DECISION
Petition #014-93
The Board held a regular meeting on Tuesday, March 9, 1993 upon
the application of Meadowood Realty Corp. requesting a variation
of Section 4, Paragraph 4.2 of the Zoning Bylaw so as to permit a
variation of the Phased Development Bylaw to allow the
construction of 26 single family homes in 1993 on Lots 1 through
26 Meadowood Road. The following members were present and
voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Louis
Rissin and John Pallone.
The hearing was advertised in the North Andover Citizen on
February 17 and 24, 1993 and all abutters were notified by
regular mail.
Upon a motion by Mr. Soule and second by Mr. Rissin, the Board
voted unanimously to GRANT the variance as requested.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.

Re: Meadowood Phased Development Variance Request
Dear Mr. Serio,
I am writing on behalf of the Planning Board in support of
the variance request of Meadow Realty Corp. from the Phased
Development Bylaw (Section 4 Paragraph 4.2 of the Zoning Bylaw)
to allow for the construction of 26 single family homes in 1993
on lots 1 through 26 Meadowood Road.
The Bylaw was created to limit development to a manageable
pace throughout the Town. As this is an area of town that has
been targeted for development, the construction of the 26 homes
was anticipated and encouraged. The development of this property
is therefore at a "manageable pace".
As such, the Planning Board supports the request of Meadow
Realty Corp to allow the construction of 26 homes in one year.

1. Five (5) copies Of' the application.
2. Six (6) copies of the site plan, one mylar and five paper.
The mylar should be stamped by a Registered Land Surveyor or
a Professional Engineer (with discipline) . The signature
box should have five lines for signatures. The mylar is to
be recorded with the Registry of Deeds after signed
approval from the Zoning Board of Appeals. A copy of
recording will accompany any building permit application
according to M.G.L. Chapter 409, Section 14.
3. The fee for publishing the legal notice will be paid for by
the petitioner when he/she delivers the legal notice to the
Eagle Tribune or the Citizen.
Check for $25.00 for filing fee, made out to 'the Town of
North Andover.
5. The petitioner will be billed for postage for sending legal
notices and decisions to all abutters.
6. The applications must be time -stamped by the Town Clerk
before acceptance by the Board of Appeals.
7. The petitioner or a legal representative must attend the
public hearing.
8. Any applications involving State highways, such as Route
114, Route 125, etc., must have a copy of site plans
submitted to Mr. David Wilson at the MA Dept. of Public
Works, District 5, 485 Maple St., Danvers, MA 02137 at least
one week before the scheduled meeting.
9. The deadline for submittal of application and delivery of
Legal Notice to the paper is
