Mr. Altieri,
I am very sorry your wife is experiencing health problems. The Health Department does have monitors that
check the plants processes on throughout the year and there are very strict state reporting requirements that
they do follow. Neither have shown any violations to the laws in the recent past. Of course we know that no
one can know all aspects of the operation on every given day. The plumes of steam are common, as the
pressure builds it does need to release and it makes quite a noise as well. The Health office is at 1600 Osgood
Street and I do see and hear this steam being released.
Without a medical diagnosis, it is more than difficult for me to make any comment on her illness, however I can
say anecdotally that currently I have no other similar complaints and the height of the stacks generally takes
the residual from the stack far away from our community. However, we will keep your concern in our complaint
file and if you receive any specific information from physicians or others please feel free to pass it on to us and
we will investigate.

Hi Susan,
Noticed a large cloud plume quite near my home on Barker Street.a few mornings ago. I then
wondered if this could be a culprit to why my wife will occasionally goes into a debilitating coughing spasm that
last about one hour. These spasms only happed at our home which give me suspicion to the air quality in my
area. We have lived here near 30 years and do remember previous bad air quality scenarios with the
Wheelbrator plant e.g., faulty scrubbers etc., a while back.

On July 18, 2012, at 4:14 pm, the Massachusetts Department of Environmental
Protection (MassDEP) received oral notification of a release/threat of release of oil/hazardous
material at the subject location, which requires one or more response actions. Based on this
information, MassDEP has reason to believe that the subject property or portion(s) thereof is a
disposal site as defined in the Massachusetts Oil and Hazardous Material Release Prevention and
Response Act, M.G.L. c. 2 1 E and the Massachusetts Contingency Plan (MCP), 3 10 CMR 40.0000.
M.G.L. c.21E and the MCP govern the assessment and cleanup of disposal sites.
The purpose of this notice is to inform you of your legal responsibilities under state law
for assessing and/or remediating the subject release. For purposes of this notice, the terms and
phrases used herein shall have the meaning ascribed to them by the MCP unless the text clearly
indicates otherwise.

STATUTORY LIABILITIES
MassDEP also has reason to believe that you (as used in this letter "you" refers to Wheelabrator
North Andover) are a Potentially Responsible Party (PRP) with liability under M.G.L. c. 21 E,
Section 5, for response action costs. Section 5 makes the following parties liable to the
Commonwealth of Massachusetts: current owners or operators of a site from or at which there is or
has been a release/threat of release of oil or hazardous material; any person who owned or operated
a site at the time hazardous material was stored or disposed of; any person who arranged for the
transport, disposal, storage or treatment of hazardous material to or at a site; any person who
transported hazardous material to a transport, disposal, storage or treatment site from which there is
or has been a release/threat of release of such material; and any person who otherwise caused or is
legally responsible for a release/threat of release of oil or hazardous material at a site.
This liability is "strict" meaning that it is not based on fault but solely on your status as
owner, operator, generator, transporter or disposer. It is also "joint and several", meaning that you
may be liable for all response action costs incurred at the site, regardless of the existence of any
other liable parties.
The MCP requires responsible parties to take necessary response actions at properties where
there is or has been a release or threat of release of oil and/or hazardous material. If you do not take
the necessary response actions, or fail to perform them in an appropriate and timely manner,
MassDEP is authorized by M.G.L. c. 21E to have the work performed by its contractors. By taking
such actions, you can avoid liability for response action costs incurred by MassDEP and its
contractors in performing these actions, and any sanctions, which may be imposed, for failure to
perform response actions under the MCP.
You may be liable for up to three (3) times all response action costs incurred by MassDEP.
Response action costs include, without limitation, the cost of direct hours spent by MassDEP
employees arranging for response actions or overseeing work performed by persons other than
MassDEP or its contractors, expenses incurred by MassDEP in support of those direct hours, and
payments to MassDEP's contractors. (For more detail on cost liability, see 3 10 CMR 40.1200.)
MassDEP may also assess interest on costs incurred at the rate of twelve percent (12%),
compounded annually. To secure payment of this debt, the Commonwealth may place liens on all
of your property in the Commonwealth. To recover the debt, the Commonwealth may foreclose on
these liens or the Attorney General may bring legal action against you.
In addition to your liability for up to three (3) times all response action costs incurred by
MassDEP, you may also be liable to the Commonwealth for damages to natural resources caused
by the release. Civil and criminal liability may also be imposed under M.G.L. c. 2 1 E, § 11, and
civil administrative penalties may be imposed under M.G.L. c. 21A, § 16 for each violation of
M.G.L. c. 21E, the MCP, or any order, permit or approval issued hereunder.

