On February 25, 2000 representatives from the Health and Building Departments
conducted an inspection with your daughter, Cathy, at the above address. This was a
follow-up inspection as specified in the letter sent to you on January 19,2000. (Please see
the attached copy) I have noted on the copy those items that have been addressed as
requested.
The progress of trash removal is noted, howeverthe premises are still far from
being in a habitable condition. Discussion during the inspection identified additional or
outstanding concerns. Mr. Nicetta, Building Inspector, and Susan Ford, Health Inspector
had the following issues.
I ) The side door must be secured immediately
2) The garage windows must be covered as soon as possible.
3) The dumpster should be removed as planned
4) The unregistered car is to be removed
5) The remaining trash inside should be removed
6) All contaminated furniture should be removed
7) Clean-up of household items should continue
8) Possible fumigation of premises
9) Removal of contaminated floors and walls as needed
10) Clean basement as needed
Please be advised that this structure remains uninhabitable due to the fact that
there is no water presently serving the home. The sanitary condition also remains of
great concern and is not conducive to human habitation. This office is very concerned for
the well being of your family and of the residents of this town, therefore, we support any
decisions which will bring this situation to closure in a timely manner.

Violations to be addressed by January 25, 2000 the following tasks must be
complete:
v�L-l) Cease all occupancy of the residence
,�,g�2) Relocate any animals which may be living in the home to limit visits to cleaning
only
a 1<-3) Secure home with proper locks to deter entry while the home is uninhabited. :5;d --A-
6(--4) Contract with a No. Andover permitted dumpster company to have a dumpster 4 -
established at the site.
Contract with a company toprovide a portable bathroom that is to remain on site
until the Health Department deems the area sanitary enough for human use.

This department will contact you periodically concerning the progress of these
tasks. A full inspection will be requested for February 21, 21000. If you are unable to
complete the tasks on your own, we recommend in these situations that you contract with
a professional cleaning company. Their expertise is often needed in these extreme
conditions. This correspondence will serve as an official Order Letter issued by the
North Andover Health Department.
Please be advised that the failure to comply within the allotted time period may result in a
criminal complaint against you in the Lawrence District Court and may result in an
assessment of a fine. You have the right to request. a hearing before the Board of Health if
you feel this order should be modified or withdrawn. A request for said hearing must be
made in writing and received by the Health Department within seven (7) days from the
receipt of this order. At said hearing you will be given an opportunity to be heard and to
present witness and documentary evidence as to why this order should be modified or
withdrawn. All affected parties will be informed of the date, time and place of the
hearing and of their right to inspect and copy all records concerning the matter to be
heard. An attorney may represent you. You also have the right to inspect and obtain
copies of all relevant records concerning the matter to be heard.

This correspondence is in regard to the complaint received at the Health Department in
relation to your property noted above. On the evening of January 17, 2000, a
representative of the Health Department was summoned to your home by the North
Andover Police Department. The police had responded to a report of an unsecured home
when they deemed our presence necessary. Upon a brief inspection by Health personnel,
it was determined that your home did not presently meet the standards of fitness for
human habitation.
The property was found to be in a severe unhealthy condition. The level of debris and
clutter, in all of the rooms, was considered to be an extreme fire hazard. There was no
running water, a foul smell throughout and the bathroom was unclean and unsanitary.
These are conditions that are deemed to endanger or impair the health or safety of any
occupants, as found in. the State Sanitary Code, 105 CMR 410.750. In addition, there was
also concern for the cats that occupied the home.
In speaking with your daughter, at the site, she stated that no persons were presently
living in the home. Acknowledging the fact that there was no one in imminent danger, it
was decided that I would wait to contact you the following day to determine the course of
action. In actuality, you contacted me on the morning of January 18, 2000 at the Health
Department. I appreciate your effort to address the situation as soon as possible. With
your cooperation, I am hopefal that we can bring this property back to a safe and livable
condition and avoid any further action by this department.
My conversation with you resulted with the following issues to be addressed and time
tables to be met.

Dear Ms. Kiersted,
On February 11, 2000 representatives from the Health and Building Departments
were called to 3 Columbia Ave. by the North Andover Fire Department dispatch. In
response to an anonymous phone call the fire personnel responded to the home about
concerns of running water in the basement. Upon amival the premises was found not
secured and the new.doorknob was found to be inoperable. In addition, through
basement windows they found that the boiler had apparently frozen and cracked and the
water was coming out onto the floor.
These observations prompted our requested presence, as well as that of the N.
Andover DPW, who immediately shut off the water from the street main. 1 informed the
Building Inspector, Robert Nicetta that the Health Department has been working with
you in the cleanup of your home. I also assured him that there was an ageement that no
one is to live in this home until it is deemed habitable by this department.
I am forwarding a copy of this letter as well as the previous communication to Mr.
Nicetta. He has agreed to allow the work to continue under the timeline that was
previously put forth. He will then accompany me on the re -Inspection to be held on or
around the 2 1" of February. If the premises is not secure or found to be in a dangerous
condition our offices will have to consider legal action. Until that time we have asked the
police officers present to keep a close eye on the property to be sure it is properly secured
and uninhabited.

A site reinspection was done at your home today regarding
a complaint received by the Board of Health concerning, especially,
an excessive amount of dog excrement littering the lawn of your
property at 3 Columbia Drive.
The situation described in the complaint had not improved, and
we must now notify you that if the property is not completely
clean in one week you will be requiredto appear before the Board
of Health at its next meeting on April 26th, at 7:30 p.m.
