We've decided to erect the swing set in the level side yard (so that we won't have to worry about aftering the yard and potentially violating any of the wetlands protection laws. We were reluctant to do so because the side yard seems so exposed, but it is really the better decision. Our offices moved and I our phones and e-mail is finally up and running. I pulled up a plan of that lot. This plan does not show the as -built (existing) conditions of the site, but does show a significant wetland resource directly behind the property. In addition, it appears that part of this wetland resource area is a replication area that was required for a filled portion of the resource area when the home was orginally built. The location of this resource area places the majority of the lot within the 100' buffer zone. Any work within this 100' buffer zone to a resource area would require a permit/filing with the Conservation Commission persuant to the Massachusetts Wetlands Protection Act and the North Andover Wetland Protection Bylaw. Further, the Conservation Commission regulates a 25'no-disturbance zone and a 50'no-build zone from the edge of the resource area under the local Bylaw. These 2 buffer zones appear to be located directly behind the existing home and the 50' no -build zone may in fact intersect through some existing structures. I think it would be a good idea to meet you at the site (I would need written permission from the current owner to do so first however) to understand the as -built conditions and guide you further in this regard and if you want to proceed, the process for filing with the Commission. N. Andover on May 24th. We would like to install a swing set in the backyard. We know that our property is abutting wetlands (though we don't have any site plans) and in order to install a swing set safely we would need to level a small area. Could you advise on what we need to do to ensure that we are not violating any environmental laws? Thank you.