NECESSARY RESPONSE ACTIONS
The subject site shall not be deemed to have all the necessary and required response actions
taken unless and until all substantial hazards presented by the site have been eliminated and a level
of No Significant Risk exists or has been achieved in compliance with M.G.L. c. 2 1 E and the MCP.
In addition, the MCP requires persons undertaking response actions at disposal sites to perform
Immediate Response Actions (IRAs) in response to "sudden releases", Imminent Hazards and
Substantial Release Migration. Such persons must continue to evaluate the need for IRAs and notify
MassDEP immediately if such a need exists.
MassDEP has determined that an IRA is necessary to respond to a release of oil
and/or hazardous material at the subject site.
You are authorized to conduct only the specific response actions for which you
received oral approval from MassDEP at the time oral notification was provided to MassDEP
of the subject release. All additional Immediate Response Actions require MassDEP
approval in accordance with 310 CMR 40.0420.
MassDEP reminds you that IRAs must include site assessment activities necessary to
evaluate potential Imminent Hazard (IH), Substantial Release Migration (SRM), and
Critical Exposure Pathway (CEP) conditions. Additional Immediate Response Actions will
be required in the event an IH, SRM, or CEP condition is observed.
You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or
actually perform the necessary response actions at the subject site. In addition, the MCP requires
persons undertaking response actions at a disposal site to submit to MassDEP a Response Action
Outcome Statement (RAO) prepared by an LSP in accordance with 310 CMR 40.1000 upon
determining that a level of No Significant Risk already exists or has been achieved at a disposal site
or portion thereof. [You may obtain a list of the names and addresses of these licensed professionals
from the Board of Registration of Hazardous Waste Site Cleanup Professionals at (617) 556-1091.]
There are several other submittals required by the MCP which are related to release
notification and/or response actions that may be conducted at the subject site in addition to an RAO,
that, unless otherwise specified by MassDEP, must be provided to MassDEP within specific
regulatory timeframes. The submittals are as follows:
(1) If information is obtained after making an oral or written notification to indicate that the
release or threat of release didn't occur, failed to meet the reporting criteria at 310 CMR
40.0311 through 40.0315, or is exempt from notification pursuant to 310 CMR 40.0317, a
Notification Retraction may be submitted within 60 days of initial notification pursuant to
310 CMR 40.0335; otherwise,

