Avrett, Managing Trustee Center Realty Trust EHA/ptd Enclosures 1755p q0 MEMORANDUM TO: North Andover Board of Appeals RE: Petition of Center Realty Trust 3 Great Pond Road North Andover, Massachusetts Statement of Facts: In September of 1984, the Petitioner, Center Realty Trust, purchased from.the North Andover Grange the building at 3 Great Pond Road. The building is a wood frame structure built: in 1910 and is located in a Residence 3 zoning district. Prior to the time of the purchase, the Petitioner negotiated a lease with the Nevins Adult Center for the use of the first floor. After renovations to the building to accommodate the needs of the first floor tenant and to comply with the recommendations of the Building Inspector to make the first and second floor of the building safer, the Center Realty Trust was given a Certificate of Use and Occupancy to allow the building to be occupied as "alterations to Grange Building". As the Building Inspector made specific recommendations during the renovation so as to make the second floor safer for groups and social gatherings, the petitioner understood this occupancy permit to allow it to continue the use of the second floor of the building as a place of assembly. Later the Center Realty Trust was informed by the Building Inspector that he would not permit the use of the second floor as a place of assembly for rental to various groups for social gatherings. The Building Inspector relies on the North Andover Zoning By -Law and the State Building Code. Specifically, he relies upon the North Andover Zoning By -Law, Section 4.121 and Table 1 (Summary of Use Regulations) which prohibit the use of a building as a place of assembly in a Residence 3 district, and upon Table 305 of the State Building Code which limits the use of wood frame buildings as places of assembly (A-3 use) to the first floor only. The center Realty Trust has filed a petition with the North Andover Zoning Board of Appeals as a party aggrieved from a decision made by the Building Inspector pursuant to Massachusetts General Laws, Chapter 40A, Section 8 and Section 10.4 of the North Andover Zoning By -Law. Discussion of Merits of Appeal: As stated in the Petitioner's Application, during the time the North Andover Grange owned the building, the Grange continually used the entire building as a place of assembly from and after its construction in 1910. The Grange's records make numerous references to hall rentals throughout its ownership of the building. The North Andover Zoning By -Law was adopted in 1943, and zoning districts, within which only certain enumerated uses were permitted, were established. The building is in a Residence 3 district where a place of assembly is not permitted without a variance. However, Massachusetts General Laws, Chapter 40A, Section 6 and Section 9.1 of the Zoning By -Law specifically provide for the continuance of pre-existing non -conforming uses. -2- Since the building was being used as a place of assembly prior to the enactment of the Zoning By -Law, and as such use has continued to the present, the use of the building as a place of assembly constitutes a pre-existing non -conforming use, the continuation of which is permitted under Massachusetts Statute and the North Andover Zoning By -Law. . The State Building Code also provides for some "grandfather" -protection of buildings existing prior to the enactment of the Code. See Massachusetts General Laws, Chapter 143, Section 92. Sections 105, 119 and 2200 of the State Building Code provide for continuation of non -conforming uses, notwithstanding Table 305, provided that various other Code sections are complied with. As the Building Inspector does not rely on any other portion of the Building Code, other than the use requirements of Table 305, as the basis for prohibiting the use of the second floor as a place of assembly, the non -conforming use must be allowed to continue. In addition, Section 308 of the State Building Code entitled "Height Exceptions" provides that upon the installation of approved sprinkler sys tems, a building may be erected one story higher than permitted in Table 305. As the proposed use of the building is classified as A-3 under Table 305, the installation of a sprinkler system would enable the Petitioner to use the second floor as a place of assembly, even without relying on the so-called "grandfather provisions" of the Building Code. The petitioner has offered to install a -3-- 0 complete sprinkler system throughout the structure in order to satisfy the Bu ilding Inspector's concerns regarding fire safety, yet the Building Inspector has indicated that he will not allow the use of the second story as a place of assembly, even upon the installation of a sprinkler system. Summary of Relief Sought: The Petiti.oner seeks an order from the Board of Appeals directing the Building Inspector to issue a Certificate of Use and Occupancy allowing the use of the second floor of the building as a place of assembly, conditional upon the installation and approval of a complete sprinkler system throughout the building. In the alternative, the Petitioner seeks a decision by the Board stating that the use of the second floor of the building as a place of assembly constitutes a pre-existing non -conforming use and that said use may continue provided the building meets the requirements of the State Building Code taking into consideration the provisi-ons in the Code relating to pre-existing buildings. This system,, in addition to other renovations undertaken at your request, should be sufficient to allow us to use the second floor of the Grange Building as a place of assembly for a maximum of 150 people. As I have previously told you, I met with Chief Dolan of the North Andover Fire Department on March 20, and he indicated to me that the Fire Department would voice no objection to use of the second floor as a place of assembly after the installation of a complete sprinkler system (subject to inspection and approval by the Building Inspector and the Fire Department) . You have indicated to me that you will refuse to issue an occupancy permit for use of the building as a place of assembly for a maximum of 150 people even if such a system is installed. We feel that this position is unreasonable and in contravention of the provisions of the North Andover Zoning By -Laws and the State Building Code. Description of relief sought on this Petition: Petitioner seeks order from Board of Appeals directing the Building Inspector to issue a Certificate of Use and Occupancy allowing the second f loor of the subject premises to be used as a place of assembly for 150 persons (with a maximum of 200 persons in the building at any one time). 