 of the North Andover Zoning Bylaw, the Planning Board
makes the following findings:
a) The specific site is an appropriate location for the proposed use as all feasible
storm water and erosion controls have been placed on the site;
b) The use will not adversely affect the neighborhood as the lot is located in a
residential zone;
c) There will be no nuisance or serious hazard to vehicles or pedestrians;
d) Adequate and appropriate facilities are provided for the proper operation of the
proposed use;
e) The Planning Board also makes a specific finding that the use is in harmony with
the general purpose and intent of the North Andover Zoning Bylaw.
Upon reaching the above findings, the Planning Board approves this Special Permit based
upon the following conditions:

1) This decision must be filed with the North Essex Registry of Deeds. The following

b) The Town Planner shall approve any changes made to these plans. Any changes
deemed substantial by the Town Planner would require a public hearing and
modification by the Planning Board.
2) Prior to issuance of a building permit:
a) A performance guarantee of one thousand ($1000) dollars in the form of a check
made out to the Town of North Andover must be posted to insure that construction

will take place in accordance with the plans and the conditions of this decision and
to ensure that the as -built plans will be submitted.
b) All erosion control measures as shown on the plan must be in place and reviewed by
the Town Planner.
c) No pesticides, fertilizers or chemicals shall be used in lawn care or maintenance.
The applicant shall incorporate this condition as a deed restriction, a copy of
the deed shall be submitted to the Town Planner and included in the file.
d) The septic system must be abandoned and connection of the dwelling to the
municipal sewer must occur.
e) The Board of Health must inspect the site to ascertain all contaminated soil has
been removed from the site.
3) Prior to release of the Performance Bond:
a) The applicant shall submit an as -built plan stamped by a Registered Professional
Engineer in Massachusetts that shows all construction, including storm water
mitigation trenches and other pertinent site features. This as -built plan shall be
submitted to the Town Planner for approval. The applicant must submit a
certification from the design engineer that the site was constructed as shown on the
approved plan.
b) The Planning Board must by a majority vote make a finding that the site is in
conformance with the approved plan.
4) In no instance shall the applicant's proposed construction be allowed to further impact
the site than as proposed on the plan referenced in Condition # 1.
5) No open burning shall be done except as is permitted during burning season under the
Fire Department regulations.
6) The Contractor shall contact Dig Safe at least 72 hours prior to commencing excavation.
7) The provisions of this conditional approval shall apply to and be binding upon the
applicant, it's employees and all successors and assigns in interest or control.
8) This permit shall be deemed to have lapsed after a two- (2) year period from the date
June 6, 2003 on which the Special Permit was granted unless substantial use or
construction has commenced.