(2) If one has not been submitted, a Release Notification Form (RNF) [copy attached] must be
submitted to MassDEP pursuant to section 310 CMR 40.0333 within 60 calendar days of
the initial date of oral notification to MassDEP of a release pursuant to 3 10 CMR 40.03 00
or from the date MassDEP issues a Notice of Responsibility (NOR), whichever occurs
earlier;
(3) Unless an RAO or Downgradient Property Status Submittal is provided to MassDEP earlier,
an Immediate Response Action (IRA) Plan prepared in accordance with 3 10 CMR 40.0420,
or an IRA Completion Statement (310 CNIR 40.0427) must be submitted to MassDEP
within 60 calendar days of the initial date of oral notification to MassDEP of a release
pursuant to 3 10 CMR 40.0300 or from the date MassDEP issues an NOR, whichever occurs
earlier; and
(4) Unless an RAO or Downgradient Property Status Submittal is provided to MassDEP earlier,
a completed Tier Classification Submittal pursuant to 310 CMR 40.0510, and, if
appropriate, a completed Tier I Pen -nit Application pursuant to 3 10 CNM 40.0700, must be
submitted to MassDEP within one year of the initial date of oral notification to MassDEP of
a release pursuant to 310 CMR 40.0300 or from the date MassDEP issues an NOR,
whichever occurs earlier.
(5) Pursuant to the MassDEP's "Timely Action Schedule and Fee Provisions", 3 10 CMR 4.00,
a fee of $1,200 must be included with an RAO statement that is submitted to MassDEP
more than 120 calendar days after the initial date of oral notification to MassDEP of a
release pursuant to 3 10 CMR 40.0300 or after the date MassDEP issues an NOR, whichever
occurs earlier, and before Tier Classification. A fee is not required for an RAO submitted to
MassDEP within 120 days of the date of oral notification to MassDEP, or from the date
MassDEP issues an NOR, whichever date occurs earlier, or after Tier Classification.
it is important to note that you must dispose of any Rernediation Waste generated at the
subject location in accordance with 3 10 CMR 40.0030 including, without limitation, contaminated
soil and/or debris. Any Bill of Lading accompanying such waste must bear the seal and signature of
an LSP or, if the response action is performed under the direct supervision of MassDEP, the
signature of an authorized representative of MassDEP.
MassDEP encourages parties with liabilities under M.G.L. c. 21E to take prompt action in
response to releases and threats of release of oil and/or hazardous material. By taking prompt
action, you may significantly lower your assessment and cleanup costs and avoid the imposition of,
or reduce the amount of, certain permit and annual compliance fees for response actions payable
under 3 10 CMR 4.00.

(BWPSW45, Any FacilityAlternative Review, Transmittal Number X240483) for alteration of the ash

2. The existing pugmills used to condition the ash with units of a larger capacity.
The proposed alterations will not alter the operation or capacity of the facility. MassDEP has
determined the design complies with 310 CIVIR 19.000 and approves the modifications.
NOTICE OF RIGHT TO APPEAL
Wheelabrator North Andover, Inc. (Wheelabrator) is hereby notified that it may within .
twenty-one (21) days file a request that this decision be deemed a provisional decision under 310 CIVIR
19.037(4)(b) by submitting a written statement of the basis on which Wheelabrator believes it is
aggrieved, together with any supporting materials. Upon timely filing of such a request, the decision
shall be deemed a provisional decision with an effective date twenty-one (21) days after the
Department's receipt of the request. Such a request shall reopen the administrative record, and the
Department may rescind, supplement, modify, or reaffirm its decision. Failure by Wheelabrator to
exercise the right provided in this section shall constit ute a waiver of Wheelabrator's right to appeal.
Appeal. Any person aggrieved by the issuance of this decision, except as provided for under
310 CIVIR 19.037(4)(b), may file an appeal forjudicial review of said decision in accordance with the
provisions of M.G.L. c. 111, s. 150A, ' and M.G.L. c. 30A, not later than thirty (30) days following the
receipt of the final decision. The standing of a. person to file an appeal and the procedures for filing such
appeal shall be governed by the provisions of M.G.L. c. 30A. Unless the person requesting an appeal
request I s and is granted a stay of the terms and conditions of the decision. by a court of competent
jurisdiction, the decision shall remain effective.
Notice of Action. Any aggrieved person intending to appeal this decision to the Superior Court
shall first provide notice to the Department of their intention to commence such action. Said notice of
intention shall include the Department file number and shall identify with particularity the issues and
reasons why it is believed the decision was not proper. Such notice shall be provided to the Office of
General Counsel of the Department and the Regional Director for the regional office which processed

All papers pertaining to design, operation, or
engineering of this site or facility shall be completed
under the supervision of a Massachusetts registered
professional engineer knowledgeable in solid waste
facility design, construction and operation, and shall
bear the seal, signature and discipline of said
engineer. The soils, geology, air monitoring and
groundwater sections of the application or monitoring
report shall be completed by competent professionals
experienced in the fields of soil science and soil
engineering, geology, air monitoring and groundwater,
respectively, under the supervision of a
Massachusetts registered professional engineer. All
mapping and surveying shall be completed by a
registered surveyor.