8. The principal points upon which the Application is based: The subject building is a two (2) story wood frame building located at 3 Great Pond Road in a Residence 3 District. The first floor is currently leased to the Nevins Adult Day Health Center, Inc. The use of the second floor is currently limited to gatherings of less than 50 persons at the Building Inspector's request. The Petitioner seeks permission to use the second floor of the building as a place of assembly for no more than 150 persons (with a maximum of 200 persons in the building at one time) as previously allowed by the Building Inspector. (See copy of Certificate of Inspection dated February 24, 1984 attached hereto and marked Exhibit "A".) In order to accomodate the first floor tenant, the Petitioner caused the building to undergo extensive renovations, all of which were approved by the Building Inspector. (See copy of Certificate of Use and Occupancy dated April 3, 1985 attached hereto and marked Exhibit "B".) Although the second f loor was used as a place of assembly prior to renovations to the building, the Building Inspector has issued conflicting Occupancy Permits ostensibly limiting the use of the second floor to a maximum of 50 persons. (See copy of Certificate of Use and Occupancy dated April 3, 1985 and attached hereto as Exhibit "C".) The Petitioner has requested that the Builidng Inspector issue a Certificate of Use and Occupancy permitting the use of the second floor as a place of assembly. (See copies of correspondence dated March 17, 1986 and April 4, 1986 attached hereto and marked Exhibits "D" and "E" respectively.) The Building Inspector has stated that the use of the second floor as a place of assembly would violate the Town of North Andover Zoning By -Law and the Commonwealth of Massachusetts State Building Code. 1. The Building Inspector argues that since the premises are located in a Residence 3 District', the use of the building as a place of assembly is prohibited. However, Section 9 . 1 of the North Andover Zoning By Law allows the continuance of nonconforming uses. From the time of the construction of the building in 1910, the building had been used by the North Andover Grange , as a place of assembly until the Petitioner purchased the building in 1984. The Grange frequently conducted dances ' fairs, auctions, etc. on the premises and leased the premises to various groups for such uses. (See Summary of North Andover Grange records regarding activities conducted on premises attached hereto and marked Exhibit "F". Original records will be made available to the Board of Appeals upon request.) As the use of the entire building as a place of assembly pre -dates the North Andover Zoning By -Law, and as such use has continued until the Building Inspector's recent directives, Section 9.1 of the Zoning By -Law and Massachusetts General Laws, Chapter 40A, Section 5.6 permit the building to be continued to be used as a place of assembly. The Building Inspector also bases his refusal to issue an Occupancy Permit upon the State Building Code which purports to prohibit use of the second floor of wood frame buildings as a place of assembly. However, the Building Code specifically provides that uses in existence prior to the enactment of the Building Code may be continued provided that the premises are maintained in a safe and sanitary condition. The Building Inspector has informed the Petitioner that his main objection to the use of the second floor is based on fire safety. The Petitioner has offered to install a complete sprinkler system throughout the building, which system would undergo inspection by the Building Inspector and the Fire Department prior to the Petitioner's use of the second floor as a place of assembly. The Fire Department has indicated to the Petitioner that it would have no objections to the requested use of the premises provided the sprinkler system meets their specifications. As the use of the building as a place of assembly pre -dates the Building Code, the building should be allowed to be continued as a place of assembly provided that the building is otherwise safe for Occupancy. Massachusetts General Laws, Chapter 40A, Section 6 provides that "a zoning ordinance or by-law shall not apply to structures or uses lawfully in existence or lawfully begun...before the first publication of notice of the public hearing on such ordinance or by-law.0 Furthermore, Section 9.1 of the North Andover Zoning BY -Law provides that *any non -conforming building, structure or use ... which lawfully existed at the time of passage of the applicable provision of this or any prior by-law or any amendment thereto may be continued..." Although the subject premises are located in a residential district, the second floor had been used by the North Andover Grange and rented by other groups for use as a place of assembly since the time of construction of the building. Prior to the enactment of the North Andover Zoning By -Law, activities at the second floor consisted of "fairs, dances, suppers, lunches, auctions, etc." Center Realty Trust of North Andover seeks merely to continue the non -conforming use of said second floor. 2. With respect to the Massachusetts State Building Code (780 C.M.R. 100 et seq.) (the 'code") Certificate of Inspe�ction, Center Realty's reasons for demanding that you issue a Certificate indicating a second floor hall capacity of 150 are as follows: Massachusetts General Laws, Chapter 143,, Section 92 provides that "no new state building code, rule or regulation or amendments thereof shall affect any building permit lawfully issued, or any building or structure lawfully begun in conformance with such permit, before the effective date of the State Building Code...w Furthermore, Section 105.1 of the Code provides as follows: 'The legal use and occupancy of any existing structure for which it had been heretofore approved, may be continued without change...' Code Section 2200.3.8 provides that "nothing contained herein shall prohibit the alteration of the building heretofore occupied as a place of assembly for such continued use, provided that the seatsf isles, passageways, balconies, stages, appurtenant rooms, and all special permit equipment comply with provisions of Sections 417.0 and 418.0. Code Section 417.2.6 provides that *nothing herein contained shall prohibit the alteration of a building heretofore occupied as a place of assembly for such continued use provided seats, isles, passageways, balconies, stages, appurtenant rooms and all special permanent equipment comply with the requirements of this Article.* Charles Foster March 17, 1986 Page -3- As the second floor appears to meet the requirements of Article 22 of the Code, the use of the second floor as a place of assembly should be allowed to continue. As the building pre -dates the Code,, and as the use of the second floor has not been changed, we consider your refusal to issue an inspection certificate indicating a capacity of 150 individuals to be in contravention of the State Building Code. Should you fail to issue a Certificate of Use and Occupancy in accordance with the above, we will have no alternative but to avail ourselves of the redress procedures established by applicable statutes and ordinances.