Any person, required by these regulations or any
order issued by the Department, to submit papers
shall identify themselves by name, profession, and
relationship to the applicant and legal interest in the

Attachment I
General Description
The current system consists of screw type conveyors that will be replaced with drag chain type
conveyors. The current system is worn and is in need of replacement. Drag chain conveyors are in place
in other parts of the flyash handling system at the facility. These drag chain conveyors have shown over
time to be effective and reliable at conveying ash. In addition, the current Pugmills that are used to
condition the flyash are being replaced with larger capacity units. There will be no impact to ash
generation rates, ash quality or characteristics as a result of this project. This change is limited to
replacing existing equipment and not changing process or the capacity of the facility.

EXPERIENCE
Since its development, the AshTech mixer-unloader system has been installed at hundreds of industrial and utility
facilities to solve dust control problems.
0 Unit capacities range from under 5TPH to over 40OTPH
with multiple unit installations providing unloading
capabilities of over 1000TPH.
0 Systems are in operation on fly ash from all types of coal -
firing, wood, and refuse combustion; on pulverized, stoker,
and fluid bed boilers; with cement, lime, coal dust, and other
abrasive powders.
0 Totally automated systems provide continuous,
unattended conditioning, discharging to trucks, storage
containers or take -away conveyors.
N__ Customized designs have been developed to solve
difficult retrofit situations.
OPERATION
The AshTech mixer-unloader is a totally enclosed, twin -shaft paddle mixer designed to thoroughly condition and
blend ash and other dusty, abrasive materials. Material feed rate into the mixer chamber is precisely controlled by a
variable -speed rotary feeder. Water spray feed rate is adjusted by control valves.
As material enters the mixer tub, inclined
mixer paddles, mounted on the counter -
rotating shafts, blend and mix the material as
it is conveyed forward. As the material is
moistened by the wetting sprays, the
interposing mixing paddles cause all dry
surfaces to be exposed, resulting in a forced
mixing and wetting of all material.

Bureau of Waste Prevention, Solid Waste Section (MassDEP) has reviewed your request for authorization to

Massachusetts (the "facility'), to other Wheelabrator facilities on a temporary basis. The request was submitted on
May 25, 2006.
Heavy rain and flooding of the service area of the facility during the period of May 12 through 15, 2006 has
resulted in an emergency condition resulting in an increase in the volume of waste received at the facility. As
identified by telephone conversation between WNA and MassDEP, the additional volume, while within the facility's
capacity limits on a basis of weight, is exceeding the ability of the facility to manage the material in a timely
manner., WNA has, therefore, requested to be authorized to reload the excess waste and transfer it to other facilities
owned/operated by the Waste Management family of companies which are better able to handle the waste. WNA
has proposed the operation at the transfer operations will occur for a period through June 10, 2006.
Pursuant to the authority established at 3 10 CMR 16.22(4), MassDEP approves the temporary transfer of
waste, provided:
The transfer of waste shall be limited to the period through June 10, 2006.
All waste shall otherwise be managed as pursuant the facility's approved operation and
maintenance plan, including, but not limited to, tipping and management of waste with the facility
building.

Wheelabrator North Andover, Inc. facility located at 285 Holt Road in North Andover, MA (the
"Facility"). The plan was received by MassDEP on March 30, 2006.
Facility Background
The Facility is a solid waste combustor located at 285, Holt Road, North Andover,
Massachusetts, and is operated by Wheelabrator North Andover, Inc. MassDEP issued an
Existing Facility Permit and Authorization to Operate Combustion Facility (the "ATO") on
March 29, 1993. The Facility's original Waste Ban Compliance Plan is dated December 30, 1999,
and was approved by MassDEP on February 28, 2000 (revised December 6, 200 1).
Waste Ban Compliance Nan
As stated in the Waste Ban Compliance Plan (the "plan"), the Facility accepts waste loads in
vehicles with a capacity of greater than 5 cubic yards, will conduct ongoing waste ban
inspections, and will conduct a minimum of 20 random, comprehensive load inspections per
month, using Option B, not opening bags. The Facility will record all failed loads discovered

conducting annual waste ban training, and distributing the plan to staff. The Facility will revise
its on-site signage to reflect the new bans prior to July 1, 2006, and implement the new bans by
July 1, 2006.
Department Determinations
MassDEP has reviewed the proposed Waste Ban Comp, a c Wfor Wheelabrator North
Andover, Inc. in accordance with the Massachusetts Solid t 1 0 CMR 16.00 &
19.000. This document is an �4pprov� , al issued pursuant to 14 s s <a4c ral Laws Chapter
-J, k�; `�, � Y I k �, �
111, Section 150A and the reg;`U1Aion§ pfomdlgSted thereunder at 3 10 CMR 19.000. In the event
this approval conflicts with all or parts of prior plan approvals or permits issued pursuant to
MGL Chapter 111 Section 150A, the terms and conditions of this approval shall supersede the
conflicting provisions of such prior permits or approvals. ' This approval does not convey
property rights of any sort or any exclusive privilege. The conditions upon which this approval
is Contingent -are presented below. This approval is also subject to the standard conditions found
at 310 CMR 19.043(5).
Conditions
A. General
1. All terms and conditions of the current operating permit(s) for the Facility shall remain in
full force and effect except as may be modified by this approval.
2. This approval is subject to any restrictions contained in the Facility's site assignment or
any restrictions contained in applicable state and federal laws and regulations.
3. Failure to comply with the waste ban requirements at 310 CMR 19.017 or the inspection
requirements of 310 CMR 19.207(25) may result in enforcement action, potentially
including a notice of non-compliance or enforcement order and/or penalty.
4. MassDEP and its agents and employees shall have the right to enter upon the Facility site
at all reasonable times and without notice, to inspect the Facility and any equipment,
structure or land located thereon, take samples, recover materials or discharges, have
access to and copy records, to perform tests and to otherwise monitor compliance with
this approval, or any and all permits relative,to the operation of the Facility, and all
environmental laws and regulations. The right of entry and inspection shall be in
addition to the MassDEP's access authorities and rights under applicable federal and state
laws and regulations, as well as any permits or other agreements between the Permittee
and MassDEP.
B. Waste Ban Plan
1. This approval supersedes and replaces in its entirety any previous waste ban approvals
issued to the Facility.

2. All activities at the Facility conducted to comply with the waste ban requirements at 310
CMR 19.017 shall be in strict accordance with the Waste Ban Compliance Plan as
submitted in your application and this approval.
3. Prior written approval from MassDEP is required before any changes or modifications
can be made to the Facility's Waste Ban Compliance Plan requirements.
4. An annual suninikion of Waste ban compliance activities at the facilities shall be reported

submitted to MassDEP by February 15 th of each calendar year. Compliance with this
condition will be determined by the date of receipt or the post -marked date, whichever is
earlier.
5. MassDEP reserves the right to modify the Facility's Waste Ban Compliance Plan based
upon a determination that restricted materials are being disposed of or transferred for
disposal in excess of approved amounts.

Wheelabrator North Andover, Inc. ("Wheelabrator") is hereby notified that it may within
twenty-one (2 1) days file a request that this decision be deemed a provisional decision under 3 10

The Department of Environmental Protection, Northeast Region, Bureau of Waste
Prevention, Solid Waste Management Section (MassDEP) has reviewed your application
(BWPSW45, Any Facility — Alternative Review, Transmittal Number X257032) for modification of
the recovered metals handling system at the Wheelabrat6r North Andover Resource Recovery
Incinerator at 285 Holt Road, North Andover, Massachusetts. The application was prepared by
WheelArator North Andover Inc.
Current site plans for the Wheelabrator North Andover Resource Recovery Incinerator
includes two (2) bunkers located adjacent to the ash handling building for the storage of metals
recovered from the ash. The bunker abutting the ash handling building is designated for ferrous
and non-ferrous metals. The second bunker is designated for the storage of other bulky metals.
Not depicted on the current site plan, non-ferrous metals are stored in a "tip dumpster" adjacent
to the ash house at the boiler building.
By this application, Wheelabrator North Andover Inc. proposes to construct a dedicated
bunker for the storage of non-ferrous metals adjacent to the ash house. The bunker will replace

MassDEP has completed its technical review of your application and determined the
proposed alteration meets applicable MassDEP requirements. MassDEP, hereby, approves the
alteration as proposed.

Ash Storage Building & APC Foundations
The scope of MRI's second Building Permit application includes work associated the ash storage
building expansion, truck aisle, conveyor gallery and foundations for the fabric filter and spray
dryer absorber.
The existing ash storage building is a three sided structure with an open wall on the South side.
As part of this project, the storage building will be doubled in size and will be fully enclosed.
The building will also include an enclosed truck aisle and conveyor gallery. The building will
have FRP siding, lighting and a 26,000 CFM ventilation system with a wet scrubber for dust
control.
The attached listing of drawings provides details concerning this work.
The building and foundations were designed by S/D Engineers in Pittsburgh, PA. Daigle
Engineer's Inc has performed a Structural Peer Review Review of this design and resolved all
their questions / comments with S/D. A copy of Daigle's review results letter is attached.
WAPC conservatively estimates the value of this work to be $2,173,728. This estimate includes
all costs associated with this work including demolition, materials and construction costs.

ap independent structural engineer review Of various Portions Of the proposed atructural work as-
sociated with the referenced project.
The objective of this review being to determine if the structural Plans and specificat'ons for . the
noted portions of the referenced project, are in compliance with Structural Code requirements,
following the guidelines established in ' Section 110.11 and Appenft I " Of the Massachusetts
State Building Code, 780 CMR, Sixth FAUtion. This Otiective is limited in that it is to be only to
the extent necessary to render an opinion reWding the stability and integrity of the primarY
structural system of the building. At no time shall it be construed that our office (Daigle E4-

Review of the structural design for Phase 11 is scheduled for a later date,
For our Phase I review, the owner provided us with ooatract drawings depicting the proposed
work, and corresponding structural sections of the specifications. The Structural Engineer Of Re-
cord (SER) Eugene H. Gales, P.E., of S/D Engineers, Inc., prepared said documents. A copy of the
geotechnical report prepared by Haley and Aldrich, and the SER's calculations for specific ele-
ments were also submitted.
As stipulated in 9 Appendix I * of 780 CMR, ow office performed the following tasks;
Checked to assure that the design loads are in conformance with Tte requirements of
the Massachusetts State Building Code, 780 CMR - Sixth Wtion.
ChecRed that the design criteria and assumptions confbrm to 780 CUR, and are in
general compliance with accepted engineering practice.
* Reviewed the Geotechnical report for verification that the design properly incorpowates
its results and recommendations.
* Checked that the organization of the strucwre is conceptually correct and that the load
paths are adequate to deliver forces from the building frame through the foundations
and into the supporting aub grade.
Performed independent calculations for a representative &action of the systems, mem-
bers and details, adequate to form a basis for our conclusions.

During the course of our review, we exchanged correspondence with, and 4conferred direcW by
phone with Mr. Gales, the SER, to request clarifications and discuss issues of concern. All such
issues of concern have been resolved to our satisfaction and we have been informed the final con-
struction will incorporate the necessary adjustments.
it is our professional opinion that the design loads and design assumptions used for the design of
this projcct conform to the requirements of the Massachusetts State Building Code, 780 CUR,
and axe in accordance with accepted engineering practice.

Ash Storage Building & APC Foundations
The scope of MRI's second Building Permit application includes work associated the ash storage
building expansion, truck aisle, conveyor gallery and foundations for the fabric filter and spray
dryer absorber.
The existing ash storage building is a three sided structure with an open wall on the South side.
As part of this project, the storage building will be doubled in size and will be fully enclosed.
The building will also include an enclosed truck aisle and conveyor gallery. The building will
have FRP siding, lighting and a 20,000 CFM ventilation system with a wet scrubber for dust
control.
The attached listing of drawings provides details concerning this work.
The building and foundations were designed by S/D Engineers in Pittsburgh, PA. Daigle
Engineer's Inc has performed a Structural Peer Review Review of this design and resolved all
their questions / comments with S/D. A copy of Daigle's review results letter is attached.
WAPC conservatively estimates the value of this work to be $2,173,728. This estimate includes
all costs associated with this work including demolition, materials and construction costs.

Review of the structural design for Phase 11 is scheduled for a later date.
For our Phase I review, the omer provided us with oontract dr&wings depicting the proposed
work, and corresponding structural sections of the specifications. The Structural Engineer of Re-
cord (SER) Eugene H. cialgs, P.E., of S/D Engineers. Inc., prepared said documents. A copy of the
geotechnical report prepared by Haley and Aldrich, and the SER's calculations for specific ele-
ments were also submitted.

Checked to assure that the dc3ign loads are ic conformance with The requirements of
the Massachusetts State Building Code, 780 CMR - Sbmh Edition.
Checked that the design criteria and assumptions conform to 780 CMR, and are in
general compliance with accepted engincering practice.
Reviewed the Geotechrucal report for verification that the design properly incorporate$
its results and recommendations.
V Checked that the organization of the structure is conceptually correct and that the load
paths are adequate to deliver forces from the building frame through the foundations
and into the supporting sub grade.
Performed independent calculations for a representative 1kartion of the systems, Mem-
bers and details, adequate to form a basis for our conclusions.
Durins the course of our review, we exchanged correspondence with, and COnferred directly by
phone with Mr. Gales, the SER, to request clarifications and discuss issues of concem. All such
Issues of concern have been resolved to our satisfaction and we have been Wormed the final con-
struction will incorporate the necessary adjustments.

I have reviewed the Planning Board's decision for MRI. Condition 5(0 states that unless
otherwise specified the conditions of the approval -shall be e&ctive upon operation of the
emission control project therefore the majority of the condition must be completed prior to the
issuance of the occupancy permit. However, the following items must be completed at this time:
1. Condition l(b): MRI_ must submit a copy of any new contract with MRI to demonstrate that
the contract requires compliance with the Designated Route. MRI must also demonstrate that
it has used best efforts to incorporate the Designated Route into existing contracts.
2. Condition l(d): MRI must submit proof that reminders have been sent out to the MRI
Contract Haulers regarding the use of the Designated Route.
3. Condition I (f): MRI must submit proof that reminders have been sent out to NESWC with a
request that NESWC advise its member communities about the route restrictions.
41 _U4 Condition.10j): MR1 must submit copies of its applications as needed to the Massachusetts
Highway Department and the North Andover Public Works.
5 Condition 2(c): 1�M must submit copies to the Town Manager's Officer of all reports issued
to regulatory agencies after August 25, 1998.
Condition 5(d): MR1 shall pay to the Town the lump sum of twenty-five thousand dollars
($25,000) on or before January 2, 1999.

7. The decision must be recorded at the Registry of Deeds and a certified copy returned to the

applicable state and federal -statutes and regulations.

environmental control and monitoring systems, vehicles and equipment which the
permittee installs or uses.

Februaiy 10.
This letter transmits three complete sets of seven stamped drawings (two full-size and one reduced -
size) for your use with the Phase I Building Permit Application. As you requested, design holds have
been removed and electrical drawings have been included. Please discard the two sets of superseded
drawings contained in our initial submittal.
This letter also confirms the hand -delivery of the copies of documents obtained from Registry files
pertaining to the project. These included North Andover ZBA approvals and decisions filed in Book
5227, pages 304 through 320, and five EMCON drawings (#86458-001-003 Rev. 2, 004 Rev. 4, 005
Rev. 0, 006 Rev. 0, and 010 Rev. 0) filed as Plan 13342 2.25.

Building Permit Application for the Phase I portion of the Emissions Control Project. The
Emissions Control Project has received approval of several North Andover boards; copies of these
approvals are provided for your information.
Wheelabrator Air Pollution Control (WAPQ is the overall Project Construction Manager; all
construction associated with the subject project will be done under subcontract to WAPC.
The Phase I scope of work is described in the attached WAPC letter with drawings and cost
information.

The petitioner, Massachusetts Refusetech.- Inc., a wholly owned
subsidiary of U.O.P., Inc., of Des Plains, Illinois, seeks a
variance of the provisions of Section 7, Par. 7.4, and Table 2
of the Zoning By Law to enable it to construct a structure which
will exceed . the height requirements of the Zoning By Law on preiri,se!
located on the North side of Holt Road.
The land is owned by the I Commonwealth of Massachusetts adjacent to
the North Andover Sanitary Landfill and is located in the Industria
2 zoning district. It is proposed to construct a resource recovery
system in cooperation with communities in Northeast Massachusetts
ast New Hampshire, known as the Northeast Solid Waste

The petitione ' r will eventually obtain title or release to the
premises. The petitioner introduced evidence showing -that the
project will consist of industrial type buildings consisting of :,4
tipping floor, storage pit, overhead cranes for feeding. refuse
into the system, utility type boilers, and a materials recovery
system. The project wi,ll incinerate solid waste and generate
electricity.
Drawing No. 5-7190-01.01-009D REV 0, dated March 25, 1982 was
submitted and made part of the petitioner's application.
The evidence presented shows that a major equipment component
of the facility is the utility type boiler which absorbs. heat'
from hot gasses from the combustion of the refuse. The design ."�,'�n
parameters for the boiler require a relatively tall furnace which
will exceed the Table 2, Indu'strial-2 maximum height of 55 feet"
by approximately 47 feet as shown on th.e aforementioned drawi,ng','
Upon a motion made by Mr. Frizelle and seconded by Mr. Foulds,
the Board voted unanimously to grant the variance as requested
by the petitioner.
Pursuant to Paragraph 7.4 and 10.4 of the Zoning By Law, the
Board finds that said structure will not affect the zonin 9 district
in general and that a literal enforcement of the height restriction
would involve a substantial hardship to the petitioner and the
Northeast Solid Waste Committee Project and, further, that the
relief can be granted without substantially derogating from theil.',
intent and purpose of the Zoning By Law.

Per our telephone conversation, 1 would like to correct some mis-
information that is floating around the area.
The stack height proposed for the NESWC facility is 250 feet. The
FAA has limited us to a tip elevation of 290 feet above MSL and the
approximate base of stack elevation is 40 feet MSL. The site grading
plan has not been developed as yet and the base of stack elevation
could vary slightly, but the tip.of stack elevation will be held at
elevation 290 feet.
Your staff's conclusion that 160 feet might I not be sufficient to
protect your facility is valid. For your information, I am enclosing
a copy of the USEPA Preliminary Determination (draft,permit) dated
April 12, 1982.
I hope this data is sufficient to allow your staff to determine that
we plan to be a good neighbor and control our emissions to an accept-
able level. If, in the review of this, your staff has any questions -
please call.

Attached is an ammended application.tackground:
1. Massachusetts REFUSETECH, INC. (MRI), submitted a variance request
under Section 7.4 on March 25, 1972.
2. A public hearing was scheduled and held on April 12, 1982.
3. The Notice of Decision was issued for a building variance dated
April 13, 1982.
4. The original application was submitted for the building only due to
various local and Des Plaines,I11 personnel interpretation of Section 7.4
which excludes a free standing stack.
5. Subsequent to the issuance of the Notice of Decision, the Town Legal
Council has determined the stack is not excluded from the height
limitations shown on Table 2 for 1-2 District.
Therefore, -MRI, respectfully requests an Emergency Hearing to include the
request for a variance for the installation of a 230 foot stack. The top of
the stack will exceed the Table 2 limit of 85 feet by 150 feet. The attached
marked -up print shows this elevation.
I apologize for any inconvenience this mis-interpretation may have caused
and request your expeditious processing.

structural steel, fencing and civil work costs to be subject to Building Permit Fees. The Site
Work, Demolition, Buildings & Enclosures, Equipment Foundations and Building Services
categories listed above (totalling $3,766,302) include all these costs as well as all other costs
associated with the supply & installation of buildings & enclosures on this project. The balance of
the direct costs and the air pollution control equipment are considered Process Equipment outside
of the "Building Costs". The Indirest Costs are considered "soft costs" that are also not included
in the Building Costs.
